08-13-1984 Minutes84-184 84-185 CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS AUGUST 13, 1984 4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, August 13, 1984, at four p.m. There were present: Mayor Charles B. Roth, Chairman presiding Commissioner John F. Burgess Commissioner Merle A. Hodges Commissioner Joseph M. Ritter comprising a quorum of the Board, also present: L. 0. Bengtson, City Attorney D. L. Harrison, City Clerk Rufus L. Nye, City Manager Absent: Commissioner Fortino B. Bonilla None CITIZEN FORUM AWARDS - PROCLAMATIONS (4.1) The Mayor presents plaques of appreciation to past board and commission members: Larry Justus and Josephine Hernandez, past members of the Human Relations Commission. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME (5.1) Public Hearing on the Proposed 1985 Budget including Revenue Sharing Funds. No protests, written or oral, were filed and the Mayor declared the public hearing closed. (5.1a) Resolution Number 84-3724, adopting the 1985 Annual Budget. Moved by Commissioner Hodges, seconded by Commissioner Ritter that Resolution Number 84-3724, adopting the 1985 Annual Budget, be adopted. Aye: (4). Nay: (0). Motion adopted. (5.1b) First Reading Ordinance Number 84-9034 - providing for the adoption and appropriation, by fund, of the budget of the City of Salina for the year beginning January 1, 1985; and appropriating money from the various funds to pay payrolls and claims against the City of Salina for the calendar year 1985. Moved by Commissioner Burgess, seconded by Commissioner Hodges that Ordinance Number 84-9034, providing for the adoption and appropriation, by fund of the budget of the City of Salina for the year beginning January 1, 1985; and appropriating money from the various funds to pay payrolls and claims against the City of Salina for the calendar year 1985 be introduced for first reading. Aye: (4). Nay: (0). Motion adopted. (5.2) Public Hearing on the possible issuance of $800,000 Economic Development Revenue Bonds for Wilbur Construction Company. No protests, written or oral, were filed and the Mayor declared the public hearing closed. Moved by Commissioner Hodges, seconded by Commissioner Roth that Resolution Number 84-3728, indicating the intention of the City of Salina to issue $800,000 Revenue Bonds for Wilbur Construction Company pursuant to Kansas Economic Revenue Bond Act, be adopted. Aye: Burgess, Roth (2). Nay: Hodges (1). Commissioner Ritter abstained. Commissioner Bonilla absent. Motion defeated. 84-187 I "i CONSENT AGENDA (6.1) Approve the Minutes of the Regular Meeting July 23, 1984. (6.2) Approve the Minutes of the Regular Meeting August 6, 1984. (6.3) Resolution Number 84-3725 - adopting the Job Classification and Salary Schedule for city employees, created pursuant to Section 2-51 of the Salina Code, and repealing Resolution Number 83-3652 and all previous resolutions, motions or actions in conflict therewith. (6.4) Resolution Number 84-3726 - requesting that the Director of Accounts and Reports waive the requirements of law relating to the preparation of financial statements and financial reports pursuant to K.S.A. 1982 Supp. 75-1120a. (6.5) Report on Bids received August 2, 1984 for Engineering Project 84-722 for slurry seal improvements of certain streets. (Contract awarded to Ballou Construction Company for $317,420.00) (6.6) Report on Bids received August 2, 1984 for Engineering Project 84-723 for machine laid seal improvements of certain streets. (Contract awarded to Brown & Brown, Inc. for $227,550) (6.7) City Engineer files plans and specifications for the construction of three well houses near the intersection of Ohio Street and Water Well Road. (Engineering Project 84-721). Set the date of August 23, 1984 to receive bids. (6.8) Resolution Number 84-3727 - determining the reasonable and safe maximum speed limit for trucks on Ohio Street between Pacific Street and Belmont Boulevard. (6.9) City Engineer files a feasibility report for street improvements on Waverly Drive from Elmhurst Boulevard to Westchester Drive. [Requested in Petition Number 3877, filed by Byron F. Hutchison] (6.10) Resolution