07-22-1985 Minutes CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS JULY 22, 1985 4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City-County Building, on Monday, July 22, 1985, at four p.m. There were present: Commissioner Joseph M. Ritter, Acting Mayor Commissioner John F. Burgess Commissioner Stephen C. Ryan Commissioner Sydney S. Soderberg comprising a quorum of the Board, also present: D. L. Harrison, City Clerk Rufus L. Nye, City Manager Absent: Mayor Merle A. Hodges, M.D. L. O. Bengtson, City Attorney CITIZEN FORUM E. H. Hagen, 2001 Ruskin Road, said that he is speaking for some of the elderly golfers. The proposed fees in the 1986 budget will price some people out of golfing. AWARDS - PROCLAMATIONS (4.1) The Mayor presented plaques of appreciation to Hassan Jafar and Bernice D'Souza, past members of the Human Relations Commission. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME None CONSENT AGENDA (6.1) Approve the Minutes of the Regular Meeting July 15, 1985. (6.2) Resolution Number 85-3795 - relating to benefits obtainable by cities under the program for federal and state aid on highway construction. [85 U-0833-01 - bridge project on Iron Avenue at the Smoky Hill River Channel between Iowa Avenue and Marymount Road] (6.3) Resolution Number 85-3796 - authorizing the Mayor or City Manager to execute amendment number 2 to the Department of Housing and Urban Development Annual Contributions Contract KC-7015. (6.4) Report on Petition Number 3903, filed by Don Vancil, for the vacation of an unused portion of Grand Avenue in Block 10, Chicago Addition. [Introduce Ordinance Number 85-9082 for first reading] 85-146 Moved by Commissioner Burgess, seconded by Commissioner Ryan that Item 6.4 of the Consent Agenda be considered under the Administration Agenda, and that all other items on the Consent Agenda be approved. DEVELOPMENT BUSINESS (7.1) Recommendation from the City Planning Commission that Plat Application 85-2A, filed by the Brown Mackie Corporation, for the approval of the Final Plat of Wheatridge Addition, be approved. [Authorize the Mayor to sign the final plat.] 85-147 Moved by Commissioner Soderberg, seconded by Commissioner Burgess that the recommendation of the City Planning Commission be accepted and that the final plat of Wheatridge Addition be approved and that the Mayor be authorized to sign the final plat. ADMINISTRATION (8.1) Presentation of the proposed 1986 Budget, including Revenue Sharing, arid set the date of August 5, 1985 at 4:00 p.m. for a public hearing. 85-148 Moved by Commissioner Soderberg, seconded by Commissioner Burgess that the proposed 1986 Budget, including Revenue Sharing, be approved for publication and that August 5, 1985 at 4:00 p.m. be set for a public hearing. (8.2) Second Reading Ordinance Number 81-8856 - providing for the amendment of Chapter 42 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the city and prescribing the proper uses thereof. [Z81-8, filed by Dean Lemmon for the present Hurd Plaza Addition] 85-149 Moved by Commissioner Burgess, seconded by Commissioner Ryan that Ordinance Number 81-8856, providing for the amendment of Chapter 42 of the Salina Code and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the city and prescribing the proper uses thereof be adopted. Aye: Burgess, Ryan, Soderberg, Ritter (4). Nay: (0). Motion adopted. (8.3) Second Reading Ordinance Number 85-9080 - establishing the requirements for commercial and industrial fences; amending Section 8-409 of the Salina Code and repealing the existing section. 85-150 Moved by Commissioner Burgess, seconded by Commissioner Ryan that Ordinance Number 85-9080, establishing the requirements for commercial and industrial fences; amending Section 8-409 of the Salina Code and repealing the existing section, be adopted. Aye: Burgess, Ryan, Soderberg, Ritter (4). Nay: (0). Motion adopted. Bill Dillinger, owner of Dillenger Fence Company would like to see the ordinance amended to include 9, 10 or even 12 foot fences in setback areas. The Commission took no action on this request. (8.4) Second Reading Ordinance Number 85-9081 - providing for the amendment of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the city and prescribing the proper uses thereof. [Z85-7, filed by Kenneth Opat] 85-151 Moved by Commissioner Soderberg, seconded by Commissioner Burgess that Ordinance Number 85-9081, providing for the amendment of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the City and prescribing the proper uses thereof, be adopted. Aye: Burgess, Ryan, Soderberg, Ritter (4). Nay: (0). Motion adopted. (8.5) Request by the Salina Housing Authority for amendment to extend the Section 8 Rental Assistance for two years ending August 1, 1988; payment of fiscal year 1985 payment in lieu of taxes; and a request that the payment in lieu of taxes arrearage for fiscal years 1977 to 1983 be forgiven. Larry Edwards, Chairman of the Salina Housing Authority presented the t3ayor with a check in the amount of $7,044.47 for the 1984 payment in lieu of taxes. 85-152 Moved by Commissioner Soderberg, seconded by Commissioner Ryan that the Housing authority request that the payment in lieu of taxes arrearage for fiscal years 1977 to 1983 be forgiven be postponed until the August 5, 1985 meeting. Aye: (4). Nay: (0). Motion adopted. (8.6) Consent Agenda Item 6.4 - A report on Petition Number 3903, filed by Don Vancil for the vacation of an unused portion of Grand Avenue in Block 10, Chicago Addition. 85-153 Moved by Commissioner Burgess, seconded by Commissioner Ryan that the City Engineer's recommendation be accepted and that Ordinance Number 85-9082 be introduced for first reading. Aye: (4). Nay: (0). Motion adopted. 85-154 Moved by Commissioner Burgess, seconded by Commissioner Ryan that the Regular Meeting of the Board of Commissioners be adjourned. Aye: (4). Nay: (0).
