03-10184 Zone Overland View Add(Published in the Salina Journal on March, 2004) ORDINANCE NUMBER 03-10184 AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE NUMBER 8526, THE SAME BEING CHAPTER 42 OF THE SALINA CODE, AND THE ZONING DISTRICT MAP THEREIN AND THEREBY ADOPTED AND PROVIDING FOR THE REZONING OF CERTAIN PROPERTY WITHIN THE CITY AND PRESCRIBING THE PROPER USES THEREOF AND AMENDING THE COMPREHENSIVE PLAN. WHEREAS, all conditions precedent for the amendment of the Zoning District Map, the rezoning of certain property therein, hereinafter described has been timely complied with, SO NOW, THEREFORE, BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. COMPREHENSIVE PLAN AMENDMENT. That the Comprehensive Plan shall be amended as follows: The Land Use Plan shall be amended redesignating the tracts of land described herein from Low -Density Residential to Medium -Density Residential. Section 2. AMENDMENT. DISTRICT "PDD R-2.5". MULTI -FAMILY RESIDENTIAL PLANNED DEVELOPMENT DISTRICT. That the Zoning District Map of the City of Salina, Kansas, duly adopted and published as a part of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, be and it is hereby amended so that the following described property be rezoned as follows, to -wit: Lot 1, Block 1 of the Overland View Addition to the City of Salina, Saline County, Kansas. shall become a part of District "PDD R-2.5". MULTI -FAMILY RESIDENTIAL PLANNED DEVELOPMENT DISTRICT. Section 3. AMENDMENT. DISTRICT "PDD C-111. RESTRICTED BUSINESS PLANNED DEVELOPMENT DISTRICT. That the Zoning District Map of the City of Salina, Kansas, duly adopted and published as a part of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, be and it is hereby amended so that the following described property be rezoned as follows, to -wit: Lot 2, Block 1 of the Overland View Addition to the City of Salina, Saline County, Kansas Section 4. CONDITIONS OF APPROVAL. That the use of said described property shall be subject to all the conditions, restrictions and limitations as made and provided for in Ordinance Number 8526, the same being Chapter 42 of the Salina Code with reference to the PLANNED DEVELOPMENT DISTRICT. Development of the property shall be subject to the plans on file with the City Planning Commission and/or City Clerk and the following conditions, to -wit: 1. Development limitations shall be as follows: a) Development of Lot 1 shall be limited to multi -family residential apartments containing no more that 96 dwelling units and shall be subject to all bulk, use and signage limitations in the R-2.5 district regulations. b) Development of Lot 2 shall be limited to multi -family residential apartments containing no more than 16 dwelling units or up to two (2) business and professional office buildings containing no more than 12,000 sq. ft and shall be subject to all bulk, use and signage limitations in the C-1 district regulations. 2. A final development plan and landscaping plan shall be submitted and approved for Lots 1 and 2 prior to issuance of a building permit. The final site development plans for Lot 1 (Phases I & II) shall be in substantial conformance with the approved preliminary site development plan, landscaping plan and elevation drawings. Plans for signage, site lighting, fencing and dumpster enclosures shall be shown on the final site development plan. 3. The developer shall be responsible for providing a public sidewalk connection from the apartment entrance to the Magnolia Road — Ohio Street intersection as part of Phase I. 4. The Fire Chief shall approve design plans for the emergency access road connecting the Knox Sandpit Ditch road to Lot I prior to issuance of a building pen -nit for Phase I. An emergency access road or ring road to provide access around the east side of the apartment buildings shall be provided in Phase II. 5. The City Engineer shall be approve final site grading and stotmwater drainage plans and shall certify that adequate water supply exists to meet required fire flows prior to issuance of a building permit for Phase I. Section 5. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper.
