08-14-2017 Minutes CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS August 14, 2017 4:00 p.m. The City Commission convened at 3:45 p.m. for Citizens Forum. The Regular Meeting of the Board of Commissioners was called to order at 4:00 p.m. in Room 107, City-County Building. Roll call was taken followed by the Pledge of Allegiance and a moment of silence. Those present and comprising a quorum: Mayor Kaye J. Crawford (presiding),Commissioners Jon Blanchard,Trent Davis, and Karl Ryan. Also present: Jason Gage, City Manager; Michael Schrage, Deputy City Manager; Greg Bengtson, City Attorney; and Shandi Wicks,City Clerk. Absent: Commissioner Melissa Rose Hodges. Mayor Crawford stated in light of the recent events in Charlottesville, Virginia, Salina will not tolerate hate, bigotry or Neo-Nazism or anything in that nature. She asked those in attendance to remember as they say the Pledge of Allegiance it says "AND JUSTICE FOR ALL." AWARDS AND PROCLAMATIONS (3.1) Mayor Crawford to recognize outgoing Fire Marshal Roger Williams. Chief Kevin Royse provided a brief biography of Fire Marshal Roger Williams. He continued to provide detailed information on Fire Marshal Williams tenure with the Salina Fire Department. Mayor Crawford thanked Fire Marshal Williams for his dedication and hard work. Commissioner Blanchard stated the number of individuals in attendance from the Salina Fire Department showed the dedication of Fire Marshal Williams. He continued by thanking Fire Marshal Williams for his hard work and dedication and ,to enjoy his retirement. CITIZENS FORUM None. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME None. CONSENT AGENDA (6.1) Approve the minutes of August 7, 2017. 17-0229 Moved by Commissioner Blanchard, seconded by Commissioner Davis, to approve the consent agenda as presented. Aye: (4). Nay: (0). Motion carried. ADMINISTRATION (7.1) Second reading Ordinance No. 17-10893 levying special assessments against certain lots and pieces of property to pay the cost of abatements of nuisances,as amended. Page 1 Mayor Crawford noted that Ordinance No. 17-10893 was passed on first reading on August 7, 2017. Since then, the report and ordinance have been modified to show payments received after the first reading of the ordinance in the amount of 5174.75. 17-00 Moved by Commissioner Blanchard, seconded by Commissioner Davis, to adopt Ordinance No. 17-10893 levying special assessments against certain lots and pieces of property to pay the cost of abatements of nuisances, as amended on second reading. A roll call vote was taken. Ave: (4) Blanchard, Davis, Ryan,Crawford. Nay: (0). Motion carried. (7.2) Second reading Ordinance No. 17-10894 levying special assessments against certain 13 lots and pieces of property to pay the cost of the repair of sidewalks. Mayor Crawford noted that Ordinance No. 17-10894 was passed on first reading on August 7, 2017 and since that time no comments have been received. 17-0231 Moved by Commissioner Blanchard, seconded by Commissioner Ryan, to adopt Ordinance No. 17- 10894 levying special assessments against certain lots and pieces of property to pay the cost of the repair of sidewalks on second reading. A roll call vote was taken. Aye: (4) Blanchard, Davis, Ryan, Crawford. Nay: (0). Motion carried. (7.3) Resolution No. 17-7469 replacing Resolution No. 16-7316 addressing the volunteer citizen boards, commissions and committees including an amendment and addition pertaining to the Ethics Policy of the City of Salina. Jason Gage, City Manager, explained the policy changes and action options. Commissioner Blanchard stated there were times on a volunteer board agenda when there was only one item and if a member would find a conflict of interest, how would that be handled so the board could still have a quorum. He continued by asking if the board member would decide to not attend the meeting would it be possible to not have it hurt their attendance record. Mr. Gage stated if a member was aware of the conflict, it would be best to let the board liaison know so the potential conflict could be reviewed by staff and legal and determine the best way to proceed. 17-0232 Moved by Commissioner Blanchard, seconded by Commissioner Davis, to adopt Resolution No. 17-7469 replacing Resolution No. 16-7316 which addresses the volunteer citizen boards, commissions and committees including an amendment to Section 3.B. and the addition of Section 3.F., both of which add provisions regarding the Ethics Policy of the City of Salina. Aye: (4). Nay: (0). Motion carried. DEVELOPMENT BUSINESS None. OTHER BUSINESS (9.1) Request for executive session (legal). 17-0233 Moved by Commissioner Davis, seconded by Commissioner Blanchard, to discuss contract negotiations with legal counsel pursuant to the attorney-client privileged communications with legal counsel exception, K.S.A. 45-7319(b)(2), for 12 minutes. The open meeting will resume in this room at 4:30 p.m. Aye: (5). Nay: (0). Motion carried.
