01-5785 Intent Bond Issue(Published in the Salina Journal on November 30 and December 7, 2001) RESOLUTION NO. 01-5785 A RESOLUTION DECLARING THE INTENT TO ISSUE GENERAL OBLIGATION COMBINED WATER AND SEWAGE SYSTEM REFUNDING BONDS, SERIES 2002-A OF THE CITY OF SALINA, KANSAS TO REFUND OUTSTANDING COMBINED WATER AND SEWAGE SYSTEM REVENUE BONDS. WHEREAS, the City of Salina, Kansas (the "City") has previously issued pursuant to K.S.A. 12-856 et seq. (the "Act") its Combined Water and Sewage System Improvement Revenue Bonds, Series 1993-A (the "Series 1993-A Bonds"), and WHEREAS, pursuant to Charter Ordinance No. 28, the City has exempted itself from the provisions of K.S.A. 12-868 and provided substitute and additional provisions on the same subject, including provisions authorizing the issuance of the City's general obligation bonds to refund the City's revenue bonds previously issued under the Act, which include the Series 1993-A Bonds. NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF SALINA, KANSAS, AS FOLLOWS: Section 1. The governing body hereby states its intent to issue its General Obligation Combined Water and Sewage System Refunding Bonds, Series 2002-A (the "2002-A Bonds"), pursuant to the Authority of Charter Ordinance No. 28 and K.S.A. 10-427 et seq. to refund all of the outstanding principal amounts of the Series 1993-A Bonds. The total amount of 2002-A Bonds proposed to be issued for such purpose is currently estimated to be $2,100,000. Section 2. This Resolution shall be published once each week for two consecutive weeks in the official City newspaper. Section 3. The 2002-A Bonds may be issued unless a petition requesting an election on the proposition, signed by electors equal in number to not less than 5% of the electors of the City who voted for the office of secretary of state at the last preceding general election of such office, is filed with the clerk of the City of Salina, Kansas, within 20 days following the last publication of such resolution. If such a petition is filed, the governing body of the City shall not issue the 2002-A Bonds unless the proposition shall receive the approval of a majority of the votes cast thereon at an election called for such purpose.
