The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, September 19, 1983, at four o'clock p.m. There were present: Mayor John F. Burgess, Chairman presiding Commissioner Fortino B. Bonilla Commissioner Merle A. Hodges Commissioner Charles B. Roth comprising a quorum of the Board, also present: L. 0. Bengtson, City Attorney Rufus L. Nye, City Manager Jacqueline Shiever, Acting City Clerk Absent: Commissioner Joseph M. Ritter D. L. Harrison, City Clerk CITIZEN FORUM None AWARDS - PROCLAMATIONS The Mayor Proclaimed Thursday, September 22, 1983 - "AMERICAN BUSINESS WOMEN'S DAY". No one was present to read the proclamation. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME None CONSENT AGENDA (6.1) Approve the Minutes of the Regular Meeting September 12, 1983. (6.2) Resolution Number 83-3661 - a resolution of the City of Salina, Kansas ('employer'), amending the deferred compensation plan adopted by Resolution Number 3426. (6.3) Resolution Number 83-3662 - a resolution providing for a speed limit of 40 MPH on Crawford Street from Lefran Street to Marymount Road. 83-165 11 Moved by Commissioner Hodges, seconded by Commissioner Bonilla that all items on the Consent Agenda be approved. Aye: (4). Nay: (0). Motion adopted. DEVELOPMENT BUSINESS (7.1) City Planning Commission reports on Annexation Application 83-1 filed by John and Evangeline Jilka, et al, requesting annexation of a 5.80 acre tract of land in the SE4 35-14-3. 83-166 Moved by Commissioner Hodges, seconded by Commissioner Bonilla that the recommendation of the City Planning Commission be approved and that Ordinance Number 83-8972, annexing certain land to the City of Salina, Kansas, in conformity with the provisions of K.S.A. 12-519 to 12-526, inclusive, be introduced for first reading. Aye: (4). Nay: (0). Motion adopted. ADMINISTRATION (8.1) City Engineer reports on Petition Number 3853, filed by Dayton Jones for the vacation of Cherokee Street between Cloud Street and Bachtold Street. John Melvin, 2219 Edgehill Road, owner of Prairie Village Mobile Home Park, suggested that the street be closed from Republic to Pawnee, leaving the two east exits from the mobile home park open. Mr. John Taddeo, 1661 West Republic Mr. Dayton Jones, 1608 Sycamore Mr. Pelletier, corner of Apache, Pawnee and Cherokee Mr. Jeff Stone, 1604 Sycamore Mr. Joe Diamicis, 1100 Apache Drive Mrs. Bob Johnson, 1661 West Republic Mrs. Pelletier, corner of Apache, Pawnee and Cherokee Told the reasons that something needs to be done about Cherokee Street. They said the street is a raceway, that it isn't safe for the children, that there is a dust problem when it's dry, and there is a mud problem when it rains. 83-167 Moved by Commissioner Roth, seconded by Commissioner Bonilla that Cherokee Drive be blocked from Republic to Cloud; with the accesses at Pawnee and Bachtold also blocked, for a trial period until May 1, 1984. Aye: (4). Nay: (0). Motion adopted. Dayton Jones, asked if he must refile his petition to vacate the street at the end of the trial period. The City Attorney responded that he would not. (8.2) Request by the Salina Housing Authority for the City Commission to forgive taxes for Housing Authority owned property. This consists of 75 units, mainly in the southwest portion of the city. Dan Boyer, Chairman of the Housing Authority of the City of Salina, and Mike Gilbert, Executive Director, explained that HUD asked them to make a formal request to the City Commission. 83-168 Moved by Commissioner Roth, seconded by Commissioner Hodges to deny the request. Aye: Hodges, Roth, Burgess (3). Nay: Bonilla (1). Motion adopted. 83-169 Moved by Commissioner Hodges, seconded by Commissioner Bonilla that the Regular Meeting of the Board of Commissioners be adjourned. Aye: (4). Nay: (0). Motion adopted.
