04-10204 Zone Matlock-JohnsonORDINANCE NUMBER 04-10204 AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE [BER 8526, THE SAME BEING CHAPTER 42 OF THE SALINA CODE, AND THE TNG DISTRICT MAP THEREIN AND THEREBY ADOPTED AND PROVIDING FOR REZONING OF CERTAIN PROPERTY WITHIN THE CITY AND PRESCRIBING THE PER USES THEREOF. WHEREAS, all conditions precedent for the amendment of the Zoning District Map, the of certain property therein, hereinafter described has been timely complied with, SO NOW, BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. AMENDMENT. DISTRICT "PC -3". PLANNED SHOPPING CENTER ISTRICT. That the Zoning District Map of the City of Salina, Kansas, duly adopted and published a part of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, be and it is hereby so that the following described property be rezoned as follows, to -wit: A tract of land located in the Southwest Quarter (SW/4) of Section Thirty-six (36), Township Fourteen (14) South, Range; Three (3) West of the Sixth Principal Meridian in Saline; County, Kansas and described as follows: Lot One (1), Block One (1); Lot One (1), Block Two (2); Lots One (1), Two (2), Three (3), Block Three (3); Lots One (1), Two (2), Three (3), Block Four (4); all in Matlock -Johnson Addition to the City of Salina, Saline; County, Kansas. This tract contains 44.50 acres, more or less. Subject to easements, restrictions and reservations now of record. become a part of District "PC -3". PLANNED SHOPPING CENTER DISTRICT. Section 2. CONDITIONS OF APPROVAL. That the use of said described property shall subject to all the conditions, restrictions and limitations as made and provided for in Ordinance 8526, the same being Chapter 42 of the Salina Code with reference to the PLANNED CENTER DISTRICT. Development of the property shall be subject: to the plans on file th the Planning Commission and/or City Clerk and the following conditions, to -wit: 1. That the development shall be in accordance with the approved site plan, including plans for signage and landscaping, incorporated- herein by reference. In addition, the development shall follow and comply with all city regulations and standards. 2. A building permit for Phase 1 (Lot 2, Block 4, Matlock -Johnson Addition) shall be applied for within eighteen (18) months of the approval date or the approved development plan shall become null and void and the zoning shall revert to its former classification. Site plans for the remaining building lots must be approved by the City Planning Commission prior to the issuance of any additional building permits. Uses shall be limited to those prescribed in the C-3 regulations, except that manufactured home display and sales shall be permitted On Lot 2, Block 4, and development shall be subject to all bulk and use limitations in the C-3 district. 4. That signage on the side shall comply with C-3 regulations, except that the pylon sign located on Lot 1, Block 1, Matlock -Johnson Addition shall have a maximum area of one hundred thirty-five (135) square feet on one sign face. 5. That the landscape plan shall be amended to show installation of Ash or Honey Locust trees alternating with shrubs along the east side of Market Place. At least two (2) trees shall be shown on the landscaped islands on the east and west ends of the parking lot, on each of seven (7) center islands surrounding light poles in the middle of the parking lot and on the island set aside for the power line pole. The amended plan shall also indicate the type of vegetative screening proposed for the KP&L substation. 6. The developer shall be responsible for the installation of all off-site improvements on Ninth Street and Schilling Road shown on the site plan drawing, including the signalization of the Ninth Street and Sam's Place intersection. 7. A site development plan containing all revisions and amendments required by the City Commission shall be submitted to the :Zoning Administrator prior to application for a building permit. Section 3. That this ordinance shall be in full force and effect from and after its adoption publication once in the official city newspaper.
