The Salina Public Library Board of Trustees held their monthly meting Thursday,
November 19, 1998, at 4:00 p.m., in the Prescott Room.
The following Board members were present: Peter Brungardt, Jack Howard, Joe
Lock, Nancy Chandler, Janice Ostrom, Jim Sullivan, and Betsy Scholten. Others present
were Joe McKenzie, Lisa Bowman, Dianna Waite, Cynthia Smull and Kathryn Young.
Nancy Chandler called the meeting to order. No corrections or changes were made
in the October 1998 minutes.
98-41 On motion made by Jim Sullivan and seconded by Jack Howard it was RESOLVED
THAT: The Board accepts the October 1998 Board minutes as printed. Motion

PUBLIC COMMENTS: None
STAFF INTRODUCTIONS: Joe introduced Lisa Bowman, Head of Children's
Department and Dianna Waite, Head of Adult Circulation Department.
FRIENDS OF THE LIBRARY REPORT: Joe introduced Kathryn Young from the
Friends.
Kathryn reported that the Friends talked about the their reorganization and the
success of the October 31, 1998 booksale. They are working on the Friends newsletter.
The Friends are providing $312.00 for Christmas gift certificates for the staff. Book
marks for contest will be judged next week.
DISCUSSION ITEMS: The library experiences recurring parking problems. The last two
weeks during story time there were no parking spots. The staff uses 15-20 parking spots.
Joe presented the City's solutions to the problem. The Board discussed the parking
problem. The Board wants to explore the Building Authorities solutions as well as lots
available for purchase on 9th street.
The Board discussed transfer of funds into the Capital Improvement Fund and the
Building Fund.
98-42 On motion made by Jack Howard and seconded by Betsy Scholten it was
RESOLVED THAT: The Board approves to move the maximum possible amount
from the General Fund to the Capital Improvement Fund and the Building Fund
for 1998, after regular expenditures are paid. Motion passed. P. 585, 11-19-98
The Board discussed the USD 305 Job Shadow Program. It is a school to career
program that places students in various businesses to observe how businesses really work.
Department Heads agreed they could handle one student a month in this program.

The Youth Placement Program -Keys to Future Grant will be placing teenage
students to work up to 10 hours a week this summer. This provides work experience for
youth. The grant would pay for the work. The library would place a student in Tech
Services. This project is administered by The Salina Arts and Humanities Commission.

ACTION ITEMS: Second Reading on Policy. The Board discussed policy up for
second reading.
98-43 On motion made by Janice Ostrom and seconded by Joe Lock it was RESOLVED
THA T: The Board approve on second reading the policy stating" The majority of
the Board shall constitute a quorum," passed on first reading in resolution 98-32.

THA T: The Board approves on second reading the policy "The Use of the Library
by Community Groups be deleted from the Library Policy," passed on first reading

98-45 On motion made by Jack Howard and seconded by Janice Ostrom it was
RESOLVED THAT: The Board approves on second reading the policy regarding
the return of library materials in remote book drops passed on first reading in

THAT: The Board approves on second reading the new staff development policy

SALINA PUBLIC LIBRARY COLLECTION AGENCY POLICY
The Salina Public Library may send a patron's account to the collection agc:mcy if that
patron has library materials that are long overdue 1 and
--the dollar amount of the long overdue materials totals $50.00 or more, or
--the materials are checked out through the interlibrary loan system, or
--the materials are out of print and in demand, or
--the Library Director determines that special circumstances warrant sending a patron's
account to the collection agency.

In order to recuperate some of the cost associated with sending an account to the
collection agency,2 a patron whose account has been sent to the collection agency is assessed a
charge based on the value of the materials that are long overdue.
Patrons who have long overdue materials valued at
--less than $100.00 are assessed a $15.00 charge;
--between $101.00 and $250.00 are assessed a $25.00 charge;
--between $251.00 and $500.00 are assessed a $50.00 charge;
--more than $500.00 of materials are assessed a $75.00 charge.
If no progress or if unsatisfactory progress is achieved on an account that is sent to the
collection agency, the Salina Public Library reserves the right to cancel the account at the
collection agency and to turn the matter over to the criminal court system, a collection attorney,
or another collection agency. The Library is within its legal rights to send a patron's account to
the criminal court system based on Article 37-CRIMES AGAINST PROPERTY of the KS.A.3
When the account of a patron who is less than 18 years of age qualifies to be sent to the
collection agency, the Library will attempt to establish a link in the automation system between
the patron record of the juvenile and the patron record of an adult who is financially responsible
for the juvenile. 4 An adult whose record is linked to the record of juvenile card holder (because
the library account of the juvenile has been turned over to the collection agency) is prohibited
from checking out library materials and from using Internet stations until the materials have been
returned and/or any charges associated with the items turned over to the collection agency have
been resolved. Once the matter has been resolved, the Library will remove the link between the
record of adult and the record of the juvenile.
¡Library materials are "long overdue" when a patron has not returned the overdue items within
seven days after the third overdue notice has been sent. Patrons who have long overdue
items on their accounts are not permitted to check out library materials and are not
permitted to use the Internet stations in the Adult Department.
2Currently, the Library must pay the collection agency (the Credit Bureau of Central Kansas)
35% of the total dollar value of any long overdue materials that the collection agency
retrieves.
3 Article 37. - CRIMES AGAINST PROPERTY
KS.A. 21-3702. Prima facie evidence of intent to permanently deprive owner or lessor of
possession, use or benefit of property.
(1) In any prosecution under this article, the following shall be prima facie evidence of intent to
permanently deprive the owner or lessor of property of the possession, use or benefit thereof:
( a) The giving of a false identification or fictitious name, address or place of employment
at the time of obtaining control over the property; or

