BOARD OF COMMISSIONERS
The Regular Meeting of the Board of Commissioners met in the Commission Meeting
Room, City -County Building, on Monday, May 7, 1984 at four p.m.
There were present:
Mayor Charles B. Roth, Chairman presiding
Commissioner John F. Burgess
Commissioner Fortino B. Bonilla
Commissioner Merle A. Hodges
Commissioner Joseph M. Ritter
comprising a quorum of the Board, also present:

(4.3) The Mayor proclaimed the Month of May, 1984 - "FOSTER PARENTS MONTH".
The proclamation was read by Dave Jacobs, Supervisor of Youth Services of SRS.
(4.4) The Mayor proclaimed the Week of May 6 through 12, 1984 - "BE KIND TO
ANIMALS WEEK". The proclamation was read by JoAnn Aills, Humane Officer for
the City of Salina.

84-110 Moved by Commissioner Burgess, seconded by Commissioner Hodges that
item 8-7 be moved to 5-1. Aye: (5). Nay: (0). Motion adopted.
(5.1) Executive session to discuss the purchase of land.
Ed Pogue, Chairman of the Salina Airport Authority, said the Area
Chamber of Commerce made a request to the Salina Airport Authority to purchase
the smallest one of the two buildings from Federal Mogul for an industrial
client. The Salina Airport Authority views this as a proper activity for a
speculative client.

sanitary sewer improvements in Fairway Estates Addition. [Requested in Petition

Richard Barlow, a property owner in the benefit district, said he
believes the charges to the benefit district are unfair, and that the petitioner
should pay a larger share of the cost.
CITIZEN FORUM
Robert Frobenius was present made a formal apology to John Burgess
and Charles Roth for circulating a recall
petition about two years ago. He
said he regrets any action that he had taken to fault these two dedicated
commissioners unjustly, and hoped his public apology will project to everyone
his regrets in this matter.

(4.1) The Mayor proclaimed the Week of May 13 through 19, 1984 - "NURSING
HOME WEEK". The proclamation
was read by Shirley Warnow, Activity Director and
Social Service Designee of Windsor Estates.
(4.2) The Mayor proclaimed the Week of May 14 through 20, 1984 - "NATIONAL
SALVATION ARMY WEEK". The proclamation

the public hearing be adjourned for two weeks, until May 21st, so the property
owners will have a chance to discuss the manner of assessment with the City
Engineer. Aye: (5). Nay: (0). Motion adopted.
CONSENT AGENDA
(6.1) Approve the Minutes of the Regular Meeting April 16, 1984.
(6.2) Approve the Minutes of the Regular Meeting April 23, 1984.
(6.3) Resolution Number 84-3710, certification of real property acquisition
procedures. Project 85U-0889-01, 85U-0890-1, 85U-08991-01.
(6.4) Report on the sufficiency of Petition Number 3870 for street
improvements on Valley View Drive, and a feasibility report filed.
(6.5) Authorization to relocate tank battery.

DEVELOPMENT BUSINESS
ADMINISTRATION
(8.1) Six month trial period for the closing of Cherokee Street expired
May 1, 1984. Consideration of Ordinance Number 83-8973, providing for the
vacation of a portion of Cherokee Street within the City of Salina, Kansas.
(This matter was considered on September 19, 1983)
David Walker, 1524 Sycamore Street, wants access to the street so
people living there will have access to their garages.
Jim Maupin, 718 Sycamore, said the street is quiet now, and it is
the first time in 17 years.
Craig Comb, 1206 Apache, said it is nice to have the street closed,
but some people need access to their garages.
Jeff Stone, 1604 Sycamore, said limited access to the street is needed.
Dayton Jones, 1608 Sycamore, said it is nice to have the street closed,
but some people need access to their garages.
John Melvin, owner of the mobile home park, said he would like to have
the south entrance open on Cloud, or vacate Cherokee Street.
Randal Bank, 1302 Apache, said the commission should close the street
or have an alley. He is not in favor of paving a street in front and in back.
Elmer Dieck, 1222 Apache, said he wants to leave the street as it is.
Mary Douglas, 1504 Pawnee, said since Cherokee Street has been closed
the traffic has increased in the total area. She said she would like to see the
street open, paved, and sidewalk installed, and to make the benefit district the
area from Republic to Cloud, and West of Broadway.

Cherokee Street be left closed, with limited access only from Bachtold. Aye:

(8.2) Second Reading Ordinance Number 84-9020, allowing crematories as
conditional uses in the R-2, R-2.5, R-3 districts; and as permitted uses in the
C-1, C-2, C-3, C-4, C-5, C-6 districts; amending Sections 42-173, 42-188, 42-203,
42-252, 42-267, 42-282, 42-302, and 42-332 and repealing the existing sections.

84-114 Moved by Commissioner Hodges, seconded by Commissioner Bonilla that
Ordinance Number 84-9020 allowing crematories as conditional uses in the R-2,
R-2.5, R-3 districts; and as permitted uses in the C-1, C-2, C-3, C-4, C-5, C-6
districts; amending Sections 42-173, 42-188, 42-203, 42-252, 42-267, 42-282,
42-302, and 42-332 and repealing the existing sections, be adopted. Aye:

(8.3) Second Reading Ordinance Number 84-9021, providing for the amendment
rezoning of certain lots in Blocks 4, 8, 10, 11, Replat of Faith Addition to
District R-2, Multiple -Family Residential District. [Zoning application 84-5,
filed by T & S, Inc.]
84-115 Moved by Commissioner Ritter, seconded by Commissioner Burgess that
Ordinance Number 84-9021, providing for the amendment of Ordinance Number 8526,
the same being Chapter 42 of the Salina Code, and the Zoning District Map therein
and thereby adopted and providing for the rezoning of certain property within the
City and prescribing the proper uses thereof, be adopted. Aye: Bonilla, Burgess,
Hodges, Ritter, Roth (5). Nay: (0). Motion adopted.
(8.4) First Reading Ordinance Number 84-9022, providing procedures for the
impoundment and removal of vehicles parked continuously upon any street for
twenty-four (24) hours or more; amending Section 38-43 of the Salina Code and
repealing the existing section.

(8.6) Recommendation by the City Engineer that a yield sign be installed on
Pacific Avenue at Twelfth Street. [Petition Number 3869, filed by Daryl Davis
for a stop sign.]
84-118 Moved by Commissioner Hodges, seconded by Commissioner Burgess that
the recommendation of the City Engineer be accepted, and that Resolution Number
84-3711, authorizing the designation of Twelfth Street as the through street at
the intersection of Twelfth Street and Pacific Avenue; authorizing the
,installation and marking of Pacific Avenue with a "Yield" sign at the
intersection of Twelfth Street and Pacific Avenue, be adopted. Aye: (5). Nay:
(0). Motion adopted.
