05-16-1983 Minutes�J CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS MAY 16, 1983 4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, May 16, 1983 at four o'clock p.m. There were present: Mayor John F. Burgess, Chairman presiding Commissioner Fortino B. Bonilla Commissioner Merle A. Hodges Commissioner Joseph M. Ritter Commissioner Charles B. Roth comprising a quorum of the Board, also present: L. 0. Bengtson, City Attorney D. L. Harrison, City Clerk Rufus L. Nye, City Manager Absent: None None CITIZEN FORUM AWARDS - PROCLAMATIONS (4.1) The Mayor proclaimed the Month of May, 1983 - "POPPY MONTH" and Saturday, May 21, 1983 - "POPPY DAY". The proclamation was read by Nellie Kurtz, Poppy Chairman. (4.2) The Mayor proclaimed Saturday, May 21, 1983 - "POPPY DAY". The proclamation was read by Connie Brown, Poppy Chairman of the VFW Auxiliary. (4.3) The Mayor proclaimed the Week of May 15 through 21, 1983 - "NATIONAL INSURANCE WOMEN'S WEEK", and Tuesday, May 17, 1983 - "AN AWARENESS DAY FOR THE PUBLIC ISSUE OF DRINKING AND DRIVING". The proclamation was read by Vicky Williams, First Vice President of Insurance Women of North Central Kansas. None PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME CONSENT (6.1) Approve the Minutes of the Regular Meeting May 9, 1983. (6.2) Resolution Number 83-3643 - authorizing the Mayor to sign an agreement with the Union Pacific Railroad Company renewing a water pipeline encroachment (C.D. 42989-2-B) East of South Industrial Area. 83-79 Moved by Commissioner Hodges, seconded by Commissioner Bonilla that all items on the Consent Agenda be approved. Aye: (5). Nay: (0). Motion adopted. DEVELOPMENT BUSINESS (7.1) Recommendation from the City Planning Commission that P.D.D. Application 83-2, filed by Roy M. Wilbur, for Lot 7, Block 2, Georgetown Addition, be approved. Roy M. Wilbur presented a development layout of the request area. i 4U Brenda O'Gorman, 637 Briarcliff, spoke against the proposed rezoning. Keith Glatz, 2105 Melrose Lane, spoke in favor on the rezoning request, and said it is needed in this area of the City. 83-80 Moved by Commissioner Roth, seconded by Commissioner Bonilla that the recommendation of the City Planning Commission be accepted, and that Ordinance Number 83-8963, providing for the amendment of Ordinance Number 8526 and the Zoning District Map of the City of Salina, be introduced for first reading. Aye: (4). Nay: (0). Commissioner Ritter abstained. Motion adopted. ADMINISTRATION (8.1) Second Reading Ordinance Number 83-8758, providing for the rezoning of Albers Industrial Park Addition to "I-2(FP)". This ordinance was introduced for first reading October 15, 1979. 83-81 Moved by Commissioner Hodges, seconded by Commissioner Ritter that Ordinance Number 83-8758, providing for the amendment of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the City and prescribing the proper uses thereof, be adopted. Aye: Bonilla, Hodges, Ritter, Roth, Burges (5). Nay: (0). Motion adopted. (8.2) Consideration of an agreement with Midwest Research Institute. C. L. Christian, Box 687, explained the proposed study by MRI and the changes requested by the City. Ed Kimball, 2263 Quincy, spoke against the study and said it is not needed. Clarence King, Attorney for Mid -State Mall, asked why the city is involved in this study. He said if Mr. Warmack wants a study he can get one. Rex Miller, 111 South Santa Fe, said there is no need for another study, that there has been enough said about the mall. Ted Weeks, 505 South Santa Fe, asked if this study binds the City. He was told it does not. 83-82 Moved by Commissioner Roth, seconded by Commissioner Ritter that Resolution Number 83-3644, A resolution approving an "Economic Impact Study for a Proposed Regional Shopping Center", changing the date from May 4 to May 13, 1983, be adopted. Aye: Ritter, Roth, Burgess (3). Nay: Bonilla, Hodges (2). Motion adopted. 83-83 Moved by Commissioner Roth, seconded by Commissioner Ritter that the regular meeting of the Board of Commissioners be adjourned. Aye: (5). Nay: (0). Motion adopted.
