COUNTY COMMISSIONERS OF SALINE COUNTY,
- KANSAS.
A RESOLUTION ESTABLISHING A JOINT CITY-COUNTY CIVIL DEFENSE
ORGANIZATION BETWEEN THE CITY OF SALINA, KANSAS, AND THE COUNTY OF
-SALINE, KANSAS; ESTABLISHING A SALINA-SALINE COUNTY CIVIL DEFENSE
COUNCIL, PROVIDING POR THE MANNER OF APPOINTMENT THER1~OF AND DE-
FINING THE POWERS AND DUTIES OF SAID COUNCIL; CREATING THE POSITION
OF DIRECTOR OF CIVIL DEFENSE AND DEFINING THE DUTIES THEREOF; CREAT-
ING THE DIVISION Of SERVICE AND THE VARIOUS SUB-DIVISIONS THEREUNDER;
PROVIDING FOR THE CIVIL DEFENSE COUNCIL BUDGET AND EXPENDITURES; AND
REPEALING THE PROVISIONS OF RESOLUTION NO' 1201 and 25a~.
WHEREAS, the governing bodies of the City of Salina and County
of Saline, State of Kansas, deem it advisable to establish a joint
City-County Civil Defense Organization under the supervision of a
Council to include the City of Salina and the County of Saline in
order that there may be a closer co-ordination between various de-
f enge agancies now and to be es ta blished in the Ci ty of Sa lina and
the County of Saline; and,
WHEREAS, such a Council was heretofore created by said govern-
ing bodies, which such crea tion should be and it is hereby abroga ted
and repealed; and,
WHEREAS, it is deemed advisable to vest in said Council and
its subocdinates, power to implement, as directed, a program to af-
fectuate and carry out the precepts, pronouncements and basic poli-
cies in conformance with Civil Defense Laws of the State of Kansas,
and the State of Kansas Emergency Government Organizations.

Section 1. Purposes. The declared purposes of this resolution
are to provide for the preparation and carrying out of plans for the
protection of persons and property within Salina and Saline County
in the event of a disaster.
Section 2.
Def ini ti ons .
(a) Civil Defense. As used in this resolution, the term "Civil
Defense" means the preparation for and the carrying out of all emerg-
ency functions, othere than functions for which military forces or
other federal agencies are primarily responsible, to prevent, mini-
mize and repair injury and damage resulting from man-made or natural
disasters.
(b) Disaster. As used in this resolution, the term "disaster"
shall mean actual or threatened enemy attack, sabotage, extraordinary
fire, flood, storm, epidemic, riot, earthquake or other similar public
ca 1ami ty.
Sec ti 011 3.
Organization of Council
(a) The Salina-Saline County Civil Defense Council shall
consist of five (5) members to be selected as follows:

The City Manager of the City of Salina;
A member of the Board of Commissioners of Salina
to be chosen by said Board of Commissioners;
A civilian member to be chosen by the Board of
Commis 5i oners of the Ci ty of Sa lina ~
A member of the Board of Cotmty Commissioners of
Saline County to be chosen by said Board of County
Commissioners;

A civilian member to be chosen by the Board of County
Commissioners of Saline County, Kansas.
(b) The appointive members of the Council shall serve at the
pleasure of the appointing body; and in the event of the resigna-
tion or death of any member of the Council, his position shall be
. filled by the original appointing body.
(c) The members of the Council shall serve without compensa-
,tieD, but shall be reimbursed for actual and necessary expenses in-
curred in connection with their duties.
(d) The Organization shall be provided with appropriate office
space, supplies and equipment, but it shall incur no expense until
the same has been authorized by the governing bodies of the Ci ty and
County, and the funds from which such expenses shall tie payable have
been designated. Provided, nothing herein shall be construed as
requiring such authorization or designation where work. is done by a
regular officer, office, department, board or other agency of the
City or County for the benefit of the Council.
Section 4. Power and Duties of the Council. The Salina-Saline
County Civil Defense Council shall have the following powers and
duties:
(a) To employ an overall Director to supervise and co-ordinate
the activities of all Civil Defense agancies in the City and County.
Said Director shall have authority to make additional appointments,
however, shall be confirmed by the Council before becoming effective.
(b) To adopt, amend and repeal rules, regulations and by-laws
governing its procedures and activities.
(c) To supervise the Office of Civil Defense and to cooperate
with any federal and state agencies created and existing from time
to time for the purpose of effectuating Civil Defense.
(d) To act jointly and co-operate with other local defense
counc i Is.
(e) To assist the State Council of Defense and perform such
services as will be required of it.
(f) To create boards and/or committees, either within or
without its membership, to aid it in the discharge of its power and
duties.
(g) To supervise and direct investigations and report to thl
governing bodies of the City and County and to the Governor and
State Civil Defense Director with recommendations for legislation,
regulations or other appropriate action as it may deem necessary
with respect to the type of activity or matters of public concern
or welfare insofar as the same shall or may be related to defense
and relief from the effects of man-made or natural dis.¡sters.
(h) To request the cooperation and assistance of the agencies
and officials of the City of Salina and County of Saline, State of
Kansas.
(i) To confirm, authorize and approve appointees or employees,
subordinate officers and administrative plans and the expenditure
of funds.
(j)
To exercise the legislative function.
Section 5. Director of Civil Defense Powers and Duties
There is thereby created the position of Director of Civil Defense.
Such Director shall be employed by the Council.

