BOX 122-20.1 WEST ¡nO:\, SALINA, KANSAS 57401 October 1, 1971 Salina City Commission City-Colmty Building Salina, Kansas 67401 Re: Salina Community Relations Com.mission Dear Commissioners: Pursuant to our rules please accept the following as a report on the progress and activities of the Salina Community RelaUons Commission since its beginning in April of 1970. As you lmow, shortly after the enabling ordinance was passed your body appointed Mrs. Shirley Jacques, Reverend J. E. Jones, George Johnson, J. Q. Rodriguez, and Phillip Aldrich to act on the Commission, which members are still sitting as the Community Relations Commission. The first meeting of our Commission was held June 10, 1970, at \vhich time it was decided to hold quarterly meetings, and the next meeting was scheduled for July 8, 1970. At our first meeting we discussed and acted on a letter from Wendell Kellogg wherein he requested certain interpretations the Commission would place on the key aspects in the fair housing ordinance. Attached to this report is a photocopy of the reply sent to Mr. Kellogg in relation to his request. On August 7, 1970, a complaint was filed before the Commission by Morris Tabor. The facts of said complaint were investigated and the parties informed of the CommissionTs determination--no probable cause existed for such complaint. The complainant, Mr. Tabor, thereafter appealed from the decision; and a three member panel was appointed to hear Mr. TaborT s appeal. Prior to the time the appeal could be heard the respondent was involved in a serious accident, and the matter is still pending. . The Commission has received requests from other cities in Kansas for copies of our ordinance, which requests have been filled. Salina City Commission October 1, 1971 Page Two On July 7, 1971, the Community Relations Commission met in a special session to consider three complaints which had been filed. Assignments of investigation were made, investigation undertaken, and in two of the complaints a determination was made that there was probable cause to believe discrimination had been practiced after which the respondents were again contacted and conciliation and persuasion was accomplished whereby the parties agreed to refrain from further discrimination. The third complaint was dismissed by the conlplainant. The C::mlmission, after finishing \vith the last two complaints, decided that some time in the near future a request \vould be placed before the City Commissioners for funds to employ a part-time investigator to not only investigate and compile the facts under complaints, but also to work on complaints which the Community Relations Commission would undertake to initiate. On July 28, 1971, Reverend Jones and Phillip Aldrich attended the tenth convention of the Kansas Chril Hights Convention in Topeka. At this convention after Heverend Jones and 1\'Ir. Aldrich listened to the various complaints of the other commissions from around the state, it became obvious that Salina has the most far-reaching and workable fair housing law in the state. Kellogg Marietta, Kellogg, and 148 South Seventh Salina, Kansas 67401 Lord Dear Mr. Kellogg: Please be advised that the Salina Community Relations Council met this day and took un¿er consideration your letter addressed to Mr. Bengtson of May 4, 1970. After discussing the various questions which you have posed, we came to the conclusion that, at this time, we do not have sufficient facts to answer your questions. After further considering your questions, we deemed it advisable to adopt a policy of refusing to render advisory opinions on abstract or moot questions. We deem our job, in relation to your letter, to adjudicate, in accordance with Salina's Code, actual complaints and bonafide controversies. If you question our position or would desir~ to discuss the letter further with us, we will have a public meeting of the Salina Communi t~y Relations Council on July 8 at 4:00 p,m. in the City Commission Room, Room 200, City-County - Board of Education Building.
