06-14-1982 Minutes49 CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS JUNE 14, 1982 4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, June 14, 1982, at four o'clock p.m. comprising a quorum of the Board, also present: L. 0. Bengtson, City Attorney D. L. Harrison, City Clerk Rufus L. Nye, City Manager Absent: None None CITIZEN FORUM AWARDS - PROCLAMATIONS (4.1) Resolution Number 82-3584 - expressing gratitude and appreciation to WALTER EDWIN CAMERON for serving as an employee of the City of Salina Police Department from March 15, 1960 to May 25, 1982. (4.2) The Mayor presented plaques of appreciation to past board and commissio members: Glorine Shelton, Board of Zoning Appeals; and Sherry Denton, Heritage Commission. (4.3) The Mayor proclaimed the Week of June 14 through 20, 1982 - "AMATEUR RADIO WEEK". The Proclamation was read by Ron Tremblay, Member of the Central Kansas Amateur Radio Club. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME (5.1) Public Hearing on the issuance of $350,000 Industrial Revenue Bonds for Kinder -Care Learning Centers, Inc. Jerome Jacobs, area representative for Kinder -Care Learning Centers, Inc., stated they had three sites under consideration and should be breaking ground two to three weeks after the Industrial Revenue Bonds were issued. Their center will handle approximately 100 children at a cost of $43.00 per week. This would be a first class facility and would not be in competition with the other centers. They will employ 15 people on the staff. Kitty Beverly, Salina Child Care Center, objected to the City issuing Industrial Revenue Bonds for a day care center. None of the present centers are full and there is no need for any more. Geraldine Briscoe, Martin Luther King Child Care Center, said there was not a need for another center with all the job lay-offs. Helen Shamburg, 2348 South Ohio, has a child care center in her home, with 19 children, stated that Salina did not need another center. Ed Pogue, Chairman of the Industrial Development Committee of the Chamber of Commerce, said other centers had been built with Industrial Revenue Bonds in the state and that the Chamber's position is to recommend to the City that they issue Industrial Revenue Bonds for this type of Industrial Development. Mr. Jacobs said there is a need in Salina for Kinder -Care and they were in business for a profit. Moved by Commissioner Roth to adopt Resolution Number 82-3591 authorizi a Letter of Intent to issue Industrial Revenue Bonds for Kinder -Care. Died for lack of second. CONSENT AGENDA (7.1) Recommendation from the City Planning Commission that Zoning Applicatio 82-4, filed by Charter Investments, Inc., and Tom Dunn Enterprises, Inc., for the rezoning of Lot 5, Block 3, the East 64' of Lots 2 and 7, and all of Lots 3, 4, 5, and 6, Block 4, Blocks 3 and 4, Countryside Addition to District "C-3" (Shopping Center District) be denied. 82-98 Moved by Commissioner Graves, seconded by Commissioner Burgess that the recommendation of the City Planning Commission be approved and the Zoning Application Number Z82-4 be denied. (7.2) Recommendation from the City Planning Commission that Zoning Applicatio 82-5, filed by Salina -Saline County Joint Board of Health, for the amendment of Section 36-1301(38) (Day Care Home) and Section 36-1301(72) (Group Day Care Center) be approved. 82-99 Moved by Commissioner Burgess, seconded by Commissioner Graves that the recommendation of the City Planning Commission be approved and that Zoning Application Number Z82-5 be approved , and that Ordinance Number 82-8914 providin for the amendment of sections 36-1301(38) and 36-1301(72) of the Salina Code, and repealing the existing sections, be introduced for first reading. ADMINISTRATION (8.1) Second Reading Ordinance Number 82-8912, providing for the rezoning of Lot 6, Block 28, Reimold's Military Replat to "C-5" Service Commercial District. [Requested in Z82-3 filed by Salina Transit Company]. 82-100 Moved by Commissioner Hodges, seconded by Commissioner Graves that Ordinance Number 82-8912, providing for the amendment of Ordinance Number 8526, the same being Chapter 36 of the Salina Code and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the City and prescribing the proper uses thereof, be adopted. Motion adopted. si (8.3) Report from the City Engineer on Petition Number 3833, filed by Merle Youngland for the vacation of an alley between Brown Welding Supply and Everett Lumber Company be denied. Merle Youngland, of Brown Welding, asked permission to install gates at each end of the alley. He stated that people drive into the alley and climb the fence and steal things. The City Attorney suggested that Mr. Youngland talk to Kansas Power and Light, Southwestern Bell, and Cable Television to see if they would release their rights to the alley so gates could be installed. 82-102 Moved by Commissioner Hodges, seconded by Commissioner Graves to table for three weeks. Aye: Duckers, Burgess, Graves, Hodges, Roth (5). Nay: (0). Motion adopted. (8.4) Request from the Union Pacific Railroad Company recommending certain railroad crossings be closed. Don Engelhardt, 122 East Beloit, stated he was against closing any of the crossings. The railroad just rebuilt the crossing at Beloit. Bud Jilka, 2026 Leland Way, stated he was against closing the Raymond crossing. Lots of parents take their children to school in this area. Mr. Bob Orrich, U.P.R.R.; ''We realize we have rebuilt some of the crossings we are asking to be closed. This was five years ago and they will need rebuilding again in five years. There are 23 crossings on Fourth Street and we want to protect as many as we can. We hope in the near future to have trains of 60 to 100 cars, now they are 5 to 10 cars. We are willing to negotiate on the pedestrian walkways.'' Mr. C. Shoemaker stated if they close these eight crossings, they are willing to pay all the cost of signalizing the others and barracading the closed crossings. 82-103 Moved by Commissioner Hodges, seconded by Commissioner Roth to accept the City Engineer's recommendation in closing certain streets, with a pedestrian walkway on Raymond, that no cost to the City and a Resolution be drafted for the closing of streets. OTHER BUSINESS 82-104 Moved by Commissioner Hodges, seconded by Commissioner Burgess to place on the agenda and adopt Resolution 82-3592 requesting the Board of County Commissioners of Saline County, Kansas, to submit to the qualified electors of the County of Saline the proposition of levying a one percent (1.0%) countywide retailers' sales tax in Saline County.
