05-14-2018 Minutes CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS May 14,2018 4:00 p.m. a The City Commission convened at 2:30 p.m. for the Parks Master Plan Update and at 3:45 p.m. for Citizens Forum. N The Regular Meeting of the Board of Commissioners was called to order at 4:00 p.m. in Room 107, City-County Building. Roll call was taken followed by the Pledge of Allegiance and a moment of silence. Those present and comprising a quorum: Mayor Karl F. Ryan (presiding), Commissioners Trent Davis,Joe Hay,Jr.,Melissa Rose Hodges, and Mike Hoppock. Also present: Jason Gage, City Manager; Michael Schrage, Deputy City Manager; Greg Bengtson, City Attorney; and Shandi Wicks,City Clerk. AWARDS AND PROCLAMATIONS (3.1) The day of May 19, 2018 as "Kids to Parks Day" in the city of Salina. Cade Thomas, Parks& Recreation Advisory Board Youth Member read the proclamation. (3.2) Special recognition for the Salina Police Department. Commissioner Hodges shared a picture of Officer Trevor Boudreaux paying his respects at the end of a funeral escort on April 14, 2018 during a snow storm. She continued to state the officers perform this service approximately 160 rimes each year. Commissioner Hodges also read the tribute prepared by the family. Commissioner Hodges thanked Officer Boudreaux for his service and presented him with a framed picture of himself. CITIZENS FORUM Robert Vidricksen, 1160 Columbine Lane, representing the Saline County Commission, provided information regarding the road annexation lawsuit and the need for both commissions to work together. Mayor Ryan thanked Mr. Vidricksen for bringing the matter to the commission and asked staff if they had an update on the matter. Greg Bengtson, City Attorney, stated the next procedural step was the filing of a mandate from the court of appeals instructing the district court on how to modify its ruling. He stated the notification was made today from the Court of Appeals to the Saline County District Court. Mr. Vidricksen provided information on the wishes of the Saline County Commission. Monte Shadwick, 709 Highland, asked Mr. Bengtson what the notification meant. Mr. Bengtson stated the Saline County District Court was now responsible to modify their decision to match the Court of Appeals. He continued to state he would need to match notes with Mr. Montoya to take the next steps. Mr. Shadwick stated that the matter needed to be discussed sooner rather than later and encouraged the City Commission to work with the County Commission on a resolution. Commissioner Hodges asked at what point action could be taken on the matter and asked if a joint meeting could occur with the Saline County Commission. Jason Gage, City Manager, stated the Governing Body and the Board of County Commissioners need to decide the best way to handle the discussions and identifying the issues relating to land annexation and the request for sharing maintenance. 2 Mayor Ryan provided his thoughts on having staff work with the county staff to prepare a w proposal but would also be fine with working directly with the County Commission. Commissioner Hay stated he felt the matter could be handled either by staff or by working with the County Commission. i3 8 Commissioner Davis stated he was in agreement with Mayor Ryan. Commissioner Hodges stated she would like to see a timeline on when the matter would be completed and stated there needed to be a sense of urgency on the matter. Mayor Ryan asked if staff could provide a timeline. Mr. Gage stated a list of issues could be created within 30 days and work towards a resolution on the matter within 60 days. Mr. Vidricksen stated he was in agreement on Mr. Gage's timeline but would like for a couple commissioners to be involved in the resolution of the matter. Mr. Bengtson stated now that a ruling was made through the courts, conversations could occur and remain in compliance with the court orders. He continued to state he would be looking to make sure the matter was handled in accordance with the open meeting laws. Jon Blanchard, 1117 State Street, provided his thoughts on the land annexation matter and the need for both commissions to work together. He continued to provide his thoughts on the need to take care of the facilities we currently have and stated he noticed that the 2 main courts at the Fieldhouse were closed for a significant amount of time and the cracks in the concrete were significant. Jason Gage, City Manager, stated a new synthetic floor was installed due to damage to the floors from installation of equipment in the ceiling that would typically have been done prior to the floor being installed. He continued to state there was concrete cracking in the building and stated the contractor was performing work to determine the cause of the cracking. Commissioner Hay provided his thoughts on the condition of the building floors. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME None. CONSENT r AGENDA (6.1) Approve the minutes of May 7, 2018. (6.2) Resolution No. 18-7555 appointing members to various boards and commissions. (6.3) Authorize staff to submit an application on behalf of eligible local recipient agencies for the 2018 Kansas Emergency Solutions Grant Program (ESG). (6.4) Authorize the City Manager to enter into an agreement with North Salina Community Development Inc. (NSCD) to form a public private partnership for residential sidewalk repair and replacement on North 9th Street from Euclid Avenue to Pacific Avenue. ADMINISTRATION (7.1) Second reading Ordinance No. 18-10934 approving an amendment of the Future w Land Use Map of the Salina, Kansas Comprehensive Plan to change the future land use designation of the southwest corner of North Ohio Street and Johnstown 8 Avenue from future Urban Residential to future Commercial. Mayor Ryan noted that Ordinance No. 18-10934 was passed on first reading on May 7, 2018 and since that time no comments have been received. 18-0165 Moved by Commissioner Hodges, seconded by Commissioner Hay, to adopt Ordinance No. 18- 10934 approving an amendment of the Future Land Use Map of the Salina, Kansas Comprehensive Plan to change the future land use designation of the southwest corner of North Ohio Street and Johnstown Avenue from future Urban Residential to future Commercial on second reading. OTHER BUSINESS Commissioner Hoppock stated he had been asked for a status on the recycling center and asked if staff could provide an update. Jason Gage, City Manager, stated the first and second phases of the environmental testing were completed and staff was now working to complete the task items. Jim Kowach, Director of Public Works, stated the results for the environmental testing were received on Friday, May 11, 2018. He continued to state the property owner would be installing a water line, sewer line and restrooms and staff would need to install signage and pavement. Commissioner Hodges asked what the status was for the curbside recycling and automated trash service. Mr. Kowach stated staff was currently working on developing specifications 1 for the new trucks to go out for bid next month and it would take several months or a year to get the new trucks. He also stated there would be ordinances created for consideration in the near future pertaining to the new automated sanitation services. Commissioner Hay stated the need for a set timeline on the recycling center. Mr. Gage Page 3 stated staff could set a set date but the facility could be completed before that date. A conversation ensued between the Commission, Mr. Kowach and Mr. Gage regarding the recycling center timeline. z ADJOURNMENT 18-047 Moved by Commissioner Davis, seconded by Commissioner Hay, that the regular meeting of the Board of City Commissioners be adjourned.
