July 23, 1979
The Regular Meeting of the Board of Commissioners met in the City
Commission Meeting Room, on Monday, July 23, 1979, at four o'clock p.m.
There were present:
Mayor Karen M. Graves, Chairman presiding
Commissioner Roy W. Allen
Commissioner Keith G. Duckers
Commissioner Dan S. Geis
Commissioner Merle A. Hodges
comprising a quorum of the Board, also:

Mike Dyer, 519 Sunset Drive, asked the Commissioners if they are aware
of the new regulations in the State Law, effective January 1, 1979, for the
handicapped. The areas of concern are the curb cuts, new facilities, Community
Theatre and the City -County Building. Mr. Dyer was told it would be checked by
the City Manager and he would be contacted.
AWARDS AND PROCLAMATIONS
THE MAYOR PROCLAIMED the Meek of August 1 through 7, 1979 - "NAVY
MOTHERS" WEEK". The proclamation was read by Irene Leiker, Commander.
CONSENT AGENDA
Approval of the minutes of the Regular Meeting July 16, 1979.
City Engineer filed plans and specifications for Engineering Project
79-648, North Salina Water Tower, and set August 23, 1979 as the date to receive
bids.
Petition Number 3770 was filed requesting curbing, guttering, paving
and grading of York Avenue from Chester Avenue to Francis Avenue; and Francis
Avenue from the existing pavement south to the north right-of-way line of the
Missouri Pacific Railroad. (To be referred to the City Engineer for checking)
Petition Number 3771 was filed by Harold L. Larson for the annexation
of a 34 acre tract in the Northwest Quarter of Section 29-14-2. (To be referred
to the City Planning Commission for a recommendation)
Moved by Commissioner Geis, seconded by Commissioner Duckers to approve
all items on the consent agenda. Aye: (5). Nay: (0). Motion adopted.
DEVELOPMENT BUSINESS
Moved by Commissioner Hodges, seconded by Commissioner Geis to place
an ordinance on second reading providing for the amendment of Ordinance Number
8526, the same being Chapter 36 of the Salina Code and providing for the rezoning
of certain property within the city and prescribing the proper uses thereof, for
the rezoning of a portion of the East 84 acres of the Northeast Quarter (NE -I4) of
Section 35-13-3, from "A-1(FP)" and "C-5(FP)" to "C-6(FP)" and "I-2(FP)"
requested in Zoning Application 77-16 filed by John Mize. Aye: (0). Nay:
Allen, Duckers, Geis, Hodges, Graves (5). Motion defeated.
Moved by Commissioner Duckers, seconded by Commissioner Allen that the
recommendation from the City Planning Commission to deny Petition "Dumber 3767,
filed by Charles M. Stover for street name changes in Meyer Addition: Meyer
Drive to Partridge Lane and Fredrich Drive to Mallard Drive, be approved. Aye:
Geis, Hodges, Allen (3). Nay: Duckers, Graves (2). Motion adopted.
Moved by Commissioner Allen, seconded by Commissioner Hodges that the
recommendation of the City Planning Commission to approve Petition 3768, filed
by Dan G. Stevenson for the annexation of a tract of land located south of
Ridgeview Road, West of Marymount Road and adjacent to the Smoky Hill River,
containing 2.37 acres, be approved and Ordinance 8726 be introduced for first
reading. Aye: (5). Nay: (0). Motion adopted.
ADMINISTRATION
Moved by Commissioner Hodges, seconded by Commissioner Geis that
Ordinance 8724, designating the time during which the public parks within the
City of Salina, Kansas shall be closed to the general public; enacting Sections
25-7, 25-8, 25-9 of the Salina Code, be adopted.
Dave Lourie, 634 South Front, works for a local radio station, and
took a poll on the curfew in the parks. He said 85% of those calling in didn't
want a curfew.
Don McConnell, 651 South 4th Street, uses Indian Rock Park for a
CB'ers get together in the early mornings and is against a curfew in this park.

parks. She feels the Commission is reacting to a few people. If they want a
curfew in Sunset Park, just put it there.
Frank Warta, 1212 Funston, is against the curfew from 12 midnight to
5 a.m. This is not enough time for a working man to sleep. He feels the parks
need better police patrol.
Cyril Marts, 340 West Jewell, said he needs to walk 4 miles a day and
used to walk in Sunset Park, but it isn't safe to walk there now.
Diane Packs, 154 North Eighth, doesn't want a curfew in the parks.
She said why let a few ruin it for others.
Kay Carlson, 525 Sunset Drive, wants a curfew in Sunset Park, but said
it would be better if it started earlier in the evening.
Mrs. Louis Lyda, 315 Sunset Drive, said she used to live on Santa Fe
but now lives on Sunset Drive. She said the noise is worse in Sunset Park than
Ion Santa Fe.
Moved by Commissioner Allen, seconded by Commissioner Duckers to
postpone action for 6 weeks so the City Manager and Police Department can study
the situation and come up with other alternatives. Aye: Allen, Duckers, Hodges,
Graves (4). Nay: Geis (1). Motion adopted.

Moved by Commissioner Geis, seconded by Commissioner Hodges that
Ordinance Number 8725, providing for the amendment of Ordinance Number 8526, the
same being Chapter 36 of the Salina Code, and the Zoning District Map therein
and thereby adopted and providing for the rezoning of certain property within
the City and prescribing the proper uses thereof, for the rezoning of the blest
33 feet of Lot 9 and all of Lots 10 and 11, Block 2, Cloverdale Addition to
District "I-2", requested in Zoning Application 79-11, filed by Myton and Yenkey
Development Company, be adopted. Aye: Allen, Duckers, Geis, Hodges, Graves (5).
Nay: (0). Motion adopted. (Ordinance was introduced for first reading July 16,
1979)
Moved by Commissioner Duckers, seconded by Commissioner Hodges, that
Resolution Number 3441, creating the Salina Citizens' Advisory Committee; setting
forth its purposes and functions; determining its membership and the method of
selection thereof; amending its membership and the method of selection thereof;
amending Resolution Number 3267, and repealing the original resolution, be
adopted. Aye: (5). Nay: (0). Motion adopted.
Moved by Commissioner Duckers, seconded by Commissioner Allen that the
Regular Meeting of the Board of Commissioners be adjourned. Aye: (5). Nay:
(0). Motion adopted.
