10-18-1982 Minutes86 CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS OCTOBER 18, 1982 4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, October 18, 1982, at four o'clock p.m. There were present: Acting Mayor John F. Burgess, Chairman presiding Commissioner Karen M. Graves Commissioner Charles B. Roth comprising a quorum of the Board, also present: L. 0. Bengtson, City Attorney D. L. Harrison, City Clerk W. E. Harris, Acting City Manager Absent: Mayor Keith G. Duckers Commissioner Merle A. Hodges City Manager, Rufus L. Nye None CITIZEN FORUM PROCLAMATIONS (4.1) The Mayor proclaimed Thursday, October 21, 1982 - "DAY IN COURT FOR LEGAL SECRETARIES". The proclamation was read by Betty Just, Clerk of the District Court. (4.2) The Mayor proclaimed Wednesday, October 20, 1982 - "COMMUNITY CLUBS DAY IN THE GREATER SALINA AREA". The proclamation was read by Mary Jane Viar, CCA Director. (4.3) The Mayor proclaimed the Week of October 16 through 22, 1982 - "I CARE WEEK". The proclamation was read by Nancy Roderick, President of the Citizens Coalition on Drug and Alcohol Abuse. None PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME CONSENT AGENDA (6.1) Approve the Minutes of the Special Meeting October 1, 1982. (6.2) Approve the Minutes of the Regular Meeting October 4, 1982. gz- (6.3) Resolution Number 3616 - authorizing and ordering certain curbing, guttering, paving, grading, and storm sewer improvements, ordering preparation of plans and specifications, and the estimate of costs. (Engineering Project 82-694 - Coachlight Lane Improvements) (6.4) Set the date of October 28, 1982 to receive bids for Engineering Project 82-694 - Coachlight Lane Improvements. (6.5) Tree Trimming license application filed by Daniel Eberhardt, d/b/a Dan's Tree Service, New Cambria, Kansas. (6.6) Cereal malt beverage license applications filed by Fred A. Young, Pres. of Reflections Of, Inc., d/b/a Reflections Of, 1056 East Pacific; Parfam, Inc., d/b/a Pizza To Go, 2031 South Ohio. 87 (6.7) Resolution Number 82-3617 - determining the overtime rate of pay as well as the remuneration in lieu of holiday pay for employees working schedules of twenty-four (24) hours on duty and forty-eight (48) hours off duty, and respectively amending Sections III -3 and IV -3 of the Personnel Manual, approved by Resolution Number 3418, and repealing Resolution Number 3464. (6.8) City Engineer reports on the sufficiency of Petition Number 3840, filed by Garlen Howington for the removal and replacement of an existing sidewalk on the north side of Prescott Avenue from Eleventh Street to a point 107 feet west. (6.9) Resolution Number 82-3618 - determining necessity of and directing that the owner or owners of certain lots construct, in compliance with plans and specifications of the City Engineer, a sidewalk, abutting said lots within 60 days of the adoption and publication hereof and providing that in the event the owner or owners fail to do so, that the City of Salina shall proceed to construct, or cause to be constructed, a sidewalk and that the total cost thereof shall be assessed against such lot or lots on which such sidewalk shall abut as other special assessments. (North side of Prescott Avenue from Eleventh Street to a point 107 feet west) (6.10) Recommendation from the City Planner concerning the membership of the Citizens' Advisory Committee. 82-210 Moved by Commissioner Roth, seconded by Commissioner Graves that all items on the Consent Agenda, except Item 6.10, be approved, and that Item 6.10 be considered October 25, 1982. DEVELOPMENT BUSINESS (7.1) Recommendation from the City Planning Commission that Annexation Application 82-1, filed by Allan Hocking, for the annexation of a tract of land in the East 1/2 of the Northwest Quarter of Section 22, Township 14 South, Range 3 West, be approved. 82-211 Moved by Commissioner Graves, seconded by Commissioner Roth that the City Planning Commission's recommendation be accepted, and that Ordinance Number 82-8940, annexing certain land to the City of Salina, Kansas, in conformity with the provisions of K.S.A. 12-519 to 12-526, inclusive, be introduced for first reading. Aye: (3)• Nay: (0). Motion adopted. (7.2) Recommendation from the City Planning Commission that Zoning Application 82-8, filed by Allan Hocking for the rezoning of a tract of land in the East 1/2 of the Northwest Quarter of Section 22, Township 14 South, Range 3 West, to District "C-5, FP" Service Commercial, Flood Plain District, be approved subject to platting. 82-212 Moved by Commissioner Roth, seconded by Commissioner Graves that the recommendation of the City Planning Commission be accepted and that Zoning Application 82-8 be approved subject to platting, and that Ordinance Number 82-8941, providing for the amendment of Ordinance Number 8526, the same being Chapter 36 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the city and prescribing the proper uses thereof, be introduced for first reading. Aye: (3)• Nay: (0). Motion adopted. ADMINISTRATION (8.1) Second Reading Ordinance Number 82-8939 - naming a street and describing its location within the city limits of Salina, Kansas. (Coachlight Lane in Interstate District Southwest of 1-70) 82-213 Moved by Commissioner Graves, seconded by Commissioner Roth that Ordinance Number 82-8939, naming a street and describing its location within the city limits of Salina, Kansas, be adopted. Motion adopted. 82-214 1 82-215 82-216 82-217 82-218 1 1 A • (8.2) First Reading Ordinance Number 82-8942 - extending the police mower of the city to include the City -County Building, Library and the parking lot adjacent thereto; amending Section 1-10 of the Salina Code and repealing the existing section. Moved by Commissioner Roth, seconded by Commissioner Graves that Ordinance Number 82-8942, extending the police power of the city to include the City -County Building, Library and the parking lot adjacent thereto; amending Section 1-10 of the Salina Code and repealing the existing section, be introduced for first reading. Aye: (3)• Nay: (0). Motion adopted. (8.3) Request filed by Harry J. Jett, D.D.S. for $400,000 Industrial Revenue Bonds. Moved by Commissioner Graves, seconded by Commissioner Roth that the Commission recess into executive session to discuss possible issuance of Industria Revenue Bonds, and possible litigation against the city for, not to exceed, 30 minutes. Aye: (3). Nay: (0). Motion adopted. The Commission recessed at 4:12 p.m. and reconvened at 4:35 P•m• Moved by Commissioner Graves, seconded by Commissioner Roth that the Regular Meeting reconvene.
