ORDINANCE NUMBER 17-10903 AN ORDINANCE AMENDING SALINA CODE SECTION 41-28 PERTAINING TO WATER TAPS AND CHARGES AND SECTION 41-71.1 PERTAINING TO SEWER CONNECTION PERMITS AND FEES AND REPEALING THE EXISTING SECTIONS. w BE IT ORDAINED by the Governing Body of Salina, Kansas: h Section 1. Amendment. Section 41-28 of the Salina Code is amended to read as follows: Sec. 41-28. Taps and charges. (a) Pursuant to K.S.A. 12-860, as amended, when a person requests water service to any property served by a water main for which no owner of the property has paid the share of the cost of installation of the water main attributable to the property, such person shall, as a condition precedent to the installation of service, pay a charge to be established by the city manager or the city manager's designee based upon either the actual cost plus reasonable interest or the present- day estimated cost of installation of the water main apportioned on either the front-footage or the square footage of the lot to be served, whichever is more equitable under the circumstances. (b) Any person requesting a new water service shall apply for such service at the utilities department office. The utility will tap the main and install the water service line terminating with a curb cock if the meter is to be installed on private property or terminate with a curb cock and meter set if meter is installed on public property. Before the new service is initiated, the person shall pay the charge described in subsection (a). The city shall inspect and approve all plumbing on private property served by the service line prior to initiation of service. (c) If a customer or property owner requests the replacement or relocation of all or any part of an existing water service line due to size or location, the city manager or the city manager's designee will review the request and, if approved, determine the estimated cost of the work. The customer or property owner will then deposit the estimated cost of the work with the water utility and the water utility will cause the work to be performed. Upon completion of the work, the deposit will be applied to the actual cost of the work and the customer or property will either be reimbursed or pay that amount necessary to equal the actual cost of the work before service will be reinitiated. Section 2. Amendment. Section 41-71.1 of the Salina Code is amended to read as follows: Sec. 41-71.1. Sewer connection permits and fees. (a) Pursuant to K.S.A. 12-860, as amended, when a person requests sanitary sewer service to any property served by a water main for which no owner of the property has paid the share of the cost of installation of the water main attributable to the property, such person shall, as a condition precedent to the installation of service, pay a charge to be established by the city manager or the city manager's designee based •upon either the actual cost plus reasonable interest or the present-day estimated cost of installation of the sanitary sewer main apportioned on either the front-footage or the square footage of the lot to be served, whichever is more equitable under the circumstances. (b) Any person requesting a new sanitary sewer service shall apply for such service at the utilities department office. Before the new service is connected, the person shall pay the charge described in subsection (a). The city shall inspect and approve all the plumbing on private property serviced by the service line prior to the sanitary sewer being connected. Section 3. Repealer. Existing Salina Code Sections 41-28 and 41-71.1 are repealed. Section 4. Effective. This ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper by the following summary: Ordinance No. 17-10903 Summary On November 6, 2017, the City Commission passed Ordinance No. 17-10903. The Ordinance amends Salina Code Sec. 41-28 pertaining to water taps and charges and Section 41-71.1 pertaining to sewer connection permits and fees and repeals the existing sections.
