Graves, Chairman presiding Commissioner Roy W. Allen Commissioner Keith G. Duckers Commissioner Dan S. Geis Commissioner Merle A. [lodges comprising a quorum of the Board, also: D. L. Harrison, City Clerk Rufus L. Nye, City Manager Absent: L. 0. Bengtson, City Attorney AWARDS - PROCLAMATIONS THE MAYOR presented plaques of appreciation to past board members: Rod Anderson, Robert Hoeffner, Ralph E. Brown, Peter L. Peterson. THE MAYOR PROCLAIMED Sunday, November 11, 1979 - "ST. JOHN'S BAPTIST CHURCH DAY". The proclamation was read by Joe N. Jones, Sr., Co -chairperson of 1 11 the St. John's Baptist Church Centennial Committee. CONSENT AGENDA Approval of the minutes of the regular meeting October 22, 1979. Cereal malt beverage license application filed by Michael Loop, d/b/a Tony's Restaurant and Winery, 244 South Santa Fe Avenue. (New application). Approval of a contract with Taliferro and Browne, Consulting Engineers, Kansas City, Kansas, for engineering services on the proposed separation of storm and sanitary sewers in the West Ash Street Area. Resolution Number 3463, authorizing the City Manager to execute the Memorandum of agreement providing a grant under Section 701 of the Housing Act of 1954, as amended. Moved by Commissioner Geis, seconded by Commissioner Hodges that all items on the consent agenda be approved. Aye: (5). Nay: (0). Motion adopted. DEVELOPMENT BUSINESS Moved by Commissioner Hodges, seconded by Commissioner Allen that the recommendation of the City Planning Commission to deny Zoning Application 79-17, filed by Karl Warhurst for the rezoning of Lot 24, Block 18, Pacific Addition from R-2 to I-2, be accepted, and the zoning application be denied. Aye: (5). Nay: (0). Motion adopted Moved by Commissioner Duckers, seconded by Commissioner Allen that the Service Extension Plan for Annexation Application 79-91 Marymount Road Tract #1 (Approximately 15 acres in 19-14-2), be adopted and that Resolution Number 3459, setting the date (of January 7, 1980) for a public hearing for the consideration of annexing certain property to the City of Salina, Kansas, be adopted. LO Moved by Commissioner Geis, seconded by Commissioner Allen that the recommendation of the City Planning Commission to approve Zoning Application 79-16 to amend the zoning ordinance to create a zoning district "HC" (Heritage Conservation) be approved. Moved by Commissioner Duckers, seconded by Commissioner Hodges that Ordinance Number 8760, providing for a Heritage Conservation district, defining the purpose, establishing a Heritage Commission, defining the commission membership, term of office; prescribing the heritage conservation plan, providing for a public hearing and certificate of appropriateness review; establishing the procedure for the demolition or removal of heritage landmarks; amending Ordinance Number 8526, the same being Chapter 36 of the Salina Code, be introduced for first reading. ADMINISTRATION Moved by Commissioner Hodges, seconded by Commissioner Allen that Ordinance Number 8761, providing for the manner of notification to the operators of motor vehicles who are overparked and providing for the manner and payment of the penalty therefor; amending Section 22-190 of the Salina Code and repealing the existing section, be introduced for first reading. Aye: (5). Nay: (0). Motion adopted. (First overparking ticket 50¢, each additional ticket $1.00 at the same parking.) Moved by Commissioner Allen, seconded by Commissioner Hodges that Ordinance Number 8759, levying special assessments on lots, pieces and parcels of ground in the City of Salina, Kansas, for the purpose of paying a portion of the cost of street and utility improvements in Eastridge, Riverdale and Georgetown Additions, be adopted. Aye: Allen, Duckers, Geis, Hodges, Graves (5). Nay: (0). Motion adopted. Moved by Commissioner Duckers, seconded by Commissioner Allen that Resolution Number 3460, authorizing and ordering certain curbing, guttering, paving and grading, water main and service and sanitary sewer improvements, ordering preparation of plans and specifications, and the estimate of costs, be adopted. (Engineering Project 79-655 for Meyer and Platten Additions). Aye: (5). Nay: (0). Motion adopted. Moved by Commissioner Geis, seconded by Commissioner Hodges that the plans and specifications filed by the City Engineer for Engineering Project 79-655 for street and utility improvements in Meyer and Platten Additions, be approved and that the City Clerk be instructed to advertise for bids to be received November 15, 1979. Aye: (5). Nay: (0). Motion adopted. Moved by Commissioner Allen, seconded by Commissioner Duckers that Resolution Number 3461, designating zones for handicapped parking in the 100 Block of North Santa Fe Avenue and in the 100 and 200 Blocks of South Santa Fe Avenue, be adopted. Aye: Allen, Geis, Hodges, Graves (4). Nay: Duckers (1). Motion adopted. Moved by Commissioner Hodges, seconded by Commissioner Duckers that Resolution Number 3462, authorizing the installation and marking of the north side of Crawford Street from Ninth Street to Broadway Boulevard as a no parking zone, be adopted. Aye: Duckers, Hodges, Graves (3). Nay: Geis (1). Commissioner Allen abstained. Motion adopted. Irvin Stephens, Trinity Lutheran Church, and Art Hanschu spoke against the parking ban on Crawford. Moved by Commissioner Duckers, seconded by Commissioner Allen that the City Engineer's recommendation be accepted and that Petition Number 3776, filed by Wilbur W. and Aliene W. Steed, for curb sidewalk on the east side of Seitz Drive from Brookwood to Glen, be approved. Aye: (5). Nay: (0). (Street and utility improvements on The Midway) Moved by Commissioner Allen, seconded by Commissioner Duckers that the City Clerk be instructed to publish notice in the official city newspaper at least once not less than ten days prior to the date of November 19, 1979, the date set for the hearing on said assessments, and that at the same time notice is published to mail to the owners of property made liable to pay the assessment at their last known post office address, a notice of the hearing and a statement of the cost proposed to be assessed against the land so owned and assessed. The City Clerk reported the assessment rolls are ready for improvements in Engineering Project 78-638, as authorized by Resolution Number 3365, passed by the Board of Commissioners on the 1st day of May, 1978. (Street and utility improvements in Ivey Park) Moved by Commissioner Hodges, seconded by Commissioner Allen that the City Clerk be instructed to publish notice in the official city newspaper at least once not less than ten days prior to the date of November 19, 1979, the date set for the hearing on said assessments, and that at the same time notice is published to mail to the owners of property made liable to pay the assessment, at their last known post office address, a notice of the hearing and a statement of the cost proposed to be assessed against the land so owned and assessed. The City Clerk reported the assessment rolls are ready for improvements in Engineering Project 78-739, as authorized by Resolution Number 3372, passed by the Board of Commissioners on the 5th day of June, 1978, and Resolution Number 3376, passed by the Board of Commissioners on the 12th day of June, 1978. (Street and utility improvements in Country Club Heights #5 and Dow Additions) Moved by Commissioner Geis, seconded by Commissioner Allen that the City Clerk be instructed to publish notice in the official city newspaper at least once not less than ten days prior to the date of November 19, 1979, the date set for the hearing on said assessments, and that at the same time notice is published to mail to the owners of property made liable to pay the assessment at their last known post office address, a notice of the hearing and a statement of the cost proposed to be assessed against the land so owned and assessed. Moved by Commissioner Allen, seconded by Commissioner Duckers that the recommendation of the City Engineer to create a "No Passing Zone" on East Crawford Street from 200 feet west of the entrance to Lower Indian Rock Park to 200 feet east of the entrance, be accepted and approved.