Number 84-3729 - determining the advisability of curbing, guttering, paving and grading improvements, estimating the cost thereof, defining the boundaries of the improvement district, method of assessment, and apportioning the cost between the improvement district and the city -at -large. Moved by Commissioner Ritter, seconded by Commissioner Hodges that all items on the consent agenda be approved. Aye: (4). Nay: (0). Motion adopted. DEVELOPMENT BUSINESS (7.1) Recommendation from the City Planning Commission that Zoning Application 84-10, filed by Robert E. Messenger for the rezoning of part of Lot 1 and all of Lots 2 through 6, Block 1, Cloverdale Addition to I-2 Light Industrial Disrict be approved. (Introduce Ordinance 84-9035 first reading) Moved by Commissioner Hodges, seconded by Commissioner Burgess that the recommendation of the City Planning Commission be accepted and that Ordinance Number 84-9035, providing for the amendment of Ordinance number 8526, the same being Chapter 42 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the city and prescribing the proper uses thereof be introduced for first reading. Aye: (4). Nay: (0). Motion adopted. ADMINISTRATION (8.1) Recommendation from the City Planning Commission that Ordinance Number 82-8911 be placed on second reading, and then a vote by the City Commission to not adopt the ordinance. [Zoning Application 82-2, filed by Wally Storey, Jr. for the rezoning of a 1.2 acre tract of unplatted property lying west of North 13th Street and north of West Woodland to I-2 Light Industrial District] Moved by Commissioner Burgess, seconded by Commission Ritter that the City Planning Commission recommendation be denied and that an extension be granted until November 1, 1984 for the approval of a final plat for property lying west of North 13th Street and north of West Woodland. Moved by Commissioner Burgess, seconded by Commissioner Hodges, that Ordinance Number 84-9038, levying special assessments against certain lots and parts of lots to pay the cost of sidewalk repair in the City of Salina, Kansas, be introduced for first reading. (8.5) First Reading Ordinance Number 84-9039 - Prohibiting loitering on or in public places to the detriment or annoyance of the adjacent property owners and persons using said public property. Moved by Commissioner Hodges, seconded by Commissioner Burgess, that Ordinance Number 84-9039, prohibiting loitering on or in public places to the detriment or annoyance of the adjacent property owners or persons using said public property, be introduced for first reading. Connie Sink, 660 South Santa Fe, is concerned about the excessive traffic noise on Santa Fe from no mufflers and tire squeeling. Linda Lindberg, 116 East Ellsworth, said she has lived there 6 years, and has seen and heard everything, including bad language, noise, drunks, shotguns, etc. She suggested that maybe a curfew is needed. The Quick Trip Store at 1307 South Santa Fe is where the crowd gathers and then problems arise from this. Dave Rettele, 33 Crestview Drive, said there are a lot of good kids driving Santa Fe. He said he doesn't believe this ordinance is the answer to the problem you are trying to solve on Santa Fe. Gene and Peggy Hulstine, 824 South Santa Fe, agree with the others about the noise and excessive speed and beer cans and bottles on the parkings. They said most of the loitering is at the Quick Trip and the Sonic Drive In. Frank Crowl, 820 South Santa Fe, said the kids from out of the County come to Salina to cruise Santa Fe. The Mayor called for a vote on Commission Action 84-193. Aye: (4). Nay: (0). Motion adopted. OTHER BUSINESS The Mayor, with the approval of the City Commissioners made the following appointments: Grievance Committee Mike Lamone, reappointed for a 3 year term to August 9, 1987. Richard J. Courter, reappointed for a 3 year term to August 9, 1987. Jim McKim, reappointed for a 3 year term to August 9, 1987. Housing Advisory and Appeals Board N. C. Grant, reappointed for a 3 year term to September 15, 1987. Housing Authority E. L. Bengtson, reappointed for a 4 year term to September 15, 1988.
