BE IT ORDAINED by the Governing Body of the City of Salina. Kansas:

73 Section 1. Findings. The Governing Body makes the following findings:

(a) The City has received a number of sign permit applications proposing electronic
changeable copy advertising signs with video displays;
(b) In order to address the public interests associated with the erection; conversion, and
operation of electronic changeable copy advertising signs, it is necessary for the City to study both
(1) the potential impacts such signs may have on the public health, safety and welfare 'and (2) the
potential need for the adoption of amendments to the Salina Code regarding time, place, and
manner of the erection, conversion, and operation of electronic changeable copy advertising signs.
(c) A temporary moratorium has been recognized under Kansas law as a means of enabling
a municipal legislative body to address matters of legislative policy when allowing actions to
proceed under existing laws may lead to unacceptable, negative consequences contrary to the public
interest
(d) A 120-day temporary moratorium on the erection and operation of new electronic
changeable-copy advertising signs and the conversion and operation of existing advertising signs to
electronic changeable-copy advertising signs within the city of Salina is the best means of (1)
addressing the public interests associated with the regulation of electronic changeable copy
advertising signs and (2) ultimately assuring the fair and equal treatment of current and future
private interests relating to the erection, conversion, and maintenance of electronic changeable copy
advertising signs.
(e) Absent a temporary moratorium, the potential exists for the erection, conversion, and
operation of electronic changeable copy advertising signs without appropriate regulations in place
to mitigate potentially adverse impacts on the community contrary to the public interest, potentially
resulting in harmful effects upon residents, property owners; and business owners.
(0 The Governing Body desires to (1) address the public interest regarding the erection,
conversion, and operation of electronic changeable-copy advertising signs (2) study the potential
impacts that electronic changeable copy advertising signs may have on the public health, safety and
welfare, (3) study and determine what local regulations, if any; may be appropriate or necessary for
electronic changeable-copy advertising signs, (4) study and determine the appropriate zoning and
location for electronic changeable-copy advertising signs and (5) determine appropriate controls for
protection of public health and welfare; and needs a reasonable period of time to complete those
tasks; and
(g) The establishment of a short-term moratorium on the construction or conversion of new
111 electronic changeable copy advertising signs during the pendency of the legislative process in which
amendments to the Salina Code may be developed and considered is necessary in order to avoid
potential conflict between current policy and the policy determinations resulting from that
zz
legislative process.
Section 2. Definitions. For purposes of moratorium the following terms shall mean:

(a) "Advertising sign". A sign which directs attention to a business, commodity, service or
entertainment conducted, sold, or offered at a location other than the premises on which the sign is
located, or to which it is affixed (off-premise sign).
(b) "Electronic changeable copy sign/Computer-operated electronic message signs". A
sign containing a computer or digital software generated message or other automated or remote
method of changing copy.
Section 3. Moratorium. There is hereby established a moratorium on the erection and operation
of new electronic changeable-copy advertising signs and the conversion and operation of existing
advertising signs to electronic changeable-copy advertising signs within the city of Salina.
Section 4. Implementation. For the purpose of implementing this moratorium, City staff shall
not:
(a) Process any pending or future application for or issue any sign permit for the erection of
any electronic changeable copy advertising signs; nor
(b) Process any pending or future application for or issue any sign permit for the conversion
of any existing advertising sign to an electronic changeable copy advertising sign.

ordinance establishes a 120 day moratorium on new electronic changeable copy
advertising signs or the conversion of existing advertising signs to electronic

Section 6. Effective Date and Term. This ordinance shall be in full force and effect for and after
its adoption and summary publication once in the official city newspaper and shall remain in full
force and effect for a period of 120 days thereafter, unless further extended by ordinance.
