OVERLAND PARK ALCæOL DIVERSION PROGRAM
PROGRAM DESCRIPTION
The Alcohol Diversion Program is an alternative to the normal court disposition
of alcohol-related offenses. At the same time, the program provides an
opportunity for an individual to identify an alcohol problem and delrelop a
treatment program. You have been arrested for an alcohol-related offense. The
Alcohol Diversion Program provides you two options:
1.
Voluntarily enter the Alcohol Diversion Program. You will be evaluated
for possible alcohol problems, be required to report to the Program
~bnitor as assigned, and may be required to complete a treatment plan.
If you successfully complete the program, the City will dismiss the
charge against you.
2.
Do not enter the Alcohol Diversion Program.

Program Components

1.
Evaluation - The first step is an evaluation to determine the existence
of an alcohol problem, if any. The evaluation is performed by Substance
Abuse Consultants, Inc. (6005 Martway, 722-3866). The evaluation
identifies three stages of alcoholism - Social Drinker, Problem Drinker,
Extreme Problem Drinker. Your treatment plan will be based on this
evaluation. The Program Monitor will schedule the initial evaluation.
You may be referred to other agencies to determine a treatment plan.
2.
Treatment Plan - First, you are required to attend the Alcohol Information
School if you have not attended previously. You are responsible for the
$40 fee. Additional treatment programs will be prescribed by the
agency performing the evaluation or other treatment providers. You
may suggest an Alternative Treatment Plan subject to approval by the
Municipal Court. You are responsible for all treatment costs.
General Conditions of Diversion - The following conditions are stipulated

a.
The Alcohol Diversion Agreement shall extend up to twelve months.
b.
You may not conSlDTIe intoxicating liquor or cereal malt beverages
during the term of this program.
c.
You stipulate that police reports, written statements of witnesses
and the results of any test may be admitted into evidence in
Municipal Court and the District Court without foundation or
further test-taking.
d.
You may seek modification of the Alcohol Diversion Agreement on
motion of the Municipal Court. Contact the Program Monitor if
needed.
e.
The charge will be dismissed if you successfully complete the terms
and conditions of your diversion.
4.
Monitoring - The Program Monitor will follow your progress while you
are partlcipating in the program. You are required to report to the
Program Monitor on a regular basis as well as verify your attendance
at prescribed treatment sessions. The Program Monitor is officed in the
Overland Park Justice Center, 8500 Antioch. The Program Monitor may
seek modification of the Alcohol Diversion Agreement on motion of the
Municipal Court.
5.
Termination of Alcohol Diversion Plan
a.
Successful completion of the Alcohol Diversion Agreement will result
in termination of the program and dismissal of the charge.
b.
The program will be terminated and the case set for trial if you
fail to complete the Alcohol Diversion Agreement or violate any of
its provisions.