The Director is hereby empowered:
(a) To request the joint Boards of Ci ty and County Commissioners
to proclaim the existence or the threatened existence of a disaster or
an emergency and the termina tion thereof; if the join t Boards of the
Ci ty and COull ty Commi ssi oners is in sessi on, or, to issue such proc la-
mation if the joint Boards of City and County Commissioners is not in
session, subject to confirmation by the joint Boards of City and County
Commissioners at the earliest practicable time.
(b) Through the joint City and County Commissicmers to proclaim
a state of disaster or a state of extreme emergency when in the opin-
ioo of the Director, the resources of the area or region are inade-
quate to cope with the disaster.
(c) To control and direct the effort of the Civil Defense
organiza tion in this Ci ty and Coun ty for the accomplishmen t of the
purpose of this resolution.
(d) To direct co-ordination and cooperation between divisions,
services and staff of the Civil Defense Org~nization of this City
and County, and to resolve questions of authority that may arise be-
twe~ them.

(e) To administer Civil Defense pursuant to programs and methods
approved by the Council.
(f) To perform the administrative function of the Office of
Ci vi 1 Def en s e .
(g) To represent the Civil Defense Organization of this City
and County in all dealings with public or private agencies pertain-
ing to Civil Defense functions.
Section 6. Successor Director. In the event of the death
nonavailability or fairuie of the Director to act, subject to the'
order of the Council, the Assistant Director shall th,ereupon become
the Director and shall be vested with all the powers of the Director,
Upon like events, the successor Director shall be likewise succeeded
by a person designated in writing by the Council.
Section 7. Civil Defense Organization. All officers and em-
ployees of ttis City and County, together with these volunteer forces
enrolled to aid them during a disaster, and all group$, organiza-
tions and persons who may by agreemen t or opera tion of law be charged
with duties incidental to the protection of life and property in this
City and County during such disaster, shall constitute the Civil De-'
fense Organization of the City of Salina and County of Saline, State
of Kansas.
Section 8. Division of Operating and Supporting Services.
There is hereby created a division of Services. ThesE~ divisions shall
be under the direction of a Deputy Director of Operating and support-
ing services, who shall be appointed by the Director. The Chiefs of
each service wi thin these di visions shall be responsible to the Direc-
tor thr ough the Depu ty Dir ec t or of Opera ting and suppor ting services.

The Direc tor aha II appoin t a chief of each servic:e except as
hereinafter provided. The Chief of the Fire Department of the City
of Salina, sbal1 be the Chief of th~ fire service. The Chief of
Police of the City of Salina and Sheriff of Saline County shall be
Chiefs of the police service. The County Heá1th Officer shall be
the Chief of the health service. The County Welfare Director shall
be the Chief of the welfare service. The Manager of 'the Kansas State
Emp10y.ent Service for Saline County shall be the Chief of the aan-
power service. The Ci ty and County Engineers shall be the Chiefs
of the engineering service.
(c)
Division of Training, Information and Special Services.
This Division shall be under the direction of the Director, for
the purpose of training, inf orma ti on and special services, and shall
consist of the following:

The City and County Attorneys shall serve as Chiefs of the legal
service.
Section 9. Duties of Staff. The Director shall prescribe the
Civil Defense duties of the DeputY Directors and the Chiefs of Oper-
ating, supporting and training. Information and Special Services,
in conformity with the Operational Survival Plan of this City and
County, as approved by the joint Boards of City and County Coamis-
sioners, and with the State of ~nsas Operational Survival Plan.
Such duties may be changed from time to time by the Director by writ-
ten administrative orders, particularly for the purpose of conform-
ing to recommendations of the Director of the Kansas State Civil De-
fense Agency or modifications made by the National Plan for Civil
Defense.
Section 10. Budget and Expenditures. The Civil Defense Council
shall prepare a proposed budget estimating the amount of funds neces-
sary to carryon the program of Civil Defense which budget shall be
submitted to the governing bodies of the City and County as is herein
provided, the funds necessary to meet the necessary expenditures shall
be provided equally by the City of Salina and County of Saline. Pay-
ment of all bills shall be made as provided by law, provided current
monthly operating expenses shall be certified to the Council.
Section ll. American Red Cross. The Director shall be respons-
ible for arranging, tfírough the Chairman of the Red Cross Chapter in
Salina and Saline County, for the participation of tbe Red Cross in
Civil Defense as a part of the mass care service in case of war-
caused disaster, and for the relationship between the Red Cross and
the Civil Defense Organization in case of natural disaster.
Section l2. Termination of Council. Such Civil Defense Council
shall terminate or cease activities whenever the Council is dissolved

or suspended by action of the joint Boards of Ci ty and County
Commissioners, or as by law provided.
Section 13. It is hereby declared necessary for the preserva-
tion of the public peace, health and safety.
Adopted and approved by the Board of Commissioners of the
County of Saline, at Salina, Kansas, this 7<.3 day of April, 1962.
