ORDINANCE NUMBER 16-10837
AN ORDINANCE EXTENDING THE MORATORIUM ON SALINA
PLANNING COMMISSION CONSIDERATION OF PLATS OF SUBDIVISIONS
WITH FRONTAGE ON AN UNPAVED ROAD THROUGH MONDAY, AUGUST f5,
2016 AND SUSPENDING ALL RELATED TIME LIMITATIONS UNDER
CHAPTER 36 OF THE SALINA CODE FOR CONSIDERATION OF SUCH PLATS'.
WHEREAS, the matters of (a) street frontage and access requirements, (b) required
paving of those frontage streets, and (c) the allocation of the cost of those improvements
among the developer, property owners within the subdivision, and the city -at -large,
collectively present significant policy considerations to be addressed at the subdivision
platting stage of real estate development;
WHEREAS, on March 7, 2016, the Governing Body adopted Ordinance No. 1,6-
10827, effective March 10, 2016 imposed a ninety (90) day moratorium upon Salina
Planning Commission consideration of plats of subdivisions with frontage on an unpaved
road and suspended all related time limitations under Chapter 36 of the Salina Code,
WHEREAS, the Governing Body finds that considerable staff, Planning
Commission, and Governing Body efforts have advanced consideration of the matter;
however, the public interest warrants further review and consideration of any needed
modification of the City's current subdivision regulations and policies relating those matters
described above, and j
WHEREAS, review of the policy and legal considerations affecting those matters
requires an extension of the moratorium on Salina Planning Commission consideration 'of
plats of subdivisions with frontage on an unpaved street; SO NOW, THEREFORE,
BE IT ORDAINED by the Governing Body of Salina, Kansas:
Section 1. Moratorium Extension. The Governing Body extends through Monday,
August 15, 2016, the moratorium upon Salina Planning Commission consideration of plats 'of
subdivisions with frontage on an unpaved road and suspends all related time limitations
under Chapter 36 of the Salina Code.
Section 2. Effective. This ordinance shall be in full force and effect from and after
its adoption and publication once in the official city newspaper by the following summary:!,

Ordinance No. 16-10837 Summary
On June 6, 2016, the City Commission passed Ordinance No. 16-10837. The
Ordinance extends through Monday, August 15, 2016 the current moratorium upon
Planning Commission consideration of plats of subdivisions with frontage on an
