ORDINANCE NUMBER 16-10836
AN ORDINANCE LEVYING A 0.75 PERCENT (0.75%) GENERAL
PURPOSE RETAILERS' SALES TAX WITHIN THE CITY OF SALINA AND
REPEALING ORDINANCE NUMBER 08-10475.
WHEREAS, pursuant to the provisions of K.S.A. 12-187, et seq. (the "Act"), the
City of Salina, Kansas (the "City") is a city of the first class authorized to implement a local
retailers' sales tax upon all retail sales within the boundaries of the City, except as
specifically exempted by such legislation; and
WHEREAS, on January 25, 2016, the Governing Body of the City adopted
Resolution Number 16-7317 submitting to the electors of the City, pursuant to the Kansas
Mail Ballot Election Act (K.S.A. 25-531, et seq.), the question of whether the City's
current 0.40 percent (0.40%) special purpose retailers' sales tax should be repealed and
replaced with a 0.75 percent (0.75%) general purpose retailers' sales tax (the "Sales Tax"),
the proceeds of which shall be used to pay the cost of improving neighborhood streets and
drainage; preserving a stable property tax rate; ensuring a quality park system; constructing
and maintaining capital improvements; funding equipment; funding bonded debt issued for
capital improvements; and continuing to support a fund managed by the City to attract
quality jobs, with such Sales Tax to commence on October 1, 2016, or as soon thereafter as
may be permitted by the Act, and terminate twenty (20) years after the Sales Tax is first
collected; and
WHEREAS, the question of imposition of the Sales Tax was submitted to the
electors of the City at a special question submitted mail ballot election on May 10, 2016;
and at the election a majority of the electors of the City voted in favor of the Sales Tax; and
WHEREAS, pursuant to the provisions of the Act, and the special question
submitted election held on May 10, 2016, the Governing Body deems it necessary and
advisable to levy the Sales Tax.
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. A 0.75 percent (0.75%) general purpose city-wide retailers' sales tax
is hereby levied, with collection of the Sales Tax to commence on October 1, 2016, or as
soon thereafter as permitted by law, and to expire twenty (20) years from the date the Sales
Tax is first collected.
Section 2. Ordinance Number 08-10475 levying a 0.40 percent (0.40%) special
purpose retailers' sales tax, and such sales tax and collection thereof, is repealed effective
on the commencement date of collection of the Sales Tax.
Section 3. The City Clerk is authorized and directed to forward a certified copy
of this ordinance to the Kansas Director of Taxation pursuant to K.S.A. 12-189 and request
the implementation thereof effective on October 1, 2016.

adoption and publication once in the official city newspaper by the following summary:

On June 13, 2016, the City Commission passed Ordinance No. 16-10836. The
Ordinance levies a 0.75 percent (0.75%) general purpose retailers' sales tax within
the City of Salina, commencing October 1, 2016, in place of the current 0.40
percent (0.40%) special purpose retailers' sales tax, and repeals Ordinance Number
