The Regular Meeting of the Board of Commissioners met in the Commission
Meeting Room, City -County Building, on Monday, November 26, 1984 at four p.m.
There were present:

CONSENT AGENDA
(6.1) Approve the Minutes of the Regular Meeting November 19, 1984.
(6.2) Petition Number 3886 - filed by Douglas G. Hill for street,
storm sewer, water and sanitary sewer improvements for certain lots in
Mayfair Addition.
Moved by Commissioner Burgess, seconded by Commissioner Hodges
that all items on the Consent Agenda be approved. Aye: (4). Nay: (0).

(8.1) Second Reading Ordinance Number 81-8846 - providing for the
amendment of Ordinance Number 8526, the same being Chapter 42 of the Salina
Code and the Zoning District Map therein and thereby adopted and providing for
the rezoning of certain property within the city and prescribing the proper
uses thereof. [ Lot 1, Block 1, Lambertz Addition to C-3, requested in Zoning
Application 81-1, filed by Lambertz and Associates.]
Moved by Commissioner Hodges, seconded by Commissioner Ritter that
Ordinance Number 81-8846, providing for the amendment of Ordinance Number
8526, the same being Chapter 42 of the Salina Code and the Zoning District
Map therein and thereby adopted and providing for the rezoning of certain
property within the city and prescribing the proper uses thereof, be adopted.
Aye: Burgess, Hodges, Ritter, Roth (4). Nay: (0). Commissioner Bonilla
absent. Motion adopted.
(8.2) Second Reading Ordinance Number 84-9049 - providing for the
amendment of Ordinance Number 8526, the same being Chapter 42 of the Salina
Code and the Zoning District Map therein and thereby adopted and providing for
the rezoning of certain property within the city and prescribing the proper
uses thereof. [ Lots 1 through 15, Alt. Block 1, Pacific Addition to 1-2,
requested in Zoning Application 84-15, filed by Wallace W. Storey]

Ordinance Number 84-9049, providing for the amendment of Ordinance Number
8526, the same being Chapter 42 of the Salina Code and the Zoning District
Map therein and thereby adopted and providing for the rezoning of certain
property within the city and prescribing the proper uses thereof, be adopted.

(8.2a) Petition Number 3885, filed by residents within 200 feet of the
request area, protesting the rezoning of the property to 1-2.
(8.3) Second Reading Ordinance Number 84-9050 - authorizing the
issuance of $768,000 Internal Improvement Bonds, Series P-231.
Moved by Commissioner Hodges, seconded by Commissioner Ritter that
Ordinance Number 84-9050, authorizing and directing the issuance, sale and
delivery of $768,000 principal amount of general obligation internal improvement
bonds, Series P-231, of the City of Salina, Kansas, for the purpose of providing
funds to pay the cost of construction of storm sewers, water mains, sanitary
sewers and street improvements in the City of Salina, Kansas; prescribing the
form and details of said bonds; and providing for the levy and collection of
the necessary assessments and taxes for the purpose of paying the principal of
and interest on said bonds as they become due; and authorizing an agreement
between the City and the Bond Registrar, be adopted. Aye: Burgess, Hodges,
Ritter, Roth. (4). Nay: (0). Commissioner Bonilla absent. Motion adopted.
(8.4) Second Reading Ordinance Number 84-9052 - authorizing the
issuance of $5,505,000 Revenue Bonds for USD #1 (Ed Warmack).
Moved by Commissioner Ritter, seconded by Commissioner Burgess that
Ordinance Number 84-9052, authorizing the City of Salina, Kansas, to lease
certain real estate located within the corporate limits of the City and to
acquire, construct, install and equip on said leased real estate certain
buildings, facilities and improvements to be subleased 'to Salina Central Mall
Limited Partnership (Dillard's), a limited partnership; authorizing and
directing the issuance of and securing the $5,505,000 principal amount of
Salina, Kansas, Revenue Bonds [Salina Central Mall Limited Partnership
(Dillard's) Project], Series 1984 and securing a certain letter of credit
and substitute credit facilities securing payment of principal and interest
on said bonds, said bonds being issued for the purpose of providing funds for
the acquisition, construction, installation and equipping of said buildings,
facilities and improvements on said leased real estate to be used for retail
and commercial facilities to be subleased to Salina Central Mall limited
partnership (Dillard's), and paying certain related costs allocable thereto
prescribing the form and authorizing the execution of a certain lease
agreement between the City and Salina Central Mall Limited Partnership
(Dillard's), with respect to such leased real estate, buildings, facilities
and improvements and other matters, be adopted. Aye: Burgess, Hodges,
Ritter, Roth (4). Nay: (0). Commissioner Bonilla absent. Motion adopted.
(8.5) First Reading Ordinance Number 84-9051 - establishing an Arts and
Humanities Commission for the City of Salina; specifying the number of members,
manner of appointment and specifying their duties; creating the position of
Director of Arts; amending Article VII of Chapter 2 of the Salina Code and
repealing the existing Article VII.
Moved by Commissioner Hodges, seconded by Commissioner Burgess
that Ordinance Number 84-9051, establishing an Arts and Humanities Commission
for the City of Salina; specifying the number of members, manner of
appointment and specifying their duties; creating the position of Director
of Arts; amending Article VII of Chapter 2 of the Salina Code and repealing
the existing Article VII, be introduced for first reading. Aye: (4).

(8.6) Second Reading Ordinance Number 84-9040 - providing for the
amendment of Ordinance Number 8526, the same being Chapter 42 of the Salina
Code, and the Zoning District Map therein and thereby adopted and providing
for the rezoning of certain property within the city and prescribing the
proper uses thereof. (Zoning Application 84-11, filed by American Stores
Properties, Inc. for the rezoning of a tract of land in the South z of the
SEJ 26-14-3 to C-5 Service Commercial District)

Ordinance Number 84-9040, providing for the amendment of Ordinance Number
8526, the same being Chapter 42 of the Salina Code and the Zoning District

property within the city and prescribing the proper uses thereof, be adopted.
