(Published in the Salina Journal on January 4 200-4) ORDINANCE NUMBER 03-10162 AN ORDINANCE PROVIDING FOR THE VACATION OF A 60 -FOOT SECTION OF CONTROLLED ACCESS TO THE PROPOSED MARSHALL MOTOR COMPANY AUTOMOBILE DEALERSHIP LOCATED ON LOT 2, BLOCK 1, LONG-MCARTHUR ADDITION TO THE CITY OF SALINA, SALINE COUNTY, KANSAS., BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. That on August 4, 2003, the governing body conducted a public hearing on the petition of Larry Marshall, Marshall Motor Company, Inc. ("Petitioner") requesting vacation of a 60 foot section of controlled access on South Ninth Street for the purpose of constructing a driveway access to the proposed Marshall Motor Company automobile dealership located on Lot 2, Block 1, Long -McArthur Addition to in the City of Salina, Saline County, Kansas. hearing that: Section 2. That the governing body finds from the evidence presented at the public (a) Due and legal notice has been given by publication as required by law. (b) No private rights will be injured or endangered by vacation of the access control. (c) The location of the Entrance as proposed in accordance with the traffic impact study recently completed by the Petitioner's traffic engineer; (d) The Entrance as proposed can be made safe and effective if the Entrance is properly designed and coordinated with the Water Well Road and I-13 5 Interchange Project. (e) In justice to the Petitioner vacation of controlled access should be granted. Section 3. That the access control is hereby vacated and shall revert to the owners of Lot 2, Block 1, Long Mc -Arthur Addition in the City of Salina, Saline County, Kansas. Section 4. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper.
