03-26-1984 MinutesCITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS MARCH 26, 1984 4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, March 26, 1984 at four o'clock p.m. There were present: Mayor John F. Burgess, Chairman presiding Commissioner Fortino B. Bonilla Commissioner Merle A. Hodges Commissioner Charles B. Roth comprising a quorum of the Board, also present: L. 0. Bengtson, City Attorney D. L. Harrison, City Clerk Rufus L. Nye, City Manager Absent: Commissioner Joseph M. Ritter None CITIZEN FORUM AWARDS - PROCLAMATIONS (4.1) The Mayor proclaimed the Week of March 24 through 31, 1984 - "AMBUC THERAPY WEEK". The proclamation was read by Bart Tannahill, President of the Red Barons Chapter of AMBUCS. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME None CONSENT AGENDA (6.1) Approve the Minutes of the Regular Meeting March 12, 1984. (6.2) Approve the Minutes of the Regular Meeting March 19, 1984. (6.3) Request by Roy Mead, 1661 West Republic #94 for a permit to keep two horses at 1402 East Woodland. (6.4) Report on the sufficiency of Petition Number 3867, filed by Robert Gile for curbing, guttering, paving, grading, storm sewer and utility improvements in the Replat of Faith Addition, and a feasibility report was filed for the improvements. (6.5) Resolution Number 84-3699 relating to benefits obtainable by cities under the program for federal and state aid on highway construction. [Replacement of the bridge on Iron Avenue at 4th Street] (6.6) Resolution Number 84-3700 determining it necessary to appropriate private property for the use of the City of Salina, Kansas, for the purpose of making improvements to the intersection of Broadway Boulevard and State Street and authorizing and directing the City Engineer to make a survey and description of the land necessary for such purposes. (6.7) Resolution Number 84-3701 relating to right-of-way acquisition and utility arrangements relating to the bridge replacement project on Iron Avenue at 4th Street. (6.8) Petition Number 3868 filed by Roy Presley for paving, grading, and sanitary sewer improvements for Fairway Estates Addition. Aye: (4). Nay: (0). Motion adopted. DEVELOPMENT BUSINESS Diana Bolte, 733 Cherokee, asked if there would be more lighting on the parking lot. She was told the lighting requirements are set out in the Zoning Ordinance. Robert Wasko, attorney for the applicant, said 5 feet of the lot will be used for the building addition and the rest for parking, which should relieve some of the traffic problems in the area. 84-72 Moved by Commissioner Bonilla, seconded by Commissioner Hodges that the recommendation of the City Planning Commission be accepted and that Zoning Application 84-1 be approved, and that Ordinance Number 84-9010, providing for the amendment of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the city and prescribing the proper uses thereof, be introduced for first reading. ADMINISTRATION (8.1) Second Reading Ordinance Number 84-9006, relating to private wastewater disposal systems, amending Section 18-75 of the Salina Code and repealing the existing section. (7.1) Recommendation from the City Planning Commission that Planned Development District Application 83-7, filed by R. E. Sprecker for the rezoning of a 4.88 acre tract of land in the SW4 of Section 19, Township 14 South, Range 3 West, to District PDD, be approved. 84-70 Moved by Commissioner Hodges, seconded by Commissioner Roth that the recommendation of the City Planning Commission be accepted and that Planned Development District Application 83-7 be approved subject to the property being platted, and that Ordinance Number 84-9008, providing for the amendment of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the city and prescribing the proper uses thereof, be introduced for first reading. (7.2) Recommendation from the City Planning Commission that Annexation Application 84-1, filed by S R and G Land Company for the annexation of a tract of land in the NJ SEJ Section 3, Township 15 South, Range 3 West, be approved. 84-71 Moved by Commissioner Roth, seconded by Commissioner Hodges that the recommendation of the City Planning Commission be accepted and that A84-1 be approved and that Ordinance Number 84-9009 be introduced for first reading. (7.3) Recommendation from the City Planning Commission that Zoning Application 84-1, filed by Jim Reed Thomas and Pecolia Haynes, d/b/a West Crawford Self-service Laundry, for the rezoning of Lot 5, Block 18, Sunset Mayor Addition, be approved. Debbie McClintock, 714 Seneca, expressed her concern about the increase in traffic and asked what it would do to the valuation of her property, and asked if it will increase her taxes. (8.2) Second Reading Ordinance Number 84-9007, relating to use of public and private sewers and drains, installation and connection of building sewers and drains, discharge criteria for municipal sewer system, penalties for violations of sewer use requirements and industrial pretreatment program requirements; amending Chapter 41 of the Salina Code. 84-74 Moved by Commissioner Bonilla, seconded by Commissioner Hodges that Ordinance Number 84-9007 - relating to use of public and private sewers and drains, installation and connection of building sewers and drains, discharge criteria for municipal sewer system, penalties for violations of sewer use requirements and industrial pretreatment program requirements; amending Chapter 41 of the Salina Code, be adopted. (8.3) First Reading Ordinance Number 84-9011, providing for the vacation of a portion of a certain utility easement in Valley View Addition to the City of Salina, Saline County, Kansas. 84-75 Moved by Commissioner Hodges, seconded by Commissioner Roth that Ordinance Number 84-9011, providing for the vacation of a portion of a certain utility easement in Valley View Addition to the City of Salina, Saline County, Kansas, be introduced for first reading. Aye: (4). Nay: (0). Motion adopted. (8.4) Recommendation from the City Engineer that a request by H. Stewart Mann, representing the Salina Presbyterian Manor, for a break in the restricted access control on Crawford Street be granted. 84-76 Moved by Commissioner Roth, seconded by Commissioner Hodges that the recommendation of the City Engineer be accepted and that Resolution Number 84-3703 amending the restricted access to Presbyterian Manor Subdivision as shown on the plat thereof, be adopted. (8.5) Recommendation from the Board of Electrical Examiners to amend three sections of the Salina Code pertaining to industrial electricians, master electrician required by electrical contractors, and reexamination of electricians after failure to meet board of examiners requirements. 84-77 Moved by Commissioner Hodges, seconded by Commissioner Bonilla that the recommendation of the Board of Electrical Examiners be accepted and that Ordinance Number 84-9012 creating the classification of industrial electrician; amending Section 8-131 of the Salina Code and repealing the existing section, be introduced for first reading; and that Ordinance Number 84-9013 requiring a licensed electrical contractor to have a master electrician in its employ at all times; amending Section 8-132 of the Salina Code and repealing the existing section, be introduced for first reading; and that Ordinance Number 84-9014, providing for reexamination of electricians after failure to meet the requirements of the board of examiners; amending Section 8-137 of the Salina Code and repealing the existing section be introduced for first reading. Steve Shogren, President of United Securities, Inc., Wichita, was present and explained the refunding proposal. 84-78 Moved by Commissioner Roth, seconded by Commissioner Bonilla that Resolution Number 84-3702, authorizing United Securities, Inc. to develop a comprehensive and definitive plan for refunding the city's outstanding bonds, be adopted. Motion adopted. 1 1 OTHER BUSINESS The Mayor, with the approval of the City Commissioners made the following appointments: Board of Electrical Examiners Steve Wilson, Master Electrician, reappointed for a 2 year term to July 24, 1985. Salina Arts Commission Jack Weisgerber, reappointed for a 3 year term to March 10, 1987.
