REGULAR MEETING OF THE BOARD OF COMMISSIONERS
DECEMBER 3, 1984
4:00 p.m.
The Regular Meeting of the Board of Commissioners met in the Commission
Meeting Room, City -County Building, on Monday, December 3, 1984, at four p.m.
There were present:
Mayor Charles B. Roth, Chairman presiding
Commissioner Fortino B. Bonilla
Commissioner John F. Burgess
Commissioner Merle A. Hodges
Commissioner Joseph M. Ritter
comprising a quorum of the Board, also present:
L. O. Bengtson, City Attorney
D. L. Harrison, City Clerk
Rufus L. Nye, City Manager

CITIZEN FORUM
Col. Keith Duckers, St. John's Military School, asked Commissioner
Bonilla if he would give the Citizens of Salina a report on the meetings and
activities he attended at the National League of Cities Conference in
Indianapolis, Indiana.
PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME

CONSENT
(6.1) Approve the Minutes of the Regular Meeting November 26, 1984.
(6.2) City Engineer report on the sufficiency of Petition Number 3886
filed by Douglas Hill for certain street, storm sewer, water and sanitary
sewer improvements in Mayfair Addition, and filed a feasibility report.
(6.3) Recommendation from the City Engineer that Petition Number 3883
filed by Morrie Soderberg, requesting a pedestrian crosswalk and a
handicapped parking space in the 200 Block of North Santa Fe Avenue be
approved.
(6.3a) Resolution Number 84-3746 - designating a zone for
handicapped parking in the 200 Block of North Santa Fe Avenue.
(6.3b) Resolution Number 84-3747 - authorizing the installation
and marking of a pedestrian crosswalk in the 200 Block of North
Santa Fe Avenue.
Moved by Commissioner Hodges, seconded by Commissioner Ritter that
all items on the Consent Agenda be approved. Aye: (5). Nay: (0). Motion
adopted.
DEVELOPMENT BUSINESS
(7.1) Recommendation from the City Planning Commission that Zoning
Application 84-16, filed by ES Realty, Inc. for the rezoning of a portion
of Lot 7, Block 5, Georgetown to R-3 be approved.
(Introduce Ordinance Number 84-9053 for first reading.)

Moved by Commissioner Hodges, seconded by Commissioner Burgess
that the recommendation of the City Planning Commission be accepted and that
Zoning Application 84-16, filed by ES Realty, Inc. for the rezoning of a
portion of Lot 7, Block 5, Georgetown Addition to R-3 be approved, and that
Ordinance Number 84-9053, providing for the amendment of Ordinance Number
8526, the same being Chapter 42 of the Salina Code, and the Zoning District
Map therein and thereby adopted and providing for the rezoning of certain
property within the City and prescribing the proper uses thereof be introduced
for first reading. Aye: Bonilla, Burgess, Hodges, Roth (4). Nay: (0).
Commissioner Ritter abstained. Motion adopted.
(7.2) Recommendation from the City Planning Commission that Urban
Renewal Application 77-113, filed by Les Appleby on behalf of Gary Morgan
d/b/a Morgan Supply, Inc., for the approval of an amendment to the final
development plan for Lot 1, Block 8, Northeast Industrial Park be approved.
Moved by Commissioner Hodges, seconded by Commissioner Ritter that
the recommendation of the City Planning Commission be accepted and that
Urban Renewal Application 77-18, filed by Les Appleby on behalf of Gary
Morgan d/b/a Morgan Supply, Inc., for the approval of an amendment to the
final development plan for Lot 1, Block 8, Northeast Industrial Park be
approved. Aye: (5). Nay: (0). Motion adopted.
ADMINISTRATION
(8.1) Second Reading Ordinance Number 84-9039 - prohibiting loitering on
or in public places to the detriment or annoyance of the adjacent property
owners and persons using said public property. (Action was postponed on
August 27, 1984)
Moved by Commissioner Ritter, seconded by Commissioner Bonilla that
Ordinance Number 84-9039, prohibiting loitering on or in public places to
the detriment or annoyance of the adjacent property owners and persons
using said public property, be adopted.
Moved by Commissioner Hodges, seconded by Commissioner Burgess that
the second reading of Ordinance Number 84-9039 be postponed indefinitely.
Aye: (5). Nay: (0). Motion adopted.
(8.2) Second Reading Ordinance Number 84-9051 - establishing an Arts and
Humanities Commission for the City of Salina; specifying the number of members,
manner of appointment and specifying their duties; creating the position of
Director of Arts; amending Article VII of Chapter 2 of the Salina Code and
repealing the existing Article VII.
Moved by Commissioner Burgess, seconded by Commissioner Hodges
that Ordinance Number 84-9051, establishing an Art and Humanities Commission
for the City of Salina; specifying the number of members, manner of
appointment; specifying their duties; creating the position of Director of
Arts; amending Article VII of Chapter 2 of the Salina Code; and repealing
the existing Article VII, be adopted. Aye: Bonilla, Burgess, Hodges, Ritter,
Roth (5). Nay: (0). Motion adopted.
(8.3) First Reading Ordinance Number 84-9054 - prescribing the corporate
limits of the City of Salina, Kansas, including land described in Ordinance
Numbers 84-8993, 84-9009, 84-9024, and repealing Ordinance Number 83-8983.
Moved by Commissioner Ritter, seconded by Commissioner Hodges that
Ordinance Number 84-9054, prescribing the corporate limits of the City of
Salina, Kansas including land described in Ordinance Numbers 84-8993, 84-9009,
84-9024 and repealing Ordinance Number 84-8983, be introduced for first
reading. Aye: (5). Nay: (0). Motion adopted.
(8.4) First Reading Ordinance Number 84-9055 - authorizing the issuance
of $4,495,000 principal amount of Salina Central Mall limited partnership
(Penney's) Project) Series of 1984 Revenue Bonds.
Moved by Commissioner Bonilla, seconded by Commissioner Ritter that
Ordinance Number 84-9055, authorizing the issuance of $4,495,000 principal
amount of Salina Central Mall limited partnership (Penney's) Project Series of
1984 Revenue Bonds be introduced for first reading. Aye: (5). Nay: (0).

(8.5) Recommendation by the City Engineer concerning a request filed by
Robert Frobenius for permission to lay a plastic line across and along
Fairdale Road adjacent to Fairway Estates Addition.
Mr. Frobenius asked for permission to put a salt water line across
and along Fairdale Road adjacent to Fairway Estates Addition and felt $200.00
would be a fair price for this easement.
Moved by Commissioner Hodges, seconded by Commissioner Ritter that
the matter be tabled for two weeks so Mr. Frobenius can get with the City
Manager to negotiate a price for the easement. Aye: (5). Nay: (0).
Motion adopted.
OTHER BUSINESS
Pat Neustrom, Chairman of the Museum Committee, gave a report on
the Museum Committee activities over the past 15 months. He thanked all the
members of the Committee and thanked the City Commission for voting for a
museum.
Moved by Commissioner Burgess, seconded by Commissioner Ritter that
the Regular Meeting of the Board of Commissioners be adjourned. Aye: (5) .
Nay: (0). Motion adopted. The meeting adjourned at 4:30 p.m.
