10-24-1983 Minutest8i CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS OCTOBER 24, 1983 4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, October 24, 1983, at four o'clock p.m. There were present: Mayor John F. Burgess, Chairman presiding Commissioner Fortino B. Bonilla Commissioner Joseph M. Ritter Commissioner Charles B. Roth comprising a quorum of the Board, also present: L. 0. Bengtson, City Attorney D. L. Harrison, City Clerk Rufus L. Nye, City Manager Absent: Commissioner Merle A. Hodges CITIZEN FORUM Mike Robinson, 749 Merrill, said he believes the Police are in the protection service and see no problem in spending $12,000 to $30,000 for a new alarm system. They are trained in the field of answering alarms and should continue. AWARDS - PROCLAMATIONS (4.1) The Mayor Proclaimed Tuesday, October 25, 1983 - "COMMUNITY CLUBS DAY IN THE GREATER SALINA AREA". The proclamation was read by Norma Goodman, CCA Chairman. (4.2) The Mayor Proclaimed the Week of October 31 through November 4, 1983 - "SALINA HUMAN RELATIONS WEEK". The proclamation was read by Will Burnett, Human Relations Director. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME None CONSENT AGENDA (6.1) Approve the Minutes of the Regular Meeting October 17, 1983. (6.2) Petition Number 3860 was filed by S. Fred Gaines for the vacation of 10' of public right-of-way along the east side of Eleventh Street between North Street and Lincoln Street. (6.3) Authorize the Mayor to sign a contract with Kennedy and Coe to audit the 1983 city accounts. (6.4) Resolution Number 83-3668 - establishing all license fees, permit fees and other user related fees or charges, pursuant to Section 2-2 of the Salina Code, which shall be effective as of January 1, 1984, and repealing Resolution Number 81-3567. (6.5) Resolution Number 83-3669 - authorizing and ordering certain water main improvements on East Cloud Street. [Engineering Project 83-710] (6.6) Resolution Number 83-3670 - authorizing and ordering certain street and storm sewer improvements in Mayfair Addition. [Engineering Project 83-711] (6.7) City Engineer files a feasibility report for improvements on East Crawford Street between Marymount Road and the east city limits. (6.8) City Engineer reports on the sufficiency of Petition Number 3859 filed by Robert Wasko for street and utility improvements in Sullivan Addition and files a feasibility report for the improvements. (6.9) Cereal malt beverage license application filed by Jody Porter, d/b/a LaCocina, 1409 West Crawford. DEVELOPMENT BUSINESS None ADMINISTRATION (8.1) Second Reading Ordinance Number 83-8977 - levying special assessments for street and storm sewer improvements on Coachlight Lane. [Engineering Project 82-694] 83-191 Moved by Commissioner Roth, seconded by Commissioner Ritter that Ordinance Number 83-8977, levying special assessments on lots, pieces and parcels of ground in the City of Salina, Kansas for the purpose of paying a portion of the cost of curbing, guttering, paving, grading and storm sewer improvements on Coachlight Lane, be adopted. Aye: Bonilla, Ritter, Roth, Burgess (4). Nay: (0). Commissioner Hodges absent. Motion adopted. (8.2) Second Reading Ordinance Number 83-8978 - levying special assessments for Lateral Sanitary Sewer 631. [Engineering Project 83-701] 83-192 Moved by Commissioner Bonilla, seconded by Commissioner Roth that Ordinance Number 83-8978, levying special assessments on lots, pieces and parcels of ground in the City of Salina, Kansas for the purpose of paying a portion of the cost of Lateral Sanitary sewer 631, be adopted. Aye: Bonilla, Ritter, Roth, Burgess (4). Nay: (0). Commissioner Hodges absent. Motion adopted. (8.3) Second Reading Ordinance Number 83-8979 - establishing a Business Improvement District for the Downtown Business District of Salina pursuant to the Business Improvement District Act and repealing Ordinance Number 83-8971. 83-193 Moved by Commissioner Ritter, seconded by Commissioner Bonilla that Ordinance Number 83-8979, an ordinance establishing a Business Improvement District for the Downtown Business District of Salina pursuant to the Business Improvement District Act and repealing Ordinance Number 83-8971 be adopted. Aye: Bonilla, Ritter, Roth, Burgess (4). Nay: (0). Commissioner Hodges absent. Motion adopted. (8.4) Request by Dr. Vernon Osborn to be present at the Commission meeting to discuss the question of city policy dealing with the issuance of license for sale of cereal malt beverage (beer). Dr. Osborn asked the City Commission to adopt a "get tough policy" to enforce the drinking age, and for the owners of filing stations and convenience stores not to sell beer to anyone under 21. 83-194 Moved by Commissioner Roth, seconded by Commissioner Ritter that the City staff be instructed to examine regulations on beer licenses. Aye: (4). Nay: (0). Motion adopted. The Commissioners thanked Dr. Osborn for his remarks. (8.5) Request by Dan Boyd, President of Salina Landlords, Inc., that the City Commission hear a proposal on the city water department policy. This policy pertains to responsibility of landowners for leaks existing from water main. Dan Boyd, President of Salina Landlords, Inc., wants the City Commission to adopt a policy, by changing the ordinance, to make the City Water Department responsible for water line maintenance from city water mains to the meter or property line. Jerry Brin, a member of the Salina Landlords, Inc. wants the City to assume the responsibility of water service lines.
