The Regular Meeting of the Board of Commissioners met in the City Commission
Meeting Room, City -County Building, on Monday, February 25, 1980, at four o'clock
P.M.
There were present:

CITIZEN FORUM
Ruth Ascher, League of Women Voters, and Virginia Usher, Teacher at
North Junior High School, spoke against the closing of the paper recycling
center.
AWARDS - PROCLAMATIONS
(4.1) The Mayor proclaimed the Month of March, 1980 - ''RED CROSS MONTH''. The
proclamation was read by Doug Ramsey.
PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME
(5.1) Resolution Number 80-3478, resolution of intent to issue $620,000
Industrial Revenue Bonds for Wilson & Company.
Bob Reichert, 1933 Ruskin Road, Retired Engineer, spoke against
Industrial Revenue Bonds in general.
C. L. Clark, attorney for Wilson & Company, said the company has
waived its tax exempt status allowed by law.
80-51 Moved by Commissioner Allen, seconded by Commissioner Hodges that
Resolution Number 80-3478, a resolution of intent to issue $620,000 Industrial
Revenue Bonds for Wilson & Company, be adopted. Aye: (3). Nay: (0). Motion
adopted.
CONSENT AGENDA
(6.1) Approval of the Minutes of the Regular Meeting February 11, 1980.
(6.2) City Engineer report on bids received February 14, 1980 for street
improvements in Fox Run Addition. [Engineering Project 80-6591
(6.3) Cereal malt beverage license application filed by Robert E. Eveleigh,
d/b/a Bob's IGA, 605 East Crawford.
(6.4) Tree trimming and treating license applications filed by Clinton R.
Davis, d/b/a Shamrock Tree Service, 1518 Cloud Circle, and Charles Ryan, d/b/a
Ryan Landscaping, Route 1, Box 151H, Salina, Kansas.

11 items on the consent agenda be approved. Aye: (3). Nay: (0). Motion adopted.
DEVELOPMENT BUSINESS
(7.1) Recommendation from the City Planning Commission that Zoning Application
80-1, filed by George F. Johnson, for the rezoning of the E 1/2 of the South 13'
Lot 95 and the E 1/2 of Lots 97 and 99 on Highland Avenue Grounds of Kansas
Wesleyan University, be approved and Ordinance Number 80-8778 be introduced for
first reading.
80-53 Moved by Commissioner Hodges, seconded by Commissioner Allen that the
recommendation of the City Planning Commission be accepted and that Ordinance
Number 80-8778, providing for the amendment of Ordinance Number 8526, the same
being Chapter 36 of the Salina Code, and the Zoning District Map therein and
thereby adopted and providing for the rezoning of certain property within the
city and prescribing the proper uses thereof, be introduced for first reading.
Aye: (3). Nay: (0). Motion adopted.
ADMINISTRATION
(8.1) Second Reading Ordinance Number 80-8777, levying special assessments
for street and utility improvements in Eastridge, Meadowlark Acres #3, and
Wallerius Additions. [Engineering Project 79-6521
80-54 Moved by Commissioner Allen, seconded by Commissioner Hodges that
Ordinance Number 80-8777, levying special assessments on certain lots, pieces and
parcels of ground in the City of Salina, Kansas, for the purpose of paying a
portion of the cost of street and utility improvements in Eastridge, Meadowlark
Acres #3, and Wallerius Additions, be adopted. Aye: Allen, Hodges, Geis (3).
Nay: (0). Mayor Graves and Commissioner Duckers absent. Motion adopted.
[Engineering Project 79-6521
(8.2) Reconsideration of Ordinance Number 80-8774, authorizing the issuance
of $1,450,000 Industrial Revenue Bonds for Windsor Nursing Home Associates, Inc.
80-55 Moved by Commissioner Hodges, seconded by Commissioner Allen that
Ordinance Number 80-8774 not be reconsidered. Aye: (3). Nay: (0). Motion
adopted.
(8.3) Request from Viron Energy Management Services to speak to the City
Commission.
Bob Martin, with Viron, didn't know the City -County Building was
controlled by an Authority, and was talking to the wrong commission.
The Commission took no action.
(8.4) Resolution Number 80-3480, determining that the plans and specifications
for the improvement of certain property in the Northeast Industrial Park complies
with the restrictions and covenants in a certain contract for Sale of Land for
Private Development.
80-56 Moved by Commissioner Hodges, seconded by Commissioner Allen that
Resolution Number 80-3480, determining that the plans and specifications for the
improvement of certain property in the Northeast Industrial Park as submitted by
Gerald K. Palmer, M.D., Norman E. Macy, M.D., and Boyd E. Smith, M.D., complies
with the restrictions and covenants in a certain Contract for Sale of Land for
Private Development, be adopted. Aye: (3). Nay: (0). Motion adopted.
(8.5) First Reading Ordinance Number 80-8779, authorizing the issuance of
$380,000 Industrial Revenue Bonds for Gerald K. Palmer, M.D., Norman E. Macy,
M.D., and Boyd E. Smith, M.D.
80-57 Moved by Commissioner Hodges, seconded by Commissioner Allen that
Ordinance Number 80-8779, authorizing the City of Salina, Kansas ("City''), to
acquire the real property hereinafter described and to construct and purchase a
building and real estate improvements to be leased to Gerald K. Palmer, M.D., and
Norman E. Macy, M.D., and Boyd E. Smith, M.D. ("The Doctors"), authorizing and
directing the issuance of $380,000 principal amount of The Doctors Industrial
Revenue Bonds, Series of 1980, of said City for the purpose of providing funds to
pay the cost of acquiring the real property hereinafter described and the
construction of a building, and real estate improvements thereon, to be leased to
the Doctors, and prescribing the form and authorizing the execution of a lease by
and between said City and the Doctors, be introduced for first reading. Aye:

(8.6) City Clerk reported the assessment rolls are ready for Engineering
Project 79-646 for street and utility improvements in Replat of Block 1, Dow
Addition, Twin Oaks Subdivision, Grain Belt Subdivision, Woodland Addition and
Marydale Addition.
80-58 Moved by Commissioner Allen, seconded by Commissioner Hodges that the
City Clerk be instructed to publish notice in the official city newspaper at
least once not less than ten days prior to the date of March 10, 1980, the date
set for the hearing on said assessments, and that at the same time notice is
published to mail to the owners of property made liable to pay the assessment, at
their last known post office address, a notice of the hearing and a statement of
the cost proposed to be assessed against the land so owned and assessed. Aye:
(3). Nay: (0). Motion adopted.
(8.7) First Reading Ordinance Number 80-8780, repealing Article 1, of Chapter
22A of the Salina Code, pertaining to the Neighborhood Centers Board.
80-59 Moved by Commissioner Allen, seconded by Commissioner Hodges that
Ordinance Number 80-8780, repealing Article I of Chapter 22A of the Salina Code,
the same being Sections 22A-1 through 22A-5, inclusive, pertaining to the
Neighborhood Centers Board, be introduced for first reading. Aye: (3). Nay:
(0). Motion adopted.

Regular Meeting of the Board of Commissioners be adjourned. Aye: (3). Nay: (0).
