BE IT ORDAINED by the Governing Body of the City of Salina. Kansas:
Section 1. The following described land located within Saline County, Kansas is hereby condemned and
appropriated to the City of Salina. Kansas for the location, construction, installation, operation, repair
and maintenance of a water treatment plant and to further assure its future capacity to provide a reliable
public water supply, to-wit:

COUNTY, KANSAS, MORE PARTICULARLY DESCRIBED AS FOLLOWS: COMMENCING

belonging or in anywise appertaining, including, but not limited to, all appurtenant water rights,
including, but not limited to, appropriation water right No. 3830.
Section 2. It is hereby found that the costs of this project will be paid by revenues from the sale of
water by the City to it's ratepayers.
Section 3. The City Manager is hereby ordered and directed forthwith to cause the initiation of eminent
domain proceedings to acquire the above-described real property, and to do and perform all other things
which might be necessary and required by law to acquire the aforementioned real property.
Section 4. Summary of ordinance for publication. This ordinance shall be in full force and effect
from and after its adoption and publication once by summary in the official city newspaper.

On March 5, 2018, the City Commission passed Ordinance No. 18-10920. The ordinance
condemns land by the City of Salina for the location and construction of a water treatment
plan at South Ohio Street and East Water Well Road, Saline County, Kansas and to further
assure its future capacity to provide a reliable public water supply, and directs the city
manager to cause the initiation of an eminent domain proceeding as provided by applicable
