08-06-1979 MinutesCity of Salina, Kansas Regular Meeting of the Board of Commissioners August 6, 1979 The Regular Meeting of the Board of Commissioners met in the City Commission Meeting Room, on Monday, August 6, 1979, at four o'clock P.M. There were present: Mayor Karen M. Graves, Chairman Presiding Commissioner Roy W. Allen Commissioner Keith G. Duckers Commissioner Dan S. Geis Commissioner Merle A. Hodges comprising a quorum of the Board, also: L. 0. Bengtson, City Attorney D. L. Harrison, City Clerk Rufus L. Nye, City Manager Absent: None CITIZEN FORUM George Toland, 908 Highland, wants the Commission to do something about trash and garbage sitting on the parking in residential areas over a 24 hour period. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME Public Hearing was held on the 1980 Budget. No comments, written or oral, were received. Moved by Commissioner Allen, seconded by Commissioner Hodges that Resolution Number 3442 be amended as follows: a. Street Department, deduct $11,000 from account #525. b. Contingencies and Insurance, deduct $30,000 from account #Z C. Parks and Recreation, transfer $35,000 from account #295 to General Fund account #957. d. Revenue Sharing, omit Reserve of $10,220 and add to Capital Equipment. Aye: (5). Nay: (0). Motion adopted. Moved by Commissioner Duckers, seconded by Commissioner Hodges that Resolution Number 3442 be adopted as amended. Aye: (5). Nay: (0). Motion adopted. Moved by Commissioner Geis, seconded by Commissioner Duckers, that Ordinance Number 8727, adopting and appropriating, by fund, the Budget of the City of Salina for the year beginning January 1, 1980, be introduced for first reading. Aye: (5). Nay: (0). Motion adopted. CONSENT AGENDA Approval of the Minutes of the Regular Meeting July 23, 1979. City Engineer reported on the sufficiency of Petition "lumber 3770 for street improvements in the Northeast Industrial Park. �l 1 Petition Number 3772 was filed by Hilts Janitor Supply Company, for the designation and painting of one parking place, directly in front of the door of the building at 320 North Santa Fe, as a loading zone. (To be referred to City Engineer for a recommendation) Approval of a contract with Ken Bieberly for design services for work at Memorial Hall. Change the date to receive bids to rebuild the Calcining Plant at the Water Treatment Plant from August 6, 1979 at 4:00 P.M. to August 16, 1979 at 10:00 A.M. Moved by Commissioner Duckers, seconded by Commissioner Hodges to approve all items on the consent agenda. Aye: (5). Nay: (0). Motion adopted. DEVELOPMENT BUSINESS Moved by Commissioner Hodges, seconded by Commissioner Allen that the recommendation from the City Planning Commission to annex a tract of land in Sections 19 and 30, T14 S, R2 W, be approved and Ordinance Number 8733 be introduced for first reading. Moved by Commissioner Geis, seconded by Commissioner Allen that the recommendation from the City Planning Commission to change the filing fees for certain applications filed with the City Planning Commission be approved and Ordinance Number 8734, establishing the procedure for the filing, review, approval and registration of subdivision plats, be introduced for first reading. Moved by Commissioner Allen, seconded by Commissioner Hodges that the recommendation from the City Planning Commission to establish fees required for certain applications, be approved and Ordinance Number 8735 be introduced for first reading. Aye: (5). Nay: (0). Motion adopted. Moved by Commissioner Duckers, seconded by Commissioner Allen that the letter received by City Manager Rufus L. Nye, dated August 6, 1979 from N. D. Olson, General Manager of MK Development Company, asking that the final plats of Fox Run and Wheatridge subdivisions and Petition Number 3773 be removed from the agenda and deferred, be accepted. Aye: (5). Nay: (0). Motion adopted. ADMINISTRATION Moved by Commissioner Geis, seconded by Commissioner Hodges that Ordinance Number 8726, annexing a tract of land south of Ridgeview Road, west of Marymount Road and adjacent to the Smoky Hill River, requested by Dan G. Stevenson in Petition Number 3768, be adopted. Aye: (5). Nay: (0). Motion adopted. Moved by Commissioner Allen, seconded by Commissioner Hodges to place Ordinance Number 8728, establishing the size of potable water piping; amending Section 9-234 of the Salina Code and repealing the existing section, on first reading. Moved by Commissioner Duckers, seconded by Commissioner Hodges to place Ordinance Number 8729, providing for the location of water meters; amending Section 35-37 of the Salina Code, and repealing the existing section, on first reading. Moved by Commissioner Hodqes, seconded by Commissioner Allen that Ordinance Number 8730, repealing Article VIII of Chapter 2 of the Salina Code, the Same being Section 2-206 through 2-216, inclusive, pertaining to the Salina Bicentennial Authority, be placed on first reading. Moved by Commissioner Allen, seconded by Commissioner Hodges to reconsider Ordinance Number 8724, designating the time during which certain public parks within the City of Salina, Kansas, shall be closed to the general public; enacting Sections 25-7, 25-8 and 25-9 of the Salina Code. Moved by Commissioner Allen, seconded by Commissioner Hodges to amend Ordinance Number 8724; closing Sunset Park to the general public between the hours of 11 P.M. and 5 A.M. Aye: (5). Nay: (0). Motion adopted. Solomon Oliver, 1101 North 11th Street feels this curfew will not solve the problem and that the Police Department should enforce the ordinances we already have on the books. Robert Rous, 929 Merrill, feels the curfew should be 10:00 P.M. to 6:00 A.M., but this will help. Ben Sellers, Jr., feels curfew will be easier to enforce than the other ordinance. He also stated a need to eliminate parking on the inside lane of the drive through Sunset Park, better police patrol of the park and radar on Sunset Drive. Mayor called for a vote on Ordinance Number 8724 as amended. Aye: (5). Nay: (0). Motion adopted. Moved by Commissioner Duckers, seconded by Commissioner Allen that the Commission recess into executive session at 4:40 P.M. to discuss a legal matter until 4:50 P.M. Aye: (5). Nay: (0).
