RESOLUTION NUMBER 01-5753
A RESOLUTION INDICATING THE DESIRE OF THE GOVERNING BODY TO
INITIATE THE PROCESS FOR CONSIDERATION OF THE VACATION OF RIGHT-OF-
WAY, SETTING A PUBLIC HEARING AND DIRECTING PUBLISHED NOTICE OF THE
PUBLIC HEARING, ALL PURSUANT TO K.S.A. 12-504.
WHEREAS, the South Ohio Corridor Project resulted in the redirection of a segment of
Wayne Avenue; and
WHEREAS, the governing body wishes to initiate the process for consideration of the
vacation of the right-of-way for that segment of redirected Wayne Avenue no longer utilized as a
public street legally described on the attached Exhibit A and depicted on the attached Exhibit B (the
"Right-of-way"); and
WHEREAS, existing public utilities located in the Right-of-way require the reservation of a
public utility easement covering the same area as the Right-of-way; SO NOW, THEREFORE
BE IT RESOLVED by the Governing Body of the City of Salina, Kansas:
Section 1. The City desires to initiate the process pursuant to K.S.A. 12-504 for
consideration of the vacation of the Right-of-way and the reservation of a public utility easement in
its place.
Section 2. The public hearing for consideration of the proposed vacation of the Right-of-
way is scheduled for the regular meeting of the governing body at 4:00 p.m. on Monday, September
24, 2001.
Section 3. The City Clerk is directed to arrange for notice of the public hearing to be
published in The Salina Journal at least 20 days prior to the date of the public hearing.
Section 4. This Resolution shall be in full force and effect from and after its adoption.
Adopted by the Board of Commissioners and signed by the Mayor this 27th day of August,
2001.

Wayne Avenue & Belmont Boulevard Rizht-of-Wav to be Vacated
Exhibit "A"
A parcel of land located in Shalimar Plaza Addition & Belmont Addition to the City of Salina, Saline County,
Kansas, and acquired School Grounds taken in Misc. Book 173, Pages 530-533, more particularly described as
follows:
Beginning at the Southwest corner of Lot 5, Block 6, Shalimar Plaza Addition:
- Thence East along the South line of said Block 6 on an assumed bearing of N 90° 00' 00" E, a distance of
242.83 feet;
- Thence along a curve to the right having a radius of 55.27 feet, an arc distance of 49.18 feet , said curve having
a long chord of 47.57 feet and a bearing of S 11° 58' 49" W1-

;- Thence N 89° 57' 51" W a distance of 116.54 feet;
- Thence along a curve to the left having a radius of 241.54 feet, an arc distance of 126.80 feet, said curve
having a long chord of 125.35 feet and a bearing of 68° 14' 35" W back to the point of beginning.
The above-described parcel of land contains 7832 square feet or 0.18 acres, more or less, and will be vacated as
street right-of-way and will be retained as utility & pedestrian easement, as shown in Exhibit "A"
