16-7317 General Purpose Retailer's Sales Taxx Z w RESOLUTION NUMBER 16-7317 A RESOLUTION SUBMITTING TO THE ELECTORS OF THE CITY OF SALINA, KANSAS, THE QUESTION OF WHETHER THE CITY'S CURRENT 0.40 PERCENT (.40%) SPECIAL PURPOSE RETAILERS' SALES TAX SHOULD BE REPEALED AND REPLACED WITH A 0.75 PERCENT (0.75%) GENERAL PURPOSE RETAILERS' SALES TAX FOR A PERIOD OF TWENTY (20) YEARS AND SPECIFYING THE PURPOSES FOR WHICH THE PROCEEDS WOULD BE USED. BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. Pursuant to K.S.A. 12-187, the Governing Body authorizes and directs that a special question election be conducted under the Kansas Mail Ballot Election Act (K.S.A. 25-431, et seq.) on May 10, 2016, at which time there shall be submitted to the qualified electors of the City the following proposition: Shall the following be adopted? Shall the City of Salina, Kansas be authorized to repeal its current 0.40 percent (.40%) special purpose retailers' sales tax scheduled to expire March 31, 2019, and replace it with a 0.75 percent (0.75%) general purpose retailers' sales tax, the proceeds of which shall be used to pay the cost of: - improving neighborhood streets and drainage; - preserving a stable property tax rate; - ensuring a quality park system; - constructing and maintaining capital improvements; - funding equipment; - funding bonded debt issued for capital improvements; and - continuing to support a fund managed by the City to attract quality jobs; with such general purpose retailers' sales tax to commence on October 1, 2016, or as soon thereafter as permitted by law, and terminate twenty (20) years after its commencement, all pursuant to the provisions of K.S.A. 12-187 et seq., as amended? Section 2. The vote at said special question election shall be by mail ballot, and the proposition stated above shall be printed on the ballots, together with voting instructions as provided by law. The City Clerk is directed to request that the County Election Officer give notice of the special election as provided by law by publishing a Notice of Special Election once each week for two (2) consecutive weeks in a newspaper of general circulation in the City, with the first publication to be not less than twenty-one (2 1) days prior to the date of the special election, and the last publication being not more than forty-five (45) days prior to the date of the special election. Section 3. This ordinance shall be in full force and effect from and after its adoption. Adopted by the Board of Commissioners and signed by the Mayor this 25th day of January, 2016.
