99-5539 Auth Georgetown Rplt(Published in the Salina Journal Novemberaj 1999) r�n:oaaaae��una RESOLUTION NUMBER 99-5539 A RESOLUTION AUTHORIZING AND ORDERING CERTAIN CURBING, GUTTERING, PAVING, GRADING, STORM DRAINAGE, SANITARY SEWER MAIN AND WATER MAIN IMPROVEMENTS IN THE REPLAT OF BLOCKS FOUR (4), TEN (10), ELEVEN (11) AND TWELVE (12),GEORGETOWN ADDITION TO THE CITY OF SALINA, KANSAS. WHEREAS, the Governing Body of the City of Salina, Kansas did hold a public hearing on the advisability of making certain curbing, guttering, paving, grading, storm drainage, sanitary sewer main and water main improvements; WHEREAS, notice of said public hearing was duly published as required by K.S.A. 12- 6a04; and WHEREAS, the Governing Body did on the 161 day of November, 1999, duly adopt a resolution finding and determining that said improvement was advisable; and NOW, THEREFORE, be it resolved by the Governing Body of the City of Salina, Kansas: Section 1. That, subject to the provisions of Resolution Number 89-4066 establishing a development policy for the financing of public improvements within the city of Salina, the following improvements are hereby authorized and ordered to be made in accordance with the findings of the governing body upon the advisability of the improvement as follows: Curbing, guttering, paving, grading and drainage for Pheasant Lane from Seitz Drive to the west property line of Lot 8, Block 5, Replat of Blocks 4, 10, 11, and 12, Georgetown Addition, to serve Lots 15 through 19, Block 4; Lots 8 through 10, Block 5; and Lots 14 through 19, Block 5, Replat of Blocks Four (4), Ten (10), Eleven (11) and Twelve (12), Georgetown Addition to the City of Salina, Kansas. The curbing, guttering, paving, grading and drainage for Pheasant Circle to serve Lots 4 through 6 and 8 through 16, Block 5, Replat of Blocks Four (4), Ten (10), Eleven (11) and Twelve (12), Georgetown Addition to the City of Salina, Kansas. The installation of a sanitary sewer main to serve Lots 8 through 21, Block 5, Replat of Blocks Four (4), Ten (10), Eleven (11) and Twelve (12), Georgetown Addition to the City of Salina, Kansas. The installation of a water main to serve Lots 16 through 18, Block 4, and Lots 8 through 16, Block 5, Replat of Blocks Four (4), Ten (10), Eleven (11) and Twelve (12), Georgetown Addition. to the City of Salina, Kansas. Section 2. The estimated and probable cost of such improvement is $240,087.39 Section 3. The improvement district is Lots 15 through 19, Block 4, and Lots 4 through 6 and 8 through 21, Block 5 all in the Replat of Blocks Four (4), Ten (10), Eleven (11) and Twelve (12), Georgetown Addition to the City of Salina, Kansas Section 4. The method of assessment shall be that 100% of the total cost assessed against the property shall be based on adjusted front footage for each residential lot for street and drainage, water and sanitary sewer improvements without regard to buildings or improvements of the land. Section 5. The proposed apportionment of cost between the improvement district and the city -at -large is: The costs assessed against the improvement district shall be: a. 100% of the total cost of street and drainage improvements, including grading, pavement, curbs and gutters, storm pipelines, concrete box culverts, ConwlitlalM Ub. storm inlets and any incidentals thereto to complete the street and drainage systems. b. 100% of the total cost of water mains, fittings, hydrants, water services, valves, and any incidentals thereto to complete the water system. c. 100% of the total cost of sanitary sewer pipeline, manholes, service connections and any incidentals thereto to complete the sanitary sewer collection system. 2. There shall be no costs assessed against the city -at -large. Section 6. The assessment with accrued interest shall be levied as a special tax upon the property included within the benefit district concurrent with the general property taxes and shall be payable in fifteen (15) equal annual installments. Section 7. That the City Engineer be and is hereby directed and ordered to prepare plans and specifications, and estimates of the cost of said improvements. Section 8. That for the purpose of providing funds to pay the cost of such improvements until bonds can be issued therefore, the Mayor and City Clerk be and they are hereby authorized to execute temporary notes for the City of Salina, Kansas, as provided by K.S.A. 10-123 and 12-6a04, not to exceed the aggregate provided by law. Such temporary notes may be issued by Resolution from time to time as required during the progress of the work on the improvements herein recited. Such temporary notes shall be in the form and executed as provided by law. Section 9. That the City Clerk is hereby authorized and directed to make progress payments to the contractors for materials furnished and for labor performed under the contract when estimates therefore are presented to her which have been properly certified by the City Engineer, so long as the aggregate payments do not exceed the total contract price. Section 10. That the City expects to incur capital expenditures on and after the date of adoption of this Resolution (the "Expenditures") in connection with such improvements, and intends to reimburse itself for such Expenditures with the proceeds of said bonds or temporary notes in an amount which, depending on the date of issuance of said bonds or temporary notes, may aggregate a maximum of $240,087.39, the anticipated cost of such improvements. Section 11. That the improvement shall not be commenced if, within 20 days after publication of this resolution, written protests signed by both 51 % or more of the resident owners of record of property within the improvement district and the owners of record of more than half of the total area of said district are filed with the City Clerk. Section 12. This resolution shall take effect after its passage and publication once in the official city newspaper. (SEAL) ATTEST: Adopted and passed this 22"d day of November, 1999. ara R.
