10-04-1982 Minutes• r CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS OCTOBER 4, 1982 4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday October 4, 1982, at four o'clock p.m. There were present: Acting Mayor John F. Burgess, Chairman presiding Commissioner Karen M. Graves Commissioner Merle A. Hodges Commissioner Charles B. Roth comprising a quorum of the Board, also present: L. 0. Bengtson, City Attorney D. L. Harrison, City Clerk Rufus L. Nye, City Manager Absent: Mayor Keith G. Duckers CITIZEN FORUM None AWARDS - PROCLAMATIONS (4.1) The Mayor presented City Service Awards to 15 City Employees with 10 years of service, and 3 City Employees with 25 years of service. (4.2) The Mayor proclaimed the Week of October 3 - 9, 1982 - "FIRE PREVENTION WEEK". The proclamation was read by Carol Rhaesa, Public Educator. (4.3) The Mayor proclaimed the Week of October 10 - 17, 1982 - "FREEDOM WEEK". The proclamation was read by Linda Vol], Salina Jaycee Jayne. (4.4) The Mayor proclaimed Saturday, October 9, 1982 - "TOOTSIE ROLL DAY". The proclamation was read by Ed Jockum, Tootsie Roll Chairman of the Knights of Columbus. (4.5) The Mayor proclaimed the Month of October, 1982 - "ALCOHOL AND OTHER DRUG ABUSE AWARENESS MONTH". The proclamation was read by Jim Zanardi, Salina Area Coordinator for Alcohol Awareness for the Central Kansas Foundation. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME None CONSENT AGENDA (6.1) Approve the Minutes of the Regular Meeting September 20, 1982. (6.2) Approve the Minutes of the Special Meeting September 29, 1982. (6.3) Petition Number 3840 - filed by Garlen H. Howington, for of Prescott the removal Avenue from and replacement of an existing sidewalk on the north side Eleventh Street to a point 107 feet west. (Refer to City Engineer) (6.4) Request by Sheryl Loder, 1502 East Woodland, for a permit to keep 2 riding horses in the city limits. (6.5) Set the date of October 21, 1982 to receive bids for the renovation of 7 restroom facilities in Sunset, Oakdale and Kenwood Parks. 84 (6.6) City Engineer reports on Petition Number 3837, filed by Robert Hay for a stop sign at the East-West portion of Hartland Avenue and Robin Road intersectio (6.8) Resolution Number 82-3614 - determining the advisability of curbing, guttering, paving, grading and storm sewer improvements, estimating the cost thereof, defining the boundaries of the improvement district, method of assessment, apportioning the cost between the improvement district and the City - at -large. (Coachlight Lane - Engineering Project 82-694) (6.9) Recommendation from the Alcohol Fund Advisory Committee. 82-202 Moved by Commissioner Hodges, seconded by Commissioner Graves that all items on the Consent Agenda be approved. Aye: (4). Nay: (0). Motion adopted. DEVELOPMENT BUSINESS (7.1) Recommendation from the City Planning Commission that Planned Development Application 82-2, filed by Charter Investments, Inc. and Tom Dunn Enterprises, Inc. for the rezoning of Lot 5, Block 3, and Lots 3, 4, 5, 6, and the East 64 feet of Lots 2 and 7, Block 4, Countryside Addition, be denied. Robert Wasko, Attorney for Charter Investment, Inc. and Tom Dunn Enterprises, Inc. stated the other three corners are zoned commercial and asked the City Commission to return the application to the City Planning Commission for reconsideration with the new data he has submitted. 82-203 Moved by Commissionr Roth, seconded by Commissioner Hodges that Planned Development District Application 82-2, be returned to the City Planning Commission for reconsideration in light of new data submitted and to consider the highest and best possible use of the area. Ethel Hull, 1008 East Claflin; Janie Lamer, 914 Russell; Robert Baetz, 915 Russell; Susan Vignery, 1001 Russell; and Dennis Toews, 931 East Claflin, were against the rezoning application, stating that there is plenty of commercial property already zoned in the area. These residents feel there will be a lot of noise and the ponding area will cause mosquitoes and decrease the valuation of their property. Mrs. Robert Baetz, 915 Russell, asked who Charter Investment, Inc. is? Mr. Dunn told her it is himself, Charles Walker and John Stevens, all local businessmen. Acting Mayor Burgess called for a vote on Motion 82-203• Aye: (4). Nay: (0). Motion adopted. ADMINISTRATION (8.1) Second Reading Ordinance Number 82-8937, providing for the rezoning of Lots 1, 2, 3, Block 5, Southern Heights Addition to District "C-5" Service Commercial District, requested in Zoning Application 82-9, filed by Walther's Oil Company. 82-204 Moved by Commissioner Hodges, seconded by Commissioner Graves, that Ordinance Number 82-8937, providing for the amendment of Ordinance Number 8526, the same being Chapter 36 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the City and prescribing the proper uses thereof, be adopted. Aye: Graves, Hodges, Roth, Burgess (4). Nay: (0). Mayor Duckers absent. Motion adopted. (6.6a) Resolution Number 82-3615 - authorizing the designation of Robin Road as the through street at the intersection of Hartland Avenue and Edward Street; authorizing the installation and marking of Edward Street with a "Yield" sign at the intersection of Edward Street at Robin Road, and authorizing the installation and marking of Hartland Avenue with a "Yield" sign at the intersection of Hartland Avenue at Robin Road. (6.7) City Engineer reports on the sufficiency of Petition Number 3838 filed by Wilson and Company for curbing, guttering, paving and storm sewer improvements Ion Coachlight Lane, and files a feasibility report on the improvements. Moved by Commissioner Hodges, seconded by Commissioner Roth that ordinance Number 82-8939, naming a street (Coachlight Lane) and describing its location within the city limits of Salina, Kansas, be introduced for first reading. Aye: (4). Nay: (0). Motion adopted. (8.4) Resolution Number 82-3612 - establishing the service fees to be charged for residential refuse collection for 1983. Moved by Commissioner Roth, seconded by Commissioner Hodges that Resolution Number 82-3612, establishing the service fees to be charged for residential refuse collection service; repealing Resolution Number 8o-3514, be adopted. Aye: (4). Nay: (0). Motion adopted. (8,5) Resolution Number 82-3613 - establishing the fees to be charged for users of the Solid Waste Disposal Area for 1983. Moved by Commissioner Hodges, seconded by Commissioner Graves that Resolution Number 82-3613, establishing the fees to be charged for users of the City of Salina Solid Waste Disposal Area; repealing Resolution Number 81-3572, be adopted.
