10-22-1979 Minutes76 City of Salina, Kansas Regular Meeting of the Board Of Commissioners October 22, 1979 The Regular Meeting of the Board of Commissioners met in the City Commission Meeting Room, City -County Building, on Monday, October 22, 1979, at four o'clock p.m. There were present: Mayor Karen M. Graves, Chairman presiding Commissioner Roy W. Allen Commissioner Keith G. Duckers Commissioner Dan S. Geis Commissioner Merle A. Hodges comprising a quorum of the Board, also: W. E. Harris, Deputy City Manager D. L. Harrison, City Clerk Absent: L. 0. Bengtson, City Attorney Rufus L. Nye, City Manager Public Hearings and Items Scheduled for a Certain Time A public hearing was held on the proposed assessments for street and Utility improvements authorized in Resolution Number 3360, passed by the Board Of Commissioners on the 10th day of April, 1978. No Protests, written or oral, were filed. Moved by Commissioner Duckers, seconded by Commissioner Geis that the special assessments in Engineering Project 78-636 be approved and that Ordinance Number 8759, levying special assessments on lots, pieces and parcels of ground in the City of Salina, Kansas, for the purpose of paying a portion of the cost of street and utility improvements in Eastridge, Riverdale and Georgetown Additioni, be introduced for first reading. Aye: (5). Nay: (0). Motion adopted. Consent Agenda Approval of the Minutes of the Regular Meeting October 15, 1979. Authorization to submit a request for waiver from the December 31, 1979 deadline to the Division of Accounts and Reports in Topeka, on fixed asset accounting. Resolution Number 3457, designating the official depositories for all moneys of the City of Salina, Kansas, and directing the City Treasurer to deposit all moneys received by him therein. Change the date to receive bids on the Memorial Hall Boiler from November 1, 1979 to November 15, 1979. Moved by Commissioner Geis, seconded by Commissioner Allen that all Aye: (5). Motion carried. 1 J Administration Moved by Commissioner Allen, seconded by Commissioner Duckers that Ordinance Number 8752, providing for the amendment of Ordinance Number 8526, the same being Chapter 36 of the Salina Code, and the Zoning District Map therei and thereby adopted and providing for the rezoning of certain property within the City and prescribing the proper uses thereof, be adopted. filed by Burwell, Butcher and Roberts, for the rezoning of Lot 2P De Ds the3East 200 feet of Surveyor's Plat 52). Moved by Commissioner Geis, seconded by Commissioner Hodges that Ordinance Number 8757, providing for the designation of certain areas as parking for the handicapped; providing for the marking thereof and making it unlawful for the unauthorized use thereof, be adopted. Aye: Allen, Duckers, Geis, Hodges Graves (5). Nay: (0). Motion adopted. Moved by Commissioner Duckers, seconded by Commissioner Geis that Resolution Number 3458, determining the advisability of curbing, guttering, paving and grading, water main and services and sanitary sewer improvements, estimating the cost therof, defining the boundaries of the improvement district and the city -at -large, be adopted. (Engineering Project 79-655 for improvements in Meyer and Platten Additions) Aye: (5). Nay: (0). Motion adopted. The City Commission considered a request from the Downtown Parking Committee to reduce overparking fines from $1.00 to 50¢. Dan West, Chairman of the Downtown Parking Committee urged the City Commission to reduce the overparking fine from $1.00 to 50¢ because they are getting a lot of complaints from customers and it is hurting business. Moved by Commissioner Hodges, seconded by Commissioner Duckers that action be postponed so the City Attorney can get a firm legal opinion as to the legality of the first ticket being 50� and the second ticket $1.00. Aye: (5). Nay: (0). Motion adopted. Moved by Commissioner Geis, seconded by Commissioner Duckers that curb sidewalk on the east side of Seitz Drive, from Brookwood to Glen, be authorized. (Requested in Petition Number 3776, filed by Wilbur W. and Aliene W. Steed) Aye: (0). Nay: (5). Motion defeated. Moved by Commissioner Allen, seconded by Commissioner Duckers to Postpone approval of the curb sidewalk until November 5, 1979, so it can be publicized. Aye: (5). Nay: (0). Motion adopted. Moved by Commissioner Hodges, seconded by Commissioner Duckers that the recommendation of the City Engineer be accepted and that Petition Number 3777, filed by Edward C. VanNess for water service to serve a tract of land north of Euclid Avenue, south of the flood control dike, at the center line of Front Street and Second Street, be approved. Aye: (5). Nay: (0). Motion adopted. Moved by Commissioner Geis, seconded by Commissioner Allen that a letter from the Salina Park Advisory Board endorsing the Park -Recreation Concept, and the Concept of an Interlocal Agreement, be received. Moved by Commissioner Duckers, seconded by Commissioner Hodges that a etter from the Salina Park Advisory Board be received, regarding the two properti s roposed for dedication for park purposes by the developers of the former Schilling anor. Aye: (5). Nay: (0). Motion adopted. Dr. Cole said someone has been dumping tree limbs and trash in the roposed park in the former Schilling Manor, and did not want the City to accept he parks until they were cleaned up. n 1 1 78 Other Business The Commission discussed a letter received from Neil Stevens, of the Smoky Valley Chapter of the Kansas Engineering Society, concerning bike paths on both sides of East Crawford. They instructed Mr. Harris to place this item on the agenda for the November 5, 1979 meeting.
