19-11006 Amending Section 7-34 pertaining to Keeping of Bees (Summary published in The Salina Journal on June 28, 2019.) (Published on the City of Salina's website for a minimum of one week from June 25 to July 9, 2019.) ORDINANCE NUMBER 19-11006 AN ORDINANCE AMENDING SALINA CODE SECTION 7-34 PERTAINING TO KEEPING BEES AND REPEALING THE EXISTING SECTION. BE IT ORDAINED by the Governing Body of Salina, Kansas: Section 1. Amendment. Section 7-34 of the Salina Code is amended to read as follows: N Sec. 7-34. Keeping bees. It shall be unlawful for any person, whether as owner of bees or as agent, representative, employee or bailee of an owner of bees, to keep or harbor any bees within the limits of the city either in violation of the requirements of this section or without having first obtained a permit for keeping bees. Any person desiring to obtain a permit to keep bees on any premises within the city limits shall file an application with the city clerk. The city manager may grant the applicant a permit to keep bees upon the premises within the city limits specified in the application upon such terms and conditions as will assure compliance with the requirements of this section. Any permit granted shall be subject to revocation by the city manager if the permit holder fails to comply with the terms and conditions of the permit or the following requirements: (a) Registration. Beekeepers shall register the number of hives and the location of each hive on the application. (b) Distance requirements. Hives must be located at or greater than the following distances: 1) Fifty (50)feet from neighboring dwellings; and 2) Forty (40) feet from any public road or sidewalk, public park, or property upon which a medical facility or school is located, with the exception of school observation hives owned and maintained in accordance with subsection(e). (c) Number of hives. Beekeepers are allowed a maximum of four(4) hives. (d) Signage. Beekeepers must install and maintain a sign, no less than five (5) inches by three (3) inches, on the premises, indicating the keeping of bees on the property. The sign must be brightly colored and include the beekeeper's name and telephone number. (e) School observation hives. A school may own and maintain observation hives on the school's property, subject to the requirements of this section other than the distance requirement relating to property upon which a school is located. Section 2. Repealer. Existing Salina Code Section 7-34 is repealed. Section 3. Effective. This ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper by the following summary: Ordinance No. 19-11006 Summary On June 24, 2019, the City Commission passed Ordinance No. 19-11006. The Ordinance amends Salina Code Sec. 7-34 pertaining to the permit and the standards and requirements required for keeping bees and repeals the existing section.
