00-5610 Intent Fox GrantC111 d111d Sxwa RESOLUTION NUMBER 00-5610 A RESOLUTION OF INTENT TO PROVIDE A CAPITAL GRANT FOR RESTORATION AND RE -USE OF THE HISTORIC FOX THEATRE IN DOWNTOWN SALINA. WHEREAS, on March 20, 2000, the Board of City Commissioners of the City of Salina, Kansas adopted Resolution Number 00-5578 expressing strong support of the restoration and re -use plans for the Historic Fox Theatre located in downtown Salina (the "Project") developed by the Historic Fox Theatre of Salina Foundation, Inc. (the "Foundation"); and WHEREAS, the City Commission wishes to reiterate its expression of support for the Project and its determination that the Project will add significantly to Salina's economic vitality, downtown revitalization, historic preservation, entertainment opportunities, and overall quality of life; and WHEREAS, the City Commission wishes to express its intent, and to encourage any future boards of City Commissioners, to recognize the beneficial public purposes that completion of the Project will serve by matching a certain level of significant private support for the Project with a grant of city funds for specific capital costs required to complete the Project; SO NOW THEREFORE BE IT RESOLVED by the Governing Body of the City of Salina, Kansas: Section 1. That the Governing Body finds that completion of the Project will serve the public purposes of adding significantly to Salina's economic vitality, downtown revitalization, historic preservation, entertainment opportunities, and overall quality of life. Section 2. That it is the intent of the Governing Body to make a capital grant to the Foundation in the amount of $750,000 (the "Grant") upon the following conditions and in the following manner.: a. It is the intent of the Governing Body that the Foundation qualify for the Grant by documenting the receipt or commitment of other funding (including, for example, individual and corporate donations, state or federal grants, and any other similar revenue sources) totaling $2,150,000. The first half of the Grant ($375,000) would be paid by the City to the Foundation in the same calendar fiscal year as the required amount of other funding is attained. The second half of the Grant ($375,000) would be paid by the City to the Foundation at the beginning of the next following calendar fiscal year for the City. b. As has been suggested by the Foundation, following completion of the Project the City will be allowed use of the Fox Theatre without charge for four mutually agreed upon dates each year. It is the intent of the Governing Body that two of the four dates be for community arts and cultural activities as recommended by the Salina Arts and Humanities Commission and that the remaining two dates be allocated by the Governing Body for charitable, not -for —profit uses. C. The Grant funds shall be used for actual capital costs incurred in completion of the Project. The Foundation shall account to the City in order to verify use of the Grant funds for that prescribed purpose. Section 3. That this resolution of intent shall be in full force and effect from and after its adoption and shall expire at 5:00 p.m., December 31, 2001.
