RESOLUTION NUMBER 99-5467
A RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE A LEASE
AGREEMENT BETWEEN THE BOARD OF COUNTY COMMISSIONERS OF SALINE
COUNTY, KANSAS, THE SALINA AREA FLYING EAGLES AND THE MID -AMERICA
RADIO CONTROLLED SOCIETY FOR CONDITIONAL USE OF FLOOD CONTROL
PROPERTY.
WHEREAS, the Schilling Road/Drainage Project, constructed in 1997, established a
250 acre tract of land at the southwest corner of Schilling Road and the flood control levee to be
used for storm water channelization and detention; and
WHEREAS, the project was a collaborative effort between Saline County, the State
of Kansas and the City of Salina; and
WHEREAS, at the end of the project Saline County retained ownership of the land
while the City of Salina has the responsibility for the maintenance of the entire drainage system;
and
WHEREAS, on November 2, 1998 the Saline County Planning and Zoning
Commission conducted a hearing to consider a request from the Salina Area Flying Eagles and
Mid-America Radio Controlled Society for a conditional use permit for a miniature radio control
aircraft flying field in this agricultural zoning district; and
WHEREAS, the permit was approved with some conditions including the submittal
of a complete plan and survey, compliance with the Corps of Engineers regulations relative to the
levee system and approval of this lease agreement. SO NOW THEREFORE
BE IT RESOLVED by the Governing Body of the City of Salina, Kansas:
Section 1. That the Mayor is hereby authorized to execute an agreement with Saline
County, the Salina Area Flying Eagles and the Mid-America Radio Controlled Society for the
lease of the Schilling Road/ Drainage area subject to the terms and conditions of the agreement, in
an amount not to exceed $ 2,250.00.
Section 2. That this resolution shall be in full force and effect from and after its
adoption.
Adopted by the Board of Commissioners and signed by the Mayor this 7th day of
June, 1999.
