REGULAR MEETING OF THE BOARD OF COMMISSIONERS

The Regular Meeting of the Board of Commissioners met in the Commission Meeting
Room, City -County Building, on Monday, August 15, 1983, at four o'clock p.m.
There were present:

PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME
(5.1) Public Hearing on the Proposed 1984 Budget including Revenue Sharing
Funds.
No protests, written or oral, were filed. The Mayor declared the
public hearing closed.
(5.1a) Resolution Number 83-3650 - adopting the 1984 Annual Budget.

Moved by Commissioner Hodges, seconded by Commissioner Bonilla that
Resolution Number 83-3650, adopting the 1984 Annual Budget, be adopted. Aye:
(5). Nay: (0). Motion adopted.
(5.1b) First Reading Ordinance Number 83-8969 - providing for the adoption
and appropriation, by fund, of the budget of the City of Salina for the year
beginning January 1, 1984; and appropriating money from the various funds to pay
payrolls and claims against the City of Salina for the calendar year 1984.

Moved by Commissioner Roth, seconded by Commissioner Ritter that
Ordinance Number 83-8969, providing for the adoption and appropriation, by fund,
of the budget of the City of Salina for the year beginning January 1, 1984; and
appropriating money from the various funds to pay payrolls and claims against
the City of Salina for the calendar year 1984, be introduced for first reading.
Aye: (5). Nay: (0). Motion adopted.
(5.2) Public Hearing on Engineering Project 83-707 for the curbing,
guttering, paving and grading of North Third Street, East Otis, East Harsh.
Steve Johnson, 1017 North Third, asked about the curbing and guttering
which was installed and has been on the taxes for 9 years. He said there are 15
homes in the one mile from Pacific to Euclid and that 98% of the traffic is from
the State Highway Department. He said he opposes the paving.
Cliff Vogan, 2072 Lewis, said he purchased 4 lots at tax sale, and he
is not for or against the paving.
Marion Davis, Jr., said he was against the paving until he learned he
is eligible for federal grant funds.
Robert Branstetter, 223 Des Moines, said he moved from the benefit
district to his Des Moines address, but his father ownes three lots and he can't
afford to pay for paving. He was told to check with the Planning Department to
see if he is eligible for grant money.
Mike Munson, said he owns a business in the district, and is in favor
the paving.
Oscar Ashton, 826 Cherokee, said he owns four lots in the benefit
district, with two rentals. The renters cannot afford to pay may more, and he
cannot afford to pay any more, and is opposed to the paving.
Betty Baier, 1220 North Third, said North Third has needed to be paved
for years. The kids use the dirt street for drag racing. She said she favors
the paving.
Joan Hunt, 1205 North Third, said the street needs to be paved.
Joe White, said he owns lots on North Third, but they are no value to
him because he lives north of New Cambria and he will turn the lots back to the
City if the street is paved.
Rick Hunt, 1205 North Third, said he favors the paving, that it is the
best way to clean up the north end of Salina.
There were no other protests filed, and the Mayor declared the public
hearing closed.
83-137 Moved by Commissioner Roth, seconded by Commissioner Hodges that
Resolution Number 83-3651, determining the advisability of certain, curbing,
guttering, paving and grading improvements, estimating the cost thereof, defining
the boundaries of the improvement district, method of assessment, and
apportioning the cost between the improvement district and the city -at -large, be
adopted. Aye: (5). Nay: (0). Motion adopted.
CONSENT AGENDA
(6.1) Approve the Minutes of the Regular Meeting August 1, 1983.
(6.2) Resolution Number 83-3652 - adopting the Job Classification and Salary
Schedule for city employees, created pursuant to Section 2-51 of the Salina
Code, and repealing Resolution Number 82-3602 and all previous resolutions,
motions or actions in conflict therewith.
(6.3) Resolution Number 83-3653 - recommending that the Board of County
Commissioners vacate a portion of a public utility easement in Mayfair Addition.
(Requested by W. Dean Owens for St. Mark's Evangelical Lutheran Church).
(6.4) Petition Number 3855 - filed by Richard A. Leiker, 807 South 5th, for
the City Commission to allow parking on just one side of South Fifth street
between Crawford and Republic.

all items on the consent agenda be approved. Aye: (5). Nay: (0). Motion

DEVELOPMENT BUSINESS
(7.1) Recommendation from the City Planning Commission that Zoning
Application 83-4, filed by the Board of Zoning Appeals to amend Sections
42-270(2)(d), 42-285(2)(d), 42-320(2)(d), 42-335(2)(d), and 42-365(2)(d), and
42-385(2)(d) to allow canopies over gasoline pumps to extend into the front yard
setback, be approved.
83-139 Moved by Commissioner Hodges, seconded by Commissioner Ritter that the
recommendation of the City Planning Commission be accepted and that Ordinance
Number 83-8970, providing that canopies over gasoline pumps may extend into
certain front yard setback; amending Sections 42-270, 42-285, 42-320, 42-335,
42-365, 42-385 of the Salina Code, and repealing the existing sections, be
introduced for first reading. Aye: (5). Nay: (0). Motion adopted.

(8.1) Second Reading Ordinance Number 83-8967 - levying special assessments
against certain lots for cutting weeds.
83-140 Moved by Commissioner Roth, seconded by Commissioner Ritter that
Ordinance Number 83-8967, levying special assessments against certain lots and
pieces of property to pay the cost of cutting weeds on certain lots and parts of
lots and the parkways abutting thereon in the City of Salina, Kansas, be
adopted. Aye: Bonilla, Hodges, Ritter, Roth, Burgess (5). Nay: (0). Motion
adopted.
(8.2) Second Reading Ordinance Number 83-8968 - levying special assessments
against certain lots for the abatement of nuisances.

Ordinance Number 83-8968, levying special assessments against certain lots and
pieces of property to pay the cost of abatement of nuisances located on certain
property, be adopted. Aye: Bonilla, Hodges, Ritter, Roth, Burgess (5). Nay:

(8.3) Resolution Number 83-3654 - establishing fees to be charged users of
the City of Salina Solid Waste Disposal Area; repealing Resolution Number
82-3613.

for the use of the sewerage system and services rendered by the combined Water

(8.7) Resolution Number 83-3658, approving a three mill levy for the Salina
Airport Authority for tax year 1983.
