November 19, 1979
The Regular Meeting of the Board of Commissioners met in the City
Commission Meeting Room, City -County Building, on Monday, November 19, 1979 at
four o'clock p.m.
There were present:
Mayor Karen M. Graves, Chairman presiding
Commissioner Roy W. Allen

CITIZEN FORUM
Steve Ascher, Bike Committee, wants bike paths on both sides of
Crawford Street.
Ruth Ascher, League of Women Voters, stated their position is for bike
paths on both sides of East Crawford.
Neil Stevens, Smoky Valley Chapter of the Kansas Engineering Society,
suggested several ways to finance bike paths on East Crawford.
AWARDS - PROCLAMATIONS
THE MAYOR PROCLAIMED the Week of November 18 through 24, 1979 - "NATIO
DECA WEEK". The proclamation was read by Andrea Geis, Club Reporter.
PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME
A public hearing was held on the proposed assessments for street and
utility improvements authorized in Resolution Number 3385, passed by the Board
of Commissioners on the 7th day of August, 1978.
No protests, written or oral, were filed.
Moved by Commissioner Geis, seconded by Commissioner Hodges that the
special assessments in Engineering Project 78-628 be approved and that Ordinance
Number 8762, levying special assessments on lots, pieces and parcels of ground
in the City of Salina, Kansas, for the purpose of paying a portion of the cost
of street and utility improvements for The Midway, be introduced for first
reading. Aye: (5). Nay: (0). Motion adopted.
A public hearing was held on the proposed assessments for street and
utility improvements authorized in Resolution Number 3365, passed by the Board
of Commissioners on the 1st day of May, 1978.
No protests, written or oral, were filed.
Moved by Commissioner Allen, seconded by Commissioner Hodges that the
special assessments in Engineering Project 78-638 be approved and that Ordinance
Number 8763, levying special assessments on lots, pieces and parcels of ground
in the City of Salina, Kansas, for the purpose of paying a portion of the cost
of street and utility improvements in Ivey Park, be introduced for first reading.
Aye: (5). Nay: (0). Motion adopted.

A public hearing was held on the proposed assessments for street and
utility improvements authorized in Resolution Number 3372, passed by the Board
of Commissioners on the 5th day of June, 1978, and Resolution Number 3376,
passed by the Board of Commissioners on the 12th day of June, 1978.
No protests, written or oral, were filed.
Moved by Commissioner Duckers, seconded by Commissioner Geis that the
special assessments in Engineering Project 78-639 be approved and that Ordinance
Number 8764, levying special assessments on lots, pieces and parcels of ground
in the City of Salina, Kansas, for the purpose of paying a portion of the cost
of street and utility improvements in Country Club Heights #5 and Dow Additions,
be introduced for first reading. Aye: (5). Nay: (0). Motion adopted.
A public hearing was held on the proposed annexation of South Ohio
Street Tract Number 5, (32.3 acres - Annexation Application 79-7).
Moved by Commissioner Duckers, seconded by Commissioner Hodges that
the City Attorney be instructed to draft an agreement with Mr. Sinsabaugh that
if and when development begins or is contemplated on this property, that it will
be annexed. Aye: Allen, Duckers, Graves, Hodges (4). Nay: Geis (1). Motion
adopted.
A public hearing was held on the proposed annexation of South Ohio
Street Tract Number 6, (29.5 acres - Annexation Application 79-8).
Mrs. Jess Harper, 1706 East Cloud and Mrs. Floyd Newcomb, 1717 East
Cloud protested the annexation.
Moved by Commissioner Geis, seconded by Commissioner Duckers that
South Ohio Street Tract #6 be annexed in accordance with the Service Extension
Plan approved September 17, 1979 and on file with the City Clerk and that
Ordinance Number 8766, annexing certain land to the City of Salina, Kansas, in
conformity with the provisions of K.S.A. 12-519 to 12-526, inclusive, be introduce
for first reading. Aye: (5). Nay: (0). Motion adopted.
CONSENT
Moved by Commissioner Hodges, seconded by Commissioner Duckers to
remove the report on bids for life insurance from the consent agenda for separate
action. Aye: (5). Nay: (0). Motion adopted.
Approval of the Minutes of the Regular Meeting November 5, 1979.
Report on bids received November 15, 1979 for Engineering Project
79-655 for street and utility improvements in Meyer and Platten Additions.
Report on bids received November 15, 1979 for Memorial Hall Boiler.
Resolution Number 3464 - determining the overtime rate of pay as well
as the remuneration in lieu of holiday pay for employees working schedules of
twenty-four hours on duty and forty-eight hours off duty, and respectively
amending Sections III -3 and IV -3 of the Personnel Manual.
Moved by Commissioner Duckers, seconded by Commissioner Geis to approve
all other items the
on consent agenda. Aye: (5). Nay: (0). Motion adopted.
The Commission considered the report on bids received November 8, 1979
for group life insurance.
Ben Sellers, Jr., representing Seed -Siebert Insurance, protested the
bid being awarded to RGB/Schmidt instead of Mr. Siebert.
Moved by Commissioner Allen, seconded by Commissioner Geis to reject
all bids and to instruct the City Clerk to readvertise for bids on group life
insurance to be received December 6, 1979. Aye: Allen, Geis, Hodges, Graves
(4). Nay: (0). Commissioner
Duckers abstained. Motion adopted.

