04-6105 Establishing Animal Control BoardRESOLUTION NUMBER 04-6105 A RESOLUTION ESTABLISHING AN ANIMAL CONTROL ADVISORY AND APPEALS BOARD IN ACCORDANCE WITH SECTION 7-16 OF THE SALINA CODE. BE IT RESOLVED by the Governing Body of Salina, Kansas: Section 1. There is hereby established the Animal Control Advisory and Appeals Board (hereinafter referred to as "the board") in accordance with Section 7-16 of the City Code. Section 2. Membership. The board shall consist of nine (9) members appointed by the Mayor with the consent of the Governing Body. Members of the Salina -Saline County Board of Health are eligible for appointment to the board, in addition to their Board of Health appointment. Section 3. Appointment and Term. Those person first appointed as members of the board shall be appointed for the following terms: (1) Three members for a term of one (1) year. (2) Three members for a term of two (2) years. (3) Three members for a term of three (3) years. Upon expiration of the term of each board member, subsequent terms shall be for a period of three (3) years. No member shall serve more than two terms except that members appointed to an initial term of one or two years or to complete an unexpired term may serve two full terms beyond their initial term. Any vacancy occurring among the membership of the board shall be filled in the same manner as initial appointment. Section 4. Compensation. The members of the board shall serve without compensation. Section 5. Meetings. The board shall meet at least quarterly and at other times when necessary. Section 6. Officers. The board shall elect one of its members as board chair for the term of one (1) year. The board chair shall preside at all meetings of the board. The board shall elect in the same manner and for the same term, one of its members to serve as vice -chair, who shall act in the absence of the board chair. Section 7. Quorum. Five (5) members of the board shall constitute a quorum for the purpose of conducting the board's business. Section 8. Staff Services. Primary staff to the board shall be provided by the Animal Shelter Division of the Salina - Saline County Health Department. The city manager shall assign a staff member as administrative liaison and the chief of police shall assign a staff member as law enforcement liaison to the board. Section 9. Purpose. 1. Act in an advisory capacity to the City -County Board of Health and their animal shelter staff on matters pertaining to Salina Animal Shelter and general animal control and protection responsibilities. r- 2. Act in an advisory capacity to the City Commission on potential changes to Chapter 7 of the City Code and other city ordinances pertaining to animals. 3. Act in an advisory capacity to the city manager, chief of police and animal control supervisor on matters pertaining to administration and enforcement responsibilities of Chapter 7 of the City Code and other related city ordinances. 4. Perform specific duties as required in Chapter 7 of the City Code, including having a three (3) member panel of the board consider permit action appeals under Section 7-125. Section 10. That this resolution shall be in full force and effect from and after October 1, 2004. Adopted by the Board of Commissioners and signed by the Mayor this 9th day of August, 2004.
