05-17-1982 Minutes39 Commission CITY OF SALINA, KANSAS Action # REGULAR MEETING OF THE BOARD OF COMMISSIONERS MAY 17, 1982 4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, May 17, 1982, at four o'clock p.m. comprising a quorum of the Board, also present: L. 0. Bengtson, City Attorney D. L. Harrison, City Clerk Rufus L. Nye, City Manager Absent: None CITIZEN FORUM Roy Garrigues, 907 East Ellsworth, asked if the Salina Airport Authority files a report with the City Commission, or if it does as it pleases? He was told the Salina Airport Authority does file a report and the meetings are open to the public. AWARDS - PROCLAMATIONS (4.1) The Mayor proclaimed Tuesday, May 18, 1982 - "COMMUNITY APPRECIATION DAY". No one was present to read the proclamation. None PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME CONSENT AGENDA (6.1) Approve the minutes of the Regular Meeting May 10, 1982. (6.2) Cereal Malt Beverage License applications. (6.3) Resolution Number 82-3587 - authorizing the standing and parking of vehicles on portions of Seventh Street in accordance with the provisions of Section 22-145 of the Salina Code. 82-74(I Moved by Commissioner Roth, seconded by Commissioner Burgess that all items on the consent agenda be approved. Aye: (5). Nay: (0). Motion adopted. DEVELOPMENT BUSINESS (7.1) Recommendation from the City Planning Commission that the final, plat of the Replat of Part of Lots 1 and 3, Block 9, Riverside Park Addition to the City of Salina, Kansas, be approved. (Plat application 82-1A, filed by Kenneth Mattison and Robert Hunt) 82-75 Moved by Commissioner Graves, seconded by Commissioner Burgess that the recommendation of the City Planning Commission be accepted and the final plat of the Replat of Part of Lots 1 and 3, Block 9, Riverside Park Addition be approved, and that the Mayor be authorized to sign the final plat. [Engineering Project 80-6711 82-76 Moved by Commissioner Hodges, seconded by Commissioner Graves that Ordinance Number 82-8906, levying special assessments on lots, pieces and parcels of ground in the City of Salina, Kansas, for the purpose of paying a portion of the cost of water system and sanitary sewer improvements in Eastridge Addition, be adopted. Aye: Burgess, Graves, Hodges, Roth, Duckers (5). Nay: (0). Motion adopted. (8.2) Second Reading Ordinance Number 82-8907 - levying special assessments on lots, pieces and parcels of ground in the City of Salina, Kansas, for the purpose of paying a portion of the cost of water and sanitary sewer improvements in Mayfair Addition. (8.3) Second Reading Ordinance Number 82-8908 - levying special assessments on lots, pieces and parcels of ground in the City of Salina, Kansas, for the purpose of paying a portion of the cost of water main improvements on Coronado Street. [Engineering Project 81-6851 82-78 Moved by Commissioner Burgess, seconded by Commissioner Graves that Ordinance Number 82-8908 levying special assessments on lots, pieces and parcels of ground in the City of Salina, Kansas, for the purpose of paying a portion of the cost of water main improvements on Coronado Street, be adopted. Aye: Burgess, Graves, Hodges, Roth, Duckers (5). Nay: (0). Motion adopted. (8.4) Second Reading Ordinance Number 82-8909 - providing for the rezoning of the East 25' of -the West 75' of the East 350' of Lot 2, Surveyor's Plat 8 to District "C-2" Neighborhood Shopping District. [Zoning Application 82-1 filed by George Johnson] 82-79 Moved by Commissioner Graves, seconded by Commissioner Burgess that Ordinance Number 82-8909, providing for the amendment of Ordinance Number 8526, the same being Chapter 36 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the City and prescribing the proper uses thereof, be adopted. Aye: Burgess, Graves, Hodges, Roth, Duckers (5). Nay: (0). Motion adopted. (8.5) First Reading Ordinance Number 82-8910 - levying a city gross earnings tax on intangibles for the year 1982. Lee Lorenz, 1945 Rolling Hills Circle, said he is against the intangible tax because it is a third tax on income. He said people have stopped saving, and it causes a hardship on elderly people. He suggested that a local sales tax be voted on, as this is the only fair tax. He said he is willing to help on a sales tax election. George R. Smith, 854 Kenison Road, said a tax on intangibles is a very unfair tax. He suggested the property taxes be increased, or get a sales tax. He said he has a petition with more than 1,000 signatures here in Salina to put the intangible tax to a vote. This was prior to the court decision that intangibl tax is illegal. Roy Garrigues, 907 East Ellsworth, said he feels an added tax to propert would be better accepted by the people. A property tax is a fair tax, but not an intangible tax. W. 0. Brown, 834 Russell, said the intangibles tax is an unfair tax to the elderly people on a fixed income. Increase the property taxes if needed. People are buying government bonds. A sales tax would be a good and fair tax. Charles Heath, 18 Crestview Drive, said the City Commission could levy a lesser tax than 2.25. He suggested lowering it to something like .75% or 10. 41 Milton Stiefel, 158 Fairdale Road, suggested the City Commission do nothing with the intangibles tax and go to the people for a sales tax. 82-80 Moved by Commissioner Burgess that first reading of Ordinance Number 82-8910 be tabled for at least 1 week. The motion died for the lack of a second. 82-81Moved by Commissioner Roth, seconded by Commissioner Graves that Ordinance Number 82-8910, levying a city gross earnings tax on intangibles for the year 1982, be introduced for first reading. Aye: Graves, Hodges, Roth, Duckers (4). Nay: Burgess (1). Motion adopted.
