01-29-2020 Minutes (Special) CITY OF SALINA,KANSAS SPECIAL MEETING OF THE BOARD OF COMMISSIONERS January 29,2020 1:30 p.m. The Special Meeting of the Board of Commissioners was called to order at 1:30 p.m. in Room 202 at Tony's Pizza Events Center,800 The Midway. Roll call was taken. Those present and comprising a quorum: Vice-Mayor Melissa Rose Hodges (presiding), Commissioners Trent Davis,Rod Franz,and Karl Ryan. Also present: Michael Schrage, City Manager;Jacob Wood, Deputy City Manager;Greg Bengtson, City Attorney;and Shandi Wicks,City Clerk. Absent: Mayor Michael Hoppock Vice-Mayor Hodges asked the Clerk for verification that notice had been sent for today's City Commission meeting.The Clerk replied yes. ADMINISTRATION 2. Public Segment. Opening Remarks and Schilling Project overview Tim Rogers, Executive Director, Salina Airport Authority, stated the purpose of the executive session was for an update from environmental counsel. • Introduction of additional participants in joint executive session by Tim Rogers: Mike Schrage, City Manager, City of Salina Linn Exline, Superintendent, USD 305 Tim Rogers, Executive Director, Salina Airport Authority Cindy Bontrager, VP & COO, Kansas State University Martha Tasker, Director of Utilities, City of Salina Eryn Wright, Legal Counsel, USD 305 Greg Bengtson, Legal Counsel, City of Salina and Salina Airport Authority Matthew Schroeder, Senior Environmental Engineer, Dragun Corporation Dr. Michael Sklash, Senior Hydrogeologist, Dragun Corporation Doug Curran, Attorney, Stinson LLP Andy Davis, Attorney, Stinson LLP Aaron Good, Legal Counsel, Kansas State University Jacob Wood, Deputy City Manager 3, Joint Executive Session. + City of Salina. Consideration of a motion for a joint executive session. "I move that the City of Salina Board of Commissioners recess into a joint executive session with the USD 305 Board of Education, the Salina Airport Authority Board of Directors, and representatives of Kansas State University for one-hour (1-hour) to discuss with Doug Curran, Page 1 environmental counsel for the Salina Public Entities, the subject of mediation zvith representatives of the U.S. Department of Justice and U.S. Army Corps of Engineers associated zvith pending litigation in U.S. District Court based upon the need for consultation with an attorney for the public bodies Which zvould be deemed privileged in the attorney-client relationship pursuant to K.S.A. 45-7319(b)(2). The City Commission recessed into executive session at 1:36 p.m. and reconvened at 2:36 p.m. No action was taken. 20-0039 Moved by Commissioner Ryan, seconded by Commissioner Davis,to recess into a joint executive session with the USD 305 Board of Education, the Salina Airport Authority Board of Directors, and representatives of Kansas State University for 15 minutes to discuss with Doug Curran, environmental counsel for the Salina Public Entities, the subject of mediation with representatives of the U.S. Department of Justice and U.S. Army Corps of Engineers associated with pending litigation in U.S. District Court based upon the need for consultation with an attorney for the public bodies which would be deemed privileged in the attorney-client relationship pursuant to K.S.A. 45-7319(b)(2).
