(Published on the City of Salina's website for a minimum of one week from DWgfflbDL2S 20116) ORDINANCE NUMBER 16-10872 AN ORDINANCE AMENDING THE EFFECTIVE DATES OF ORDINANCES 16-10846,16- 10847, 16-10848, 16-10849, 16-10850, 16-10851, AND 16-10852 PERTAINING TO THE ADOPTION OF THE 2012 INTERNATIONAL BUILDING CODE, 2012 INTERNATIONAL RESIDENTIAL CODE, 2012 UNIFORM PLUMBING CODE, 2012 UNIFORM MECHANICAL w CODE, 2011 NATIONAL ELECTRICAL CODE, 2012 INTERNATIONAL ENERGY y CONSERVATION CODE, AND 2012 INTERNATIONAL FIRE CODE AND LOCAL a AMENDMENTS OF EACH AND ESTABLISHING CRITERIA FOR BUILDING PERMITS BEING REVIEWED AND APPROVED SUBJECT TO THE CODES IN EFFECT AT THE TIME A PROJECT WAS INITIATED. BE IT ORDAINED by the Governing Body of Salina, Kansas: Section 1. Amendment of Section 60 of Ordinance No. 16-10846. Section 60 of Ordinance No. 16- 10846 of the Salina Code is amended to read as follows: Section 60. Effective. This ordinance shall be in full force on January 1, 2017; provided however, applicants for projects initiated prior to April 1, 2017 may elect that plan and permit review, permit issuance and inspection be conducted in accordance with the 2006 International Building Code and local amendments as previously in effect on December 31, 2016. A project shall be considered to have been initiated upon application for a building permit for any of the following scopes of work: 1. footing & foundation, ' 2. shell construction, 3. whitebox construction, 4. tenant finish construction, or 5. any combination of the above scopes of work to accomplish full project completion. Applicants for projects that have been initiated prior to April 1, 2017 shall be allowed to continue to elect that their project be designed, permitted, constructed and inspected for subsequent phases of work according to the 2006 Intemational Building Code and local amendments in effect on December 31, 2016, provided that construction is undertaken no later than 90 days from the time of project initiation and that an active building permit is maintained from the commencement of construction until project completion. In the event that construction is not commenced or an active permit is not maintained as required, subsequent construction or permits and corresponding work shall be subject to the 2012 International Building Code and local amendments in effect on January 1, 2017. 2. Repealer. Existing Section 60 of Ordinance No. 16-10846 is repealed. Section 3. Amendment of Section 39 of Ordinance No. 16-10847. Section 39 of Ordinance No. 16- 10847 of the Salina Code is amended to read as follows: Section 39. Effective. This ordinance shall be in full force on January I, 2017; provided however, applicants for projects initiated prior to April 1, 2017 may elect that plan and permit review, permit issuance and inspection be conducted in accordance with the 2006 International Residential Code for One and Two -Family Dwellings and local amendments as previously in effect on December 31, 2016. A project shall be considered to have been initiated upon application for a building permit for any of the following scopes of work: 1. footing & foundation, v 2. shell construction, 3. whitebox construction, 4. tenant finish construction, or 5. any combination of the above scopes of work to accomplish full project completion. Section 15 of Ordinance No. 16- 10848 of the Salina Code is amended to read as follows: Section 15. Effective. This ordinance shall be in full force on January 1, 2017; provided however, applicants for projects initiated prior to April 1, 2017 may elect that plan and permit review, permit issuance and inspection be conducted in accordance with the 2006 Uniform Plumbing Code and local amendments as previously in effect on December 31, 2016. A project shall be considered to have been initiated upon application for a building permit for any of the following scopes of work: 1. footing & foundation, 2. shell construction, 3. whitebox construction, 4. tenant finish construction, or 5. any combination of the above scopes of work to accomplish full project completion. Repealer. Existing Section 15 of Ordinance No. 16-10848 is repealed. Amendment of Section 18 of Ordinance No. 16-10849. Section 18 of Ordinance No. 16- 10849 of the Salina Code is amended to read as follows: Section 18. Effective. This ordinance shall be in full force on January 1, 2017; provided however, applicants for projects initiated prior to April 1, 2017 may elect that plan and permit review, permit III issuance and inspection be conducted in accordance with the 2006 Uniform Mechanical Code and local amendments as previously in effect on December 31, 2016. A project shall be considered to have been initiated upon application for a building permit for any of the following scopes of work: 1. footing & foundation, 2. shell construction, 3. whitebox construction, 4. tenant finish construction. or 5. any combination of the above scopes of work to accomplish full project completion. Section 10 of Ordinance No. 16- 10850 of the Salina Code is amended to read as follows: Section 10. Effective. This ordinance shall be in full force on January 1, 2017; provided