ADMINISTRATION
Moved by Commissioner Hodges, seconded by Commissioner Allen that
Ordinance Number 8722, releasing and vacating a portion of the "Clear Zone
Easement" acquired by the City of Salina, Kansas, in Case Number 21,538 in the
District Court of Saline County, Kansas, be adopted. Aye: Allen, Duckers,
Hodges, Graves (4). Nay: Geis (1). Motion adopted.
Bill Usher, Chairman of the Aviation and Transportation Committee of
the Salina Area Chamber of Commerce asked that action on the ordinance be
postponed for two weeks.
Dean Owens and Harry Steele, representing Presbyterian Manor, asked
for passage of the ordinance today.
Bob Berkley, representing Oliver Hagg wanted the ordinance passed
today, or they would withdraw their Quit Claim Deed.
Moved by Commissioner Hodges, seconded by Commissioner Duckers that
Ordinance Number 8760 providing for a Heritage Conservation District, defining
the purpose, establishing a Heritage Commission, defining the Commission
membership, term of office; prescribing the heritage conservation plan; providing
for a public hearing and a certificate of appropriateness review; establishing
the procedure for the demolition or removal of heritage landmarks; amending
Ordinance 8526, the same being Chapter 36 of the Salina Code, be adopted. Aye:
Allen, Duckers, Geis, Hodges, Graves (5). Nay: (0). Motion adopted.
Moved by Commissioner Hodges, seconded by Commissioner Geis that
Ordinance Number 8761, providing for the manner of notification to the operators
of motor vehicles who are overparked and providing for the manner and payment of
the penalty therefor; amending Section 22-190 of the Salina Code and repealing
the existing section, be adopted. Aye: Allen, Duckers, Geis, Hodges, Graves
(5). Nay: (0). Motion adopted.
Moved by Commissioner Geis, seconded by Commissioner Allen that Petition
Number 3779, filed by A & K Railroad, requesting street improvements for all
existing streets in the Northwest Quarter (N144) of Section 2, Township 15 South,
Range 3 West (aka Fox Run Addition) which are to be dedicated to the public.
These improvements shall consist of a three (3) inch asphaltic concrete overlay
applied to all existing streets; removal and replacement of all areas of existing
pavement that show structural deterioration; removal and replacement of defective
concrete curb and gutter; and crack sealing of existing pavement, and that the
method of assessment be by front footage and the cost of improvement be 100%
against the property owner in the improvement district, excluding any publicly
owned property, be referred to the City Engineer for a report on the sufficiency
of the petition. Aye: (5); Nay: (0). Motion adopted.
Moved by Commissioner Allen, seconded by Commissioner Duckers that the
Commission instruct the City Manager to inform MK Development that if and when
the Wheatridge Addition plat is finally approved that a valid petition be signed
prior to the approval of the plat, for removal of the existing surfacing on
Alabama Street and its replacement with 8 -inch full depth asphalt be submitted.

Moved by Commissioner Hodges, seconded by Commissioner Duckers that
Petition Number 3746, filed by MK Development Company for approval of the final
plat of Fox Run Addition, as recommended by the City Planning Commission on
July 3, 1979, be approved and that the Mayor be authorized to sign the final plat.

Moved by Commissioner Allen, seconded by Commissioner Duckers that
Petition Number 3780, filed by Paul J. Meis for lighted baseball diamonds in
Lower Indian Rock Park as promised in the election publicity material circulated
prior to the 1976 Bicentennial Center bond election, be referred to the Salina
Park Advisory Board and Recreation Commission for cost estimates and recommendati

Moved by Commissioner Hodges, seconded by Commissioner Allen that
Petition Number 3781, filed by Dorothy D. Moore for maintenance and repair
throughout the winter months of the Schilling Industrial Base streets, namely
Centennial Road, Scanlan and all area roads between West Crawford and Schilling
Road, be accepted and that the City Manager check to see what streets or private
roads the petitioner is complaining about for lack of snow and ice removal. Aye:
(5). Nay: (0). Motion adopted.