(b) the failure of a person who leases or rents personal property to return the same within
10 days after the date set forth in the lease or rental agreement for the r(:turn of the
property, if notice is given to the person renting or leasing the property to return the
property within seven days after receipt of the notice, in which case the subsequent
return of the property within the seven-day period shall exempt such transaction from
consideration as prima facie evidence as provided in this section.
(2) In any prosecution for a misdemeanor under KS.A. 21-3701 and amendments thereto in
which the object of the alleged theft is a book or other material borrowed from a library, it
shall be prima facie evidence of intent to permanently deprive the owner of the possession,
use or benefit thereof if the defendant failed to return such book or material within 30 after
receiving notice from the library requesting its return, in which case the subsequent return of
the book or material within the 30-day period shall exempt such transaction uom
consideration as prima facie evidence as provided in this section.
(3) The word "notice" as used herein shall be construed to mean notice in writing and such
notice in writing will be presumed to have been given three days following deposit of the
notice as registered or certified matter in the United States mail, addressed to such person
who has leased or rented the personal property or borrowed the library material at the address
as it appears in the information supplied by such person at the time of such leasing, renting or
borrowing, or to such person's last known address.
4A parent, stepparent, legal guardian, or foster parent gives permission for a juvenile who is
less than 14 years of age to get a library card by completing and signing a Library Card
Application Form from the Children's Department or by completing and signing an Adult
Library Card Permission Form. The signature on the Library Card Authorization Form or
on the Adult Library Card Permission Form indicates that the parent, stepparent, or legal
guardian accepts full financial responsibility for any charges accrued on th(: juvenile's
card.
A juvenile who is between the ages of 14 and 18 may get a library card from the
Adult Circulation Department without parental permission. However, when that juvenile
applies for a library card he or she must name a parent, step-parent, legal guardian, or
foster parent who will accept full financial responsibility for any charges aĆrued on the
juvenile's card.

The Board discussed revised policy on replacement costs.

RESOLVED THAT: The Board accepts the revised replacement costs listed below
in the Replacement Costs for Lost or Ruined Materials policy on first r~ading.

Overdue, Lost, or Damaged Materials: Fines and Reparations:
A charge of$.10 (ten cents) per day is made on each overdue material. The maximum
fine on any book or item loaned, except films, is $5.00. The maximum fine on any book or item
loaned in the children's department is $2.00. The cost of replacement is charged for lost books or
other material; this payment is refunded if the lost item is returned in good condition. The
Library will not accept donated materials for lost or damaged materials.
When a patron loses a book or other library material, the patron will pay a replacement
cost for that material. The cost is determined by the average cost for that type of material and a
processing fee. Replacement prices will be reviewed annually through a check of book and
material costs with Baker and Taylor. The replacement costs are as follows:

Betsy Scholten asked Dianna Waite about why the hard plastic covers on the
magazines for checkout were oversized, making them harder to handle. Dianna responded
that the covers protected the materials when they were dropped off in the book drops.
FINANCIAL REPORT: Joe reported that the library is doing well. More books are
presently on order. The reports from the mutual funds come in slowly so there is no new
information at this time.
STATISTICAL REPORT: Circ is down slightly although it was a busy month.
LIBRARIAN'S REPORT: Joe McKenzie reported that work on updating thE~ fire alarms
system is under way. The Sandzen had been delivered to Denver for repair. Cost of repair
will be approximately $3,000.00. It will be ready to pick up after the first of the year.
The stairwell rail attached to the wall is being refinished.
There have been eleven applications for the Reference Librarian position. The ad
for the new Program Specialist for Children's will be in the paper on Wednesday and
Sunday. This is the last week of pre-school story time. There are new posters being made
up to encourage reading.
There is an 8% increase in the Health/Dental Insurance this year.
