12-28-2016 Minutes CITY OF SALINA, KANSAS SPECIAL MEETING OF THE BOARD OF COMMISSIONERS December 28, 2016 8:00 a.m. The Special Meeting of the Board of Commissioners was called to order at 8:00 a.m. in Room 107, City-County Building. Roll call was taken followed by the Pledge of Allegiance and a moment of silence. Those present and comprising a quorum: Mayor Kaye J. Crawford (presiding), Commissioners Jon Blanchard,Trent Davis, Randall Hardy, and Karl Ryan. Also present: Jason Gage, City Manager; Michael Schrage, Deputy City Manager; Greg Bengtson, City Attorney; and Shandi Wicks, City Clerk. ADMINISTRATION (3.1) International and Uniform Building Codes. (3.1a) First reading Ordinance No. 16-10872. (3.2b) Declare of compelling public purpose exists for second reading on the same day. (3.2c) Second reading Ordinance No. 16-10872. Michael Schrage, Deputy City Manager, explained the adoption of the building codes, the amendments and action options. Mayor Crawford asked if there were any other complaints received. Mr. Schrage stated staff had not received any complaints but there were a number of contractors with new projects that would be affected by the change. Commissioner Blanchard asked if staff had already sent out correspondence with contractors. Gary Hobbie, Director of Community & Development Services, stated staff had sent an email notifying the contractors of the meeting and possible changes. Don Marrs, DMA Architects, provided his thoughts on the code amendments. Commissioner Blanchard asked Mr. Marrs why he did not come to the City Commission sooner. Mr. Marrs stated three (3) months was not enough time. A conversation ensued between the Commission and Mr. Marrs regarding the implementation time of the building codes. Commissioner Blanchard provided his thoughts on the implementation of the building codes and the Design Review Team (DRT) process. Mr. Marrs also provided his thoughts on the implementation of the building codes and the DRT process. Mayor Crawford asked if the April 1, 2017 implementation date would work for Mr. Marrs. Mr. Marrs stated yes. Commissioner Davis asked if the school projects would continue to fall under the old building codes. Jim Brown, Building Official stated the school projects were submitted as a complete submittal but had multiple phases. He continued to state the school projects would remain under the current 2006 codes for the entire project. Page 1 A conversation ensued between the Commission, Mr. Schrage and Mr. Marrs regarding projects in relation to the building codes. Mr. Schrage stated if an application would be received before the effective date, the project would fall under the current building codes. w Jason Gage, City Manager, provided information on the DRT process and the proposed Ez implementation of the new building codes. Mr. Marrs provided additional information on the implementation of the building codes. 16-0496 Moved by Commissioner Davis, seconded by Commissioner Hardy, to pass Ordinance No. 16- 10872 on first reading. Aye: (5). Nay: (0). Motion carried. 16-0497 Moved by Commissioner Davis, seconded by Commissioner Ryan, to declare a compelling public purpose exists for second reading approval of Ordinance No. 16-10872 on the same day as the first reading. Aye: (5). Nay: (0). Motion carried. 16-0498 Moved by Commissioner Davis, seconded by Commissioner Ryan, to adopt Ordinance No. 16- 10872 on second reading. A roll call vote was taken. Aye: (5) Blanchard, Davis, Hardy, Ryan, Crawford. Nay: (0). Motion carried. OTHER BUSINESS (4.1) Request for executive session (legal). ,16-0499 Moved by Commissioner Davis, seconded by Commissioner Hardy, to recess into executive session for 45 minutes to discuss with legal counsel matters subject to the attorney-client privilege for the reason that public discussion of those matters would waive the privilege and adversely affect the City's interest in the matters and reconvene at 9:30 a.m. Aye: (5). Nay: (0). Motion carried The City Commission recessed into executive session at 8:40 a.m. and reconvened at 9:30 a.m. No action was taken. 16-0500 Moved by Commissioner Ryan, seconded by Commissioner Crawford, to extend the current executive session for an additional 30 minutes. Aye: (5). Nay: (0). Motion carried. The City Commission recessed into executive session at 9:30 a.m. and reconvened at 10:00 a.m. No action was taken. 16-0501 Moved by Commissioner Davis, seconded by Commissioner Ryan, to extend the current executive session for an additional 28 minutes. Aye: (5). Nay: (0). Motion carried. The City Commission recessed into executive session at 10:00 a.m. and reconvened at 10:28 a.m. No action was taken.
