08-20-1979 Minutes5 *j City of Salina, Kansas Regular Meeting of the Board Of Commissioners August 20, 1979 The Regular Meeting of the Board of Commissioners met in the City Commission Meeting Room, City -County Building, on Monday, August 20, 1979, at four o'clock P.M. There were present: Mayor Karen M. Graves, Chairman presiding Commissioner Roy W. Allen Commissioner Keith G. Duckers Commissioner Dan S. Geis comprising a quorum of the Board, also: L. 0. Bengtson, City Attorney D. L. Harrison, City Clerk Rufus L. Nye, City Manager Absent: Commissioner Merle A. Hodges CITIZEN FORUM Robert Marietta, representing residents in the Sears Center area, said the residents are complaining because the noise is bad from loud motorcycles, radios, people calling for help, beer drinking and drugs. The residents think parking should be eliminated in this area from 11:00 P.M. to 6 A.M., and there is also a need for an ordinance against loud mufflers on motorcycles. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME Public Hearing was held on an increase in monthly rates and deregulation of rates for Salina Cable TV Systems, Inc. Eleanor Sullivan was opposed to the deregulation of Cable TV; but she thought the $1.00 increase was justified. Larry Justus, Salina Cable TV, asked the Commission to approve the adjustment in rates first, then discuss the deregulation. Harry Steele, 104 North Hilldale, feels Cable TV should be regulated. He said the cost to motels, hotels resthomes and hospitals on the new fee schedule is an increase of 60%. He was not against the $1.00 increase. Pat Guernsey, 112 Overhill Road, is opposed to the 60% increase on commercial rates. Mr. Miller, South Fifth Street, was concerned about the bad service. He has Cable TV poles in the alley that need to be straightened. She feels the city should control TV rates. Mrs. Don Amend, asked who would Day for a rate study to justify Cable TV rates. She was told the consumer would pay for it. Neil Brooks, 616 South Phillips, said there are too many sports on TV now. He said he is afraid the elderly cannot afford a rate increase. 5T Moved by Commissioner Duckers, seconded by Commissioner Allen that Ordinance Number 8737, granting to Salina Cable TV System, Inc., a corporation, its successors, lessees and assigns, for a term of fifteen (15) years, the right, authority, power and franchise to establish, construct, acquire, maintain and operate a community antennae and closed-circuit electronic system within the City of Salina, Kansas, to render, furnish and sell community antennae and closed-circuit electronic service therefrom within the City of Salina, Kansas, and environs thereof, and to use and occupy the streets and other public places of the City of Salina, Kansas, for such community antennae and closed-circuit electronic system; and repealing Ordinance Number 8544, be placed on first reading. Moved by Commissioner Duckers, seconded by Commissioner Geis that the proposed fee schedule, as filed with the City Clerk dated August 14, 1979, to become effective September 1, 1979, be approved. Cereal Malt Beverage license application filed by Donald L. Roles, d/b/a Sazerac, 427 South Broadway. (New application). Moved by Commissioner Duckers, seconded by Commissioner Geis, that all items on the consent agenda be approved. Aye: (4). Play: (0). Motion adopted. DEVELOPMENT BUSINESS Moved by Commissioner Allen, seconded by Commissioner Geis that the recommendation of the City Planning Commission to approve Petition Number 3707, filed by Robert Frisbie, requesting the approval of the Final Plat of Frisbie Acres, located at approximately 1200 Marymount Road and containing four (4) acres, be approved and that the Mayor be authorized to sign the plat. Aye: (4). Nay: (0). Motion adopted. Moved by Commissioner Duckers, seconded by Commissioner Geis that the recommendation of the City Planning Commission to approve Petition Number 3769, filed by Marla Schwiethale, requesting the extension of Edward Street in Twin Oaks Addition across the railroad tracks to meet Hartland Street at Robin Road, be approved and the City Manager be authorized to proceed. Moved by Commissioner Duckers, seconded by Commissioner Allen that the recommendation of the City Planning Commission to approve Petition Number 3771, filed by Harold Larson, for the annexation of a tract of land located on East Cloud Street, extending immediately east of the Elks Golf Course and containing approximately 23 acres, with the condition that the property be zoned "A-1" (Agriculture), be approved and that Ordinance Plumber 8738, annexing the land, be introduced for first reading. Aye: (4). Nay: (0). Motion adopted. Moved by Commissioner Allen, seconded by Commissioner Geis that the recommendation of the City Planning Commission to approve Zoning Application 79-13, filed by Roberta Kaufman, requesting the rezoning of Lots 1, 2, 3, 4, 5, 6, 8 and 9, Block 1, Replat of Edgemere Addition, from District "C-1" (Restricted Business District) to District "C-5" (Service Commercial District), be approved and that Ordinance Number 8739 be introduced for first reading. Aye: (4). Nay: (0). Motion adopted. Moved by Commissioner Allen, seconded by Commissioner Geis that Protest Petition Number 3774, was filed by Lloyd C. Moore, Pastor of Quayle United Methodist Church, be referred to the City Planning Commission for a report. Aye: (4). Nay: (0). Kansas City, 618,107 property in the City of Salina, Kansas, be adopted. Aye: Allen, Duckers, Geis, Missouri Graves (4). Nay: (0). Motion adopted. The City Manager reported on bids received August 16, 1979 for the 998,300 82,000 sale of certain park property, that all bids were under the appraised value. Motion adopted. 108,000 The following bids were received August 16, 1979 for rebuilding the calcining plant: Calcining Plant Chlorine Handling Systems Wilson and Company recommended the contract be awarded to B R B Contractors, Inc., for the calcining plant for $532,369 and the chlorine handling systems for $76,479.
