ORDINANCE NUMBER 18-10917
AN ORDINANCE AMENDING ORDINANCE NUMBER 8628, TO THE EXTENT
NECESSARY TO AMEND THE FINAL DEVELOPMENT PLAN AND APPLICABLE
CONDITIONS FOR THE TOLLE SUBDIVISION PLANNED DEVELOPMENT
B DISTRICT.
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. Findings. In relation to the following described real estate:
Lot Three (3), Block One (1), Tolle Subdivision in the City of Salina, Saline County, Kansas
(the"Property")
the Governing Body makes the following findings:
1. All conditions precedent for the amendment of the final development plan and
applicable conditions for the Tolle Subdivision Planned Development District as it
applies to the Property have been timely met;
2. No change to the existing building footprint is being proposed and the additional
dwelling unit should not be noticeable to or have an impact on neighboring properties;
3. Adequate off-street parking is available on the site to support a third dwelling unit; and
4. The subject property is located in a Suburban Residential land use area and medium
density development in an identified secondary use in this land use category in the
Comprehensive Plan. The residential density on this site would increase to 13 units/acre,
which is still within the density limits of the R-2 zoning district.
Section 2. Ratification of Zoning Classification as PLANNED DEVELOPMENT DISTRICT
R-2 ( Multiple-Family Residential). The amendment of the Zoning District Map of the City of
Salina, Kansas to rezone the Property as part of PLANNED DEVELOPMENT DISTRICT R-2
(Multiple-Family Residential) enacted by Ordinance No. 8628 is ratified and shall remain in effect
Section 3. Amended Final Development Plan. The amended final development plan as
recommended for approval by the planning commission is approved and incorporated as part of this
ordinance and shall be filed in the zoning administrator's office.
Section 4. Amended Conditions of Approval. Use of the Property shall continue to be subject to
all of the conditions, restrictions, and limitations applicable to the "R-2" Multiple-Family
Residential District under Ordinance 8526, as amended and as codified in Chapter 42 of the Salina
Code. Development of the Property shall be subject to and substantially conform to (a) the
amended final development plan and (b) the following conditions:
1. Zoning district regulations. Development and use of the Property shall be limited to the
uses permitted in the "R-2"Multiple-Family Residential District, except that a three (3)
family dwelling unit (triplex) shall be permitted on Tract No. 3 of the Property and shall
be subject to the bulk regulations and use limitations applicable to the "R-2" Multiple-
Family Residential District, except as enumerated in sub-point 2 below.
2. Variations and modifications. Pursuant to Salina Code Sec. 42-403(a)(12), otherwise
applicable district regulations shall be varied or modified as follows:
None.

3. Additional conditions. Development and use of the Property shall be subject to the
following additional conditions:
a) The plan drawing shall be labeled: Amended Final Development Plan Tolle
Subdivision Planned Development District;
b) The addressing of the proposed dwelling units shall be 2097, 2099 A and 2099 B
Hageman Avenue and these addresses shall be clearly posted at the exterior
entrances to each dwelling unit and on an address identification sign posted at the
Hageman Avenue driveway entrance to the property;
c) The property owner must submit building plans and a building permit application for
review and approval by City staff prior to making the proposed modifications to
create a third dwelling unit on Tract No. 3; and
d) The property owner shall be responsible for preparing and submitting two (2) 24 inch
x 36 inch mylars of the Amended Final Development Plan of Lot 3, Block 1, of the
Tolle Subdivision containing all required technical corrections, for recording in the
Saline County Register of Deeds office.
Section 5. Repealer. Ordinance Number 8628 and all other prior ordinances relating to the
Property are repealed to the extent they are in conflict with this ordinance.
Section 6. Summary of ordinance for publication. This ordinance shall be in full force and
effect from and after its adoption and publication once by summary in the official city newspaper.
Ordinance No. 18-10917 Summary
On February 12, 2018, the City Commission passed Ordinance No. 18-10917. The ordinance
amends the Tolle Subdivision PDD on Hageman Avenue to allow 2097-2099 Hageman
Avenue to be converted from a two family dwelling to a three family dwelling. A complete
