REGULAR MEETING OF THE BOARD OF COMMISSIONERS
JANUARY 14, 1980

The Regular Meeting of the Board of Commissioners met in the City Commission
Meeting Room, City -County Building, on Monday, January 14, 1980, at four o'clock
p.m.
There were present:

AWARDS - PROCLAMATIONS
(4.1) The Mayor proclaimed January 15, 1980 - "DR. MARTIN LUTHER KING, JR.
COMMEMORATION DAY". The proclamation was read by Betty Pierce.

CONSENT AGENDA
(6.1) Approval of the minutes of the Regular Meeting January 7, 1980.
(6.2) Resolution Number 80-3474, authorizing and ordering certain asphaltic
concrete overlay applied to all existing streets in Fox Run Addition to the City
of Salina, Kansas; remove and replace all areas of existing pavement that show
structural deterioration; remove and replace defective curb and gutter; and
crack sealing of existing pavement; ordering preparation of plans and
specifications, and the estimate of costs.
(6.3) Contract with Bucher and Willis for "701" Comprehensive Plan Update.

(8.1) Second reading Ordinance Number 80-8773 annexing certain land to the
City. [Marymount Tract #1, Annexation Application 79-91
80-14 Moved by Commissioner Geis, seconded by Commissioner Hodges, that
Ordinance 80-8773, annexing certain land to the City of Salina, Kansas, in
conformity with the provisions of K.S.A. 12-519 to 12-526, inclusive, be adopted.
Aye: Allen, Duckers, Geis, Hodges, Graves (5). Nay: (0). Motion adopted.
(8.2) First Reading Ordinance Number 80-8774 authorizing issuance of
$1,450,000 Industrial Revenue Bonds for Windsor Nursing Home Associates, Inc.
80-15 Moved by Commissioner Allen, seconded by Commissioner Hodges that
Ordinance 80-8774, authorizing the City of Salina, Kansas, to acquire the real
property hereinafter described and to construct, purchase and install buildings
and improvements and furnishings and equipment to be leased to Windsor Nursing
Home Associates, Inc., a Kansas Corporation; authorizing and directing the
issuance of $1,450,000 principal amount of nursing home revenue bonds, Series
1980, of said city for the purpose of providing funds to pay the cost of acquiring
said real property and constructing, purchasing and installing said buildings
and improvements and furnishings amd egipment to be leased to said company;
prescribing the form and authorizing the execution of a lease by and between
said city and said company; and prescribing the form and approving the execution
of a guaranty agreement by said company; and making an election under Section
103(b)(6)(D) of the Internal Revenue Code, be introduced for first reading.

(8.3) First reading Ordinance Number 80-8775, franchise ordinance for Salina
Cable TV System, Inc. [Deregulation of cable TV rates.]
80-16 Moved by Commissioner Allen, seconded by Commissioner Duckers that
Ordinance Number 80-8775, granting to Salina Cable T.V. System, Inc., a
corporation, its successors, lessees and assigns, for a term of fifteen (15)
years, the right, authority, power and franchise to establish, construct,
acquire, maintain and operate a community antennae and closed-circuit electronic
system within the City of Salina, Kansas, to render, furnish and sell community
antennae and closed-circuit electronic service therefrom within the City of
Salina, Kansas, and environs thereof, and to use and occupy the streets and
other public places of the City of Salina, Kansas, for such community antennae
and closed-circuit electronic system; and repealing Ordinance Number 8544, be
introduced for first reading. Aye: Allen, Duckers, Hodges, Graves (4). Nay:
Geis (1). Motion adopted.
Herman Wiesner wants to Commission to leave the ordinance as it is.
lie is concerned about the type of programs on cable.
Frieda Fox, 841 Custer, does not have cable, and doesn't want it, she
has her own antenna.
Eleanor Sullivan, #3 Crestview Drive, wants to know if the city gets a
balance sheet from Cable TV. She is against the deregulation.
Larry Justus, Manager of Salina Cable T.V., said the market place and
the free enterprise system will regulate TV rates for Cable TV.
(8.4) Resolution Number 80-3473, establishing an Alcohol Fund Advisory
Committee.
80-17 Moved by Commissioner Duckers, seconded by Commissioner Hodges that
Resolution Number 80-3473, to establish an Alcohol Fund Advisory Committee, be
adopted. Aye: (5). Nay: (0). Motion adopted.
(8.5) Resolution Number 80-3475, to submit to the qualified electors of the
City of Salina, the proposition of levying one-half of one percent (.5) retailer's
sales tax in the City of Salina, Kansas.
Ed Shepard, Central Kansas Foundation for Alcohol, stated he is pleased
with the resolution.
80-18 Moved by Commissioner Geis, seconded by Commissioner Hodges that
Resolution Number 80-3475, to submit to the qualified electors of the City of
Salina the proposition of levying one-half of one percent (.5%) retailer's sales
tax in the City of Salina, Kansas, be adopted. Aye: (5). Nay: (0). Motion
adopted.
(8.6) Resolution Number 80-3476, to repeal the three percent (3%) intangibles
tax as authorized by Kansas Statutes.
80-19 Moved by Commissioner Allen, seconded by Commissioner Geis that
Resolution Number 80-3476 to repeal the three percent (3%) intangibles tax as
authorized by Kansas Statutes, be adopted. Aye: (5). Nay: (0). Motion adopted.