however, applicants for projects initiated prior to April I, 2017 may elect that plan and permit review, permit issuance and inspection be conducted in accordance with the 2005 National Electric Code and local amendments as previously in effect on December 31, 2016. A project shall be considered to have been initiated upon application for a building permit for any of the following scopes of work: 1. footing & foundation, 2. shell construction, 3. whitebox construction, 4. tenant finish construction, or 5. any combination of the above scopes of work to accomplish full project completion. Applicants for projects that have been initiated prior to April 1, 2017 shall be allowed to continue to elect that their project be designed, permitted, constructed and inspected for subsequent phases of work according to the 2005 National Electric Code and local amendments in effect on December 31, 2016, provided that construction is undertaken no later than 90 days from the time of project initiation and that an active building permit is maintained from the commencement of construction until project completion. In the event that construction is not commenced or an active permit is not maintained as required, subsequent construction or permits and corresponding work shall be subject to the 2012 National Electric Code and local amendments in effect on January 1, 2017. 10. Repealer. Existing Section 10 of Ordinance No. 16-10850 is repealed. Section 11. Amendment of Section 5 of Ordinance No. 16-10851. Section 5 of Ordinance No. 16- 10851 of the Salina Code is amended to read as follows: Section 5. Effective. This ordinance shall be in full force on January 1, 2017; provided however, applicants for projects initiated prior to April 1, 2017 may elect that plan and permit review, permit issuance and inspection be conducted without the application of the 2012 International Energy Conservation Code since it was not in effect on December 31, 2016. A project shall be considered y to have been initiated upon application for a building permit for any of the following scopes of work: a 1. footing & foundation, 2, shell construction, 3. whitebox construction. 4. tenant finish construction, or 5. any combination of the above scopes of work to accomplish full project completion. Applicants for projects that have been initiated prior to April 1, 2017 shall be allowed to continue to elect that their project be designed, permitted, constructed and inspected for subsequent phases of work without the application of the 2012 International Energy Code since it was not in effect on December 31, 2016, provided that construction is undertaken no later than 90 days from the time of project initiation and that an active building permit is maintained from the commencement of construction until project completion. In the event that construction is not commenced or an active permit is not maintained as required, subsequent construction or permits and corresponding work shall be subject to the 2012 International Energy Code and local amendments in effect on January 1, 2017. Section 12. Repealer. Existing Section 5 of Ordinance No. 16-10851 is repealed Section 13. Amendment of Section 63 of Ordinance No. 16-10852. Section 63 of Ordinance No. 16- 10852 of the Salina Code is amended to read as follows: Section 63. Effective. This ordinance shall be in full force on January 1, 2017; provided however, applicants for projects initiated prior to April 1, 2017 may elect that plan and permit review, permit issuance and inspection be conducted in accordance with the 2006 International Fire Code and local amendments as previously in effect on December 31, 2016. A project shall be considered to have been initiated upon application for a building permit for any of the following scopes of work: 1. footing & foundation, 2. shell construction, 3. whitebox construction, 4. tenant finish construction, or 5. any combination of the above scopes of work to accomplish full project completion. Applicants for projects that have been initiated prior to April I, 2017 shall be allowed to continue to elect that their project be designed, permitted, constructed and inspected for subsequent phases of work according to the 2006 International Fire Code and local amendments in effect on December 31, 2016, provided that construction is undertaken no later than 90 days from the time of project initiation and that an active building permit is maintained from the commencement of construction until project completion. Section 14. Repealer. Existing Section 63 of Ordinance No. 16-10852 is repealed. d Section 15. Effective. The Ordinance amends the effective dates of Ordinances 16-10846, 16-10847, 16-10848, 16-10849, 16-10850, 16- 10851, and 16-10852 pertaining to the adoption of the 2012 International Building Code, 2012 International Residential Code, 2012 Uniform Plumbing Code, 2012 Uniform Mechanical Code, 2011 National Electrical Code, 2012 International Energy Conservation Code, and 2012 Intemational Fire Code and local amendments of each and establishes criteria for building permits being reviewed and approved subject to the codes in effect at the time a project was initiated.
