There were present: Acting Mayor Dan S. Geis, Chairman Presiding Commissioner Roy W. Allen Commissioner Keith G. Duckers Commissioner Merle A. Hodges comprising a quorum of the Board, also: D. L. Harrison, City Clerk Rufus L. Nye, City Manager Absent: Karen M. Graves, Mayor L. 0. Bengtson, City Attorney CONSENT AGENDA Approval of the Minutes of the Regular Meeting August 6, 1979. City Engineer filed a feasibility report for Petition Number 3770, requesting curbing, guttering, paving and grading of York Avenue from Chester Avenue to Francis Avenue; and Francis Avenue from the existing pavement south to the north right-of-way line of the Missouri Pacific Railroad. Cereal malt beverage license application filed by Frank Pruitt, d/b/a Oak Tree Restaurant and Lounge, 1601 North Ninth Street. (New application) Moved by Commissioner Duckers, seconded by Commissioner Allen that all items on the consent agenda be approved. Aye: (4). May: (0). Motion adopted. ADMINISTRATION Moved by Commissioner Allen, seconded by Commissioner Hodges that Ordinance Number 8722, releasing and vacating a portion of the "clear zone easement" acquired by the City of Salina, Kansas, in Case Number 21,538 in the District Court of Saline County, Kansas, postponed from July 2, 1979 meeting, be adopted. Bob Berkley, attorney for Oliver Haig, owner of the property, requested that the adoption of this ordinance be postponed until the city attorney and all commissioners are present. Moved by Commissioner Allen, seconded by Commissioner Hodges that Ordinance 8722 be postponed until the city attorney and all commissioners are present. Aye: (4). Nay: (0). Motion adopted. Moved by Commissioner Hodges, seconded by Commissioner Allen that Ordinance Number 8727, providing, adopting and appropriating, by fund, the budget of the City of Salina, Kansas for the year beginning January 1, 1980, be adopted. Moved by Commissioner Hodges, seconded by Commissioner Duckers that Ordinance Number 8730, repealing Article VIII of Chapter 2 of the Salina Code, the Same being Section 2-206 through Section 2-216, inclusive, pertaining to the Bicentennial Authority, be adopted. Aye: (4). May: (0). Motion adopted. �J Moved by Commissioner Duckers, seconded by Commissioner Allen that Ordinance Number 8731, levying special assessments against certain lots and pieces of property to pay the cost of cutting weeds on certain lots and parts of lots and the parkways abutting thereon in the City of Salina, Kansas, be introduced for first reading. Aye: (4). May: (0). Motion adopted. Moved by Commissioner Hodges, seconded by Commissioner Allen that Ordinance Number 8732, levying special assessments against certain lots and pieces of property to pay the cost of abatement of nuisances, located on certain property in the City of Salina, Kansas, be introduced for first reading. Aye: (4). Nay: (0). Motion adopted. Moved by Commissioner Duckers, seconded by Commissioner Hodges that Ordinance Number 8733, annexing certain land to the City of Salina, Kansas, in conformity with the provisions of K.S.A. 12-519 to 12-526, inclusive, be adopted. Motion adopted. .< Moved by Commissioner Allen, seconded by Commissioner Hodges that Ordinance Number 8734, establishing the procedure for the filing, review, approval and registration of subdivision plats; amending Appendix B, Section III (A) (1) and Section III (A) (4) of the Salina Code and repealing the existing section, be adopted. ""i" Moved by Commissioner Hodges, seconded by Commissioner Duckers that Ordinance Number 8735, establishing the fees for certain applications; amending Section 27-4 of the Salina Code and repealing the existing section, be adopted. Motion Larry Justus, Regional Manager of Salina Cable TV Systems, Inc., requested approval of a rate increase from $7.50 to $8.50 per month and deregulation of the Cable TV rates. Mr. Justus says there will be an increase in service by adding three (3) more channel coverages for this fee. Moved by Commissioner Duckers, seconded by Commissioner Allen that a public hearing be held at 4:00 P.M. on August 20, 1979 to hear comments about the $1.00 rate increase and the deregulation of Cable TV rates. Moved by Commissioner Hodges, seconded by Commissioner Allen to give consent to the assignment of lease on Roberts Industries and to adopt Resolution Number 3443, a resolution pertaining to the $1,000,000 Industrial Revenue Bonds, Series of June 1, 1973, of the City of Salina, Kansas (Roberts Industries, Inc.) authorized by Ordinance Number 8288; consenting to liquidation of Roberts Industries, Inc., assignment by Roberts Industries, Inc. of interest in lease to Federal-Mogul Corporation, and consent to sublease.
