06-17-1985 Minutes CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS JUNE 17, 1985 4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City-County Building, on Monday, June 17, 1985, at four p.m. There were present: Mayor Merle A. Hodges, Chairman presiding Commissioner John F. Burgess Commissioner Joseph M. Ritter Commissioner Stephen C. Ryan Commissioner Sydney S. Soderberg comprising a quorum of the Board, also present: L. O. Bengtson, City Attorney D. L. Harrison, City Clerk Rufus L. Nye, City Manager Absent: None CITIZEN FORUM None AWARDS- PROCLAMATIONS None PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME None CONSENT AGENDA (6.1) Approve the Minutes of the Regular Meeting June 10, 1985 (6.2) Report on bids received June 13, 1985 for Engineering Project 85-729 Machine Laid Seal on various streets. [Contract awarded to Brown and Brown, Inc. for $140,250.00.] (6.3) Report on bids received June 13, 1985 for Engineering Project 85-730 for Latex Modified Slurry Seal on various streets. [Contract awarded to Ballou Construction Company, Inc. for $416,199.50.] (6.4) Annual review of the Comprehensive Plan of the City of Salina. 85-119 Moved by Commissioner Burgess, seconded by Commissioner Ritter that all items on the Consent Agenda be approved. Aye: (5). Nay: (0). Motion adopted. DEVELOPMENT BUSINESS (7.1) Recommendation from the City Planning Commission that Zoning Application 85-5, filed by John R. Ferguson, for the rezoning of Lots 6 through 24, Alternating, Block 1, Van Trine Addition to District R-3 be approved. [Introduce Ordinance Number 85-9077 first reading] 85-120 Moved by Commissioner Ritter, seconded by Commissioner Ryan that the recommendation of the City Planning Commission be accepted and that Zoning Application 85-5 be approved and that Ordinance Number 85-9077, providing for the amendment of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the City and prescribing the proper uses thereof, be introduced for first reading. Aye: (5). Nay: (0). Motion adopted. ADMINISTRATION (8.1) Petition Number 3901 filed by downtown merchants requesting the elimination of the left turn restriction at the corner of Santa Fe and Iron. [Refer to the City Engineer for a recommendation] 85-121 Moved by Commissioner Soderberg, seconded by Commissioner Ryan that petition number 3901 be referred to the City Engineer for a recommendation. (8.2) First Reading Ordinance Number 85-9078 - providing the method of service of notice for the abatement of a nuisance; amending Section 24-7 of the Salina Code and repealing the existing section. 85-122 Moved by Commissioner Ritter, seconded by Commissioner Soderberg that Ordinance Number 85-9078, providing the method of service of notice for the abatement of a nuisance; amending Section 24-7 of the Salina Code and repealing the existing section, be introduced for first reading. (8.3) Resolution Number 85-3788 - determining it necessary to appropriate private property for use of the City of Salina, Kansas, for the purpose of constructing approximately 290 to 350 off-street parking spaces, arcades and crosswalks in the downtown business district as authorized by Resolution Number 85-3779 and authorizing and directing the City Engineer to make a survey and description of the land necessary for such purposes. 85-123 Moved by Commissioner Burgess, seconded by Commissioner Soderberg that Resolution Number 85-3788, determining it necessary to appropriate private property for use of the City of Salina, Kansas, for the purpose of constructing approximately 290 to 350 off-street parking spaces, arcades and crosswalks in the downtown business district as authorized by Resolution Number 85-3779 and authorizing and directing the City Engineer to make a survey and description of the land necessary for such purposes, and adding to the list of properties to be appraised the North 4½" of Lot 85, all of Lots 83, 81, and 79 on Seventh Street, Original Townsite, be adopted. Aye: (5). Nay: (0). Motion adopted.